BALAKRISHNAN NAIR &amp; P.N.RAVINDRAN, JJ.\n\n                   ------------------------------\n                        W.A.No.212\/2010\n                   ------------------------------\n\n               Dated this, the 19th day of March, 2010\n\n\n                           JUDGMENT\n<\/pre>\n<p>Balakrishnan Nair, J.\n<\/p>\n<p>     The 5th petitioner in the Writ Petition is the appellant. He<\/p>\n<p>was included in the rank-list published by the Public Service<\/p>\n<p>Commission for appointment to the post of Printer Grade-II in<\/p>\n<p>the Government Presses in Thiruvananthapuram. The persons<\/p>\n<p>included in the said rank-list are to be appointed in Letter<\/p>\n<p>Presses.   But, in view of the change in technology and the<\/p>\n<p>machines used, printing using Letter Press has become scarce<\/p>\n<p>and now offset printers are being used. Therefore, the existing<\/p>\n<p>Printers Grade II in the Letter Presses are given training and<\/p>\n<p>deployed to man Offset Presses, though the said persons are<\/p>\n<p>working in sanctioned posts.        Pointing out that there are<\/p>\n<p>vacancies in the sanctioned posts, the appellant and others filed<\/p>\n<p>the Writ Petition. But, the official respondents submitted that<\/p>\n<p>no sufficient Letter Presses are available for accommodating the<\/p>\n<p>WA No.212\/2010\n<\/p>\n<p>                                &#8211; 2 &#8211;\n<\/p>\n<p>appointees, if the existing vacancies are reported to the Public<\/p>\n<p>Service Commission. Accepting the said submission, the Writ<\/p>\n<p>Petition was dismissed. Hence this appeal.<\/p>\n<p>      2. As directed by this Court, the Director of Printing has<\/p>\n<p>filed an affidavit on 12.3.2010, in which it is stated as follows:<\/p>\n<blockquote><p>            &#8220;3. It is respectfully submitted that a number<\/p>\n<p>      of Printers in the Letter Press Wing are idling for<\/p>\n<p>      want of sufficient work. Total number of sanctioned<\/p>\n<p>      posts of Printer Gr.II in Trivandrum is 82. Out of this<\/p>\n<p>      67 posts are lying vacant. Any further appointments<\/p>\n<p>      to the post of Printer Grade II in the Letter Press<\/p>\n<p>      Wing will only result in idling of more employees for<\/p>\n<p>      want of sufficient work. At present Government is<\/p>\n<p>      not     using obsolete technology of Letter Press<\/p>\n<p>      Printing and the Offset Printing Machines are being<\/p>\n<p>      used for printing purpose.     There are 54 posts of<\/p>\n<p>      Offset Printing Machine Operators in the Offset Wing<\/p>\n<p>      in the Printing Department.<\/p><\/blockquote>\n<p>            4.   It is humbly submitted that 94 posts of<\/p>\n<p>      Printer Grade II in various Government Presses are<\/p>\n<p>      lying vacant.     Department has taken a          policy<\/p>\n<p>      decision not to fill up such vacancies           due to<\/p>\n<p>      insufficiency of work.    Any further appointments to<\/p>\n<p>      the vacant posts of Printer Grade II will only create<\/p>\n<p>WA No.212\/2010\n<\/p>\n<p>                              &#8211; 3 &#8211;\n<\/p>\n<p>     additional burden to the State exchequer for which<\/p>\n<p>     no benefits can be derived by the Government.<\/p>\n<p>     Hence no action has been taken to fill up the vacant<\/p>\n<p>     posts of Printer Grade II in the Government Presses<\/p>\n<p>     even though the rank list has been extended till<\/p>\n<p>     30.4.2010.&#8221;\n<\/p>\n<p>In view of the above statement, the official respondents would<\/p>\n<p>point out that no further vacancies could be reported to the<\/p>\n<p>Public Service Commission ti fill up the vacancies in the post of<\/p>\n<p>Printer Grade II.\n<\/p>\n<p>     3. The learned counsel for the appellant pointed out that<\/p>\n<p>on earlier occasions also, persons working in the Letter Press<\/p>\n<p>side have been deployed to the Offset Press side and the same<\/p>\n<p>precedent may be followed now also. So, the learned counsel<\/p>\n<p>prayed that the official respondents may be directed to report<\/p>\n<p>the existing vacancies in the cadre of Printer Grade II, so that<\/p>\n<p>they could be utilised for manning the Offset Presses.       The<\/p>\n<p>learned counsel also pointed out that sufficient posts of Printer<\/p>\n<p>Grade II to man Offset Presses are yet to be sanctioned and<\/p>\n<p>there is dearth of qualified hands to operate the machines.<\/p>\n<p>WA No.212\/2010\n<\/p>\n<p>                                &#8211; 4 &#8211;\n<\/p>\n<p>Those posts could be filled up by Printers on the Letter Press<\/p>\n<p>side, it is submitted.\n<\/p>\n<p>      4.    Rule 3(b) of Part II, Kerala State and Subordinate<\/p>\n<p>Services Rules reads as follows:\n<\/p>\n<blockquote><p>             &#8220;(b) The inclusion of a candidate&#8217;s name in any<\/p>\n<p>      list of approved candidates for any service (State or<\/p>\n<p>      Subordinate) or any class or category in a service,<\/p>\n<p>      shall not confer on him any claim to appointment to<\/p>\n<p>      the service, class or category.&#8221;\n<\/p><\/blockquote>\n<p>The well-settled principle that the candidates included in a rank-<\/p>\n<p>list have no legal right to claim appointment finds statutory<\/p>\n<p>expression in the above quoted Rule, as far as State and<\/p>\n<p>Subordinate Services are concerned.         Earlier, when Letter<\/p>\n<p>Presses were being used to meet the printing requirement of the<\/p>\n<p>State, sufficient posts of Printer Grade II were created. Now,<\/p>\n<p>that the said technology has become obsolete and the<\/p>\n<p>Government have gone for better machines and modern<\/p>\n<p>technology, the vacancies in the post of Printer Grade II are not<\/p>\n<p>being filled up by it.    A person included in the rank-list can<\/p>\n<p>claim appointment, if only the said post is filled up. In the face<\/p>\n<p>WA No.212\/2010\n<\/p>\n<p>                              &#8211; 5 &#8211;\n<\/p>\n<p>of the decision of the Government not to fill up the vacancies in<\/p>\n<p>the post of Printer Grade II, as the same is unnecessary, the<\/p>\n<p>claim of the appellant for advice to those vacancies cannot be<\/p>\n<p>allowed.\n<\/p>\n<p>     In the result, the Writ Appeal fails and it is dismissed.<\/p>\n<p>                                     K.
