SHAH\n\t\t\t\n\t\t\n\t\n\n \n\nDate\n: 07\/09\/2005 \n\n \n\nCOMMON\nORAL ORDER<\/pre>\n<p>\tIn<br \/>\nthis group of petitions, the respective petitioner has prayed for an<br \/>\nappropriate writ, order and direction prohibiting the respondent<br \/>\nauthorities from forcibly evicting the petitioners from the land<br \/>\nbearing Revenue Survey No.112 of Moje Halol, District Panchmahals<br \/>\nwithout complying with the order at Annexure-B to the petition. It<br \/>\nappears that the present Special Civil Applications are filed only on<br \/>\nthe basis of the apprehension and there is no basis for such<br \/>\napprehension that the respondent authorities may evict the<br \/>\npetitioners forcibly from the lands in question. Nothing is produced<br \/>\non record to show that the respondents have tried to evict the<br \/>\npetitioners.  It is also required to be noted that the present<br \/>\nSpecial Civil Applications came to be filed on 7th March,<br \/>\n2005 and no order is passed by this Court in the aforesaid petitions<br \/>\nand the present Special Civil Applications are placed on board for<br \/>\nhearing before this Court by the Registry  in regular course. It is<br \/>\nnot even the case of the petitioners that the respondents have<br \/>\nevicted the petitioners forcibly  even today i.e on 7th<br \/>\nSeptember, 2005.
