(ORAL)\n<\/pre>\n<p>           On 22.04.2008, the following order was passed:<\/p>\n<p>                 &#8220;Learned counsel for the appellant contends that<br \/>\n           the   judgment      dt.   31.01.2005   rendered    by   the<br \/>\n           competent court of law was placed on the file before<br \/>\n           the first appellate court by way of additional evidence.<br \/>\n           The application moved in that behalf was not decided<br \/>\n           in spite of the fact that the reply of the same was also<br \/>\n           filed by the opposite side and the aforesaid judgment<br \/>\n           being a subsequent event has bearing on the merits of<br \/>\n           the case in hand.\n<\/p>\n<p>                 Notice of motion for 01.09.2008.\n<\/p>\n<p>                 In the meantime, status quo shall be maintained<br \/>\n           with regard to alienation of the suit property.&#8221;<\/p>\n<p>           Learned senior counsel appearing on behalf of the<\/p>\n<p>respondents is not in a position to deny that this application was<br \/>\n<span class=\"hidden_text\"> RSA No.2531 of 2007                                        -2-<\/span><\/p>\n<p>not decided by the ld. Lower Appellate Court. With regard to the<\/p>\n<p>application sought to be pressed by the appellant, an affidavit<\/p>\n<p>has been filed by the counsel who had appeared for the present<\/p>\n<p>respondents in the first appeal stating that in fact the said<\/p>\n<p>application was not pressed before the ld. Lower Appellate Court.<\/p>\n<p>           In my opinion, even if that be so, the lower appellate<\/p>\n<p>court would have to pass an order stating that the application<\/p>\n<p>was dismissed not having been pressed.\n<\/p>\n<p>           In these circumstances, it would be in the interest of<\/p>\n<p>justice if on this limited ground the appeal is allowed and the<\/p>\n<p>matter is remanded back to the ld. Lower Appellate Court for<\/p>\n<p>fresh   decision   after   consideration   of   the   application\/s   for<\/p>\n<p>additional evidence.       The judgment and decree of the courts<\/p>\n<p>below are set aside.\n<\/p>\n<p>           Parties through counsel are directed to appear before<\/p>\n<p>the District Judge, Jhajjar on 03.12.2009.        Ld.
