Justice P.S.GOPINATHAN\n\n Dated :26\/10\/2009\n\n O R D E R\n                     P.S.GOPINATHAN, J.\n                ----------------------------------------\n                    Crl.R.P.No.3255 of 2009\n                ----------------------------------------\n          Dated this the 26th day of October, 2009\n\n                               ORDER\n<\/pre>\n<p>      The revision petitioner is the accused in C.C.No.643 of<\/p>\n<p>1998 on the file of the Judicial Magistrate of the First Class,<\/p>\n<p>Paravoor. The second respondent herein prosecuted the revision<\/p>\n<p>petitioner for offence under Section 138 of the Negotiable<\/p>\n<p>Instruments Act. The learned magistrate, after due trial, found<\/p>\n<p>the revision petitioner guilty. Accordingly, he was convicted and<\/p>\n<p>sentenced to undergo simple imprisonment for six months. He<\/p>\n<p>was also directed to pay Rupees one lakh as compensation to the<\/p>\n<p>second respondent under Section 357(3) of the Code of Criminal<\/p>\n<p>Procedure. The learned Additional Sessions Judge, Adhoc-III,<\/p>\n<p>Kollam, in appeal, confirmed the above conviction and sentence.<\/p>\n<p>      2.   Assailing the legality, correctness and propriety of the<\/p>\n<p>above conviction and sentence as confirmed in appeal, this<\/p>\n<p>revision petition was filed. Today, when the revision petition<\/p>\n<p>came up for hearing the revision petitioner and the legal heirs of<\/p>\n<p>second respondent settled the matter out of court and jointly<\/p>\n<p>Crl.R.P.No.3255 of 2009<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>filed a petition as Crl.M.A.No.9775 of 2009 seeking permission<\/p>\n<p>for compounding the offence alleged. Having heard either side<\/p>\n<p>and the learned public prosecutor, I find no reason to reject the<\/p>\n<p>petition.
