JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 14\/10\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>This<br \/>\n\tappeal is directed against judgment of the lower Appellate Court<br \/>\n\trendered by the learned 3rd Extra Assistant Judge,<br \/>\n\tRajkot, on 10.04.2004, in Regular Civil Appeal No.37 of 1993,<br \/>\n\twhereby the judgment and decree passed by the Trial Court on<br \/>\n\t09.03.1993 in Regular Civil Suit No.541 of 1987 in favour of the<br \/>\n\tpresent appellants (original defendants) was set aside and the<br \/>\n\tappellants were ordered to reinstate the original plaintiff<br \/>\n\t(respondent herein) with full backwages till the date of<br \/>\n\treinstatement, from the date of termination.\n<\/p>\n<p>The<br \/>\n\tappeal had been admitted in terms of the following substantial<br \/>\n\tquestions of law, by order dated 06.12.2004:\n<\/p>\n<p>a)<br \/>\n\tWhether  the  Civil  Court  has  jurisdiction  to entertain the Suit<br \/>\n against  the  termination  of  service  which is covered under the<br \/>\nprovisions of  Industrial Disputes Act, 1947?\n<\/p>\n<p> b) \tWhether the  Suit  for  enforcement  of  Personal  Service  Contract   is  maintainable  under  the provisions of Civil Procedure Code?\n<\/p>\n<p>c) \tWhether the probationer has a right to  hold  the post?\n<\/p>\n<p>d) \tWhether the services of the  probationer  can  be terminated  during the probationary period on the ground of unsatisfactory  work \/ unsuitability?\n<\/p>\n<p>e) \tWhether  the  Civil Court can go beyond the terms of appointment order?\n<\/p>\n<p>f) \tWhether an order of  termination  (Ex.64)  is  an order of termination simpliciter or passed by way of punishment, i.e. punitive or stigmatic?\n<\/p>\n<p>g) \tWhether principles of natural justice is required to be followed in case of termination of services of the probationer during the probation period on the ground of unsuitability?\n<\/p>\n<p>h) \tWhether  Departmental  Enquiry  is required to be held in case  of  termination  simpliciter  of  a probationer during probation period on the ground of unsatisfactory work?\n<\/p>\n<p>i) \tWhether Civil Court has jurisdiction to grant the relief  of  reinstatement with all the back wages and continuity of service?\n<\/p>\n<p>When<br \/>\n\tthe appeal is taken up for hearing today, it is submitted by<br \/>\n\tMr.D.G.Chauhan, learned counsel for the appellants as well as by<br \/>\n\tMr.I.S.Supehia, learned counsel for the respondent, that the parties<br \/>\n\thave arrived at a settlement out of Court and have drawn up the<br \/>\n\tTerms of Settlement dated 27.09.2010. It is jointly submitted by the<br \/>\n\tlearned counsel for the respective parties that the appeal may be<br \/>\n\tdisposed of in terms of the Settlement arrived at between the<br \/>\n\tparties and the decree passed by the learned lower Appellate Court<br \/>\n\tbe modified accordingly. The Terms of Settlement dated 27.09.2010<br \/>\n\tare as follows:\n<\/p>\n<p>TERMS<br \/>\n\tOF SETTLEMENT<\/p>\n<p>1.\tThat<br \/>\n\tthe University agreed to treat the services of Shri Vajubhai<br \/>\n\tL.Hingrajiya &#8211; respondent as regular service with effect from<br \/>\n\t15-7-1985 i.e. after completion of 2 years probation period only for<br \/>\n\tthe purpose of retiral benefits.\n<\/p>\n<p>2.\tThat<br \/>\n\tthe University agreed to grant all service benefits viz. seniority,<br \/>\n\tpay scale, leave and other benefits with effect from 24-6-2004.\n<\/p>\n<p>3.\tThat<br \/>\n\tthe respondent agreed that he will not claim any benefits including<br \/>\n\tmonetary benefits from 14-7-1983 or 15-7-1985 like continuity of<br \/>\n\tservice seniority, pay fixation, leave and other consequential<br \/>\n\tbenefit etc. till the date of reinstatement i.e. upto 24-6-2004. The<br \/>\n\trespondent further agreed to forego all back wages till the date of<br \/>\n\treinstatement i.e. upto 24-6-2004 from the date of termination as<br \/>\n\tawarded by judgment and order dated 10-4-2003 by the Learned 3rd<br \/>\n\tExtra Assistant Judge, Rajkot in Regular Civil Appeal No.37 of 1993.\n<\/p>\n<p>4.\tThat<br \/>\n\tthe respondent agreed that he would not be entitled for any benefits<br \/>\n\tprior to 24-6-2004 like seniority, pay fixation, leave and other<br \/>\n\tservice benefits and will not claim in future. Both the parties have<br \/>\n\tagreed that the entire period of 17 years 5 months&#8217; absence period<br \/>\n\twould be treated as notional continuity for the purpose of retiral<br \/>\n\tbenefits.\n<\/p>\n<p> \tIn<br \/>\n\tview of the above settlement the University agrees to withdraw the<br \/>\n\tSecond Appeal No.76 of 2003 pending before this Hon&#8217;ble Court. The<br \/>\n\tSettlement bears the signatures of the Registrar, Junagadh<br \/>\n\tAgricultural University (appellant No.1) and Shri Vajubhai<br \/>\n\tL.Hingrajiya (respondent).\n<\/p>\n<p>As<br \/>\n\tthere is consensus between the learned counsel for the respective<br \/>\n\tparties regarding disposal of the appeal in terms of the above<br \/>\n\t&#8220;Terms of Settlement&#8221; and it is jointly prayed that the<br \/>\n\tdecree passed by the lower Appellate Court may be modified<br \/>\n\taccordingly, the following order is passed:\n<\/p>\n<p>The<br \/>\n\tjudgment and decree dated 10.04.2003 passed by the learned 3rd<br \/>\n\tExtra Assistant Judge at Rajkot in Regular Civil Appeal No.37 of<br \/>\n\t1993, shall stand modified in terms of the Settlement arrived at<br \/>\n\tbetween the parties, as per Terms of Settlement reproduced<br \/>\n\thereinabove.\n<\/p>\n<p>In<br \/>\n\tview of the above, no further order is now required to be passed.<br \/>\n\tThe appeal is disposed of, accordingly.
