Justice V.GIRI\n\n Dated :23\/07\/2008\n\n O R D E R\n                         V.GIRI, J\n                       -------------------\n                    W.P.(C).21896\/2008\n                       --------------------\n            Dated this the 23rd day of July, 2008\n\n                       JUDGMENT\n<\/pre>\n<p>      Petitioner, who is a Circle Inspector of Police, is<\/p>\n<p>aggrieved by Ext.P8 order of transfer by which he was<\/p>\n<p>transferred out of Anchal in Kollam District without a<\/p>\n<p>specific posting and Ext.P9 order passed by the Director<\/p>\n<p>General of Police suspending him from service. Several<\/p>\n<p>grounds have been taken in the writ petition challenging<\/p>\n<p>the order of suspension. When the matter came up for<\/p>\n<p>admission, it was suggested to the learned counsel for the<\/p>\n<p>petitioner   that since    there is an alternate appellate<\/p>\n<p>remedy      available in relation          to Ext.P9 order of<\/p>\n<p>suspension, it would be appropriate that the petitioner<\/p>\n<p>avails the same. Accordingly, Ext.P19 appeal has been<\/p>\n<p>filed by the petitioner on 22.7.2008.          Same is to be<\/p>\n<p>considered    and disposed of by the Government under<\/p>\n<p>Rule 23(b) of the Kerala Police Departmental Inquiries<\/p>\n<p>Punishment and Appeal Rules, 1958.\n<\/p>\n<\/p>\n<p>2.    The appeal has been presented before the DGP as<\/p>\n<p>W.P.(C).21896\/2008<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>required to be done. But it is to be considered by the<\/p>\n<p>Government.\n<\/p>\n<\/p>\n<p>3.    In the result, writ petition is disposed of directing<\/p>\n<p>the second respondent to forward Ext.P19 to the<\/p>\n<p>Government within one week from the date of receipt of<\/p>\n<p>a copy of this judgment, if not already done.         First<\/p>\n<p>respondent, Government, shall hear the petitioner and<\/p>\n<p>pass orders on Ext.P19 within four weeks from the date<\/p>\n<p>of receipt of appeal memorandum from the DGP. Copy of<\/p>\n<p>the writ petition along with the copy of I.A.9538\/2008<\/p>\n<p>shall be produced by the petitioner, along with the<\/p>\n<p>certified copy of     the  judgment      before the   first<\/p>\n<p>respondent.
