The names of all the office bearers alongwith their addresses       The information is not<br \/>\n    since the date of inspection of Jiwan Jyoti Cooperative Group       available in this office<br \/>\n    Housing Society Ltd having its registered office at 229, Dr.        but available in the<br \/>\n    Joshi Road, Karol Bagh, New Delhi &#8211; 110005 till date.               Society&#8217;s record. Hence<br \/>\n                                                                        any may apply directly<br \/>\n                                                                        to the society.\n<\/p>\n<p>Ground of the First Appeal:\n<\/p>\n<p>     Incorrect and incomplete information had been provided by the PIO.\n<\/p>\n<p>Order of the FAA:\n<\/p>\n<p>        &#8220;The applicant has filed an appeal dated 13.08.2009 seeking details related to<br \/>\narbitration cases from 1985 apart from the names of the office bearers alongwith their<br \/>\naddresses. The SPIO\/AR (N\/W) has replied on 10.09.09 that the file is not available. He<br \/>\nshould make efforts to locate the file and also endeavor to get the same from the Society \/<br \/>\nArbitrator if so required. A proper reply should be given to Point No. 13&#8221;.\n<\/p>\n<p>Ground of the Second Appeal:\n<\/p>\n<p>    Incomplete information had been provided by the PIO. In spite, of the order of the First<br \/>\nAppellate Authority dated 13th October 2009 ordering the SPIO to provide the requested<br \/>\ninformation to the appellant, no information or reply has been provided till date.\n<\/p>\n<p>Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present:\n<\/p>\n<p>Appellant : Mr. Jasmeet Singh;\n<\/p>\n<p>Respondent : Absent;\n<\/p>\n<p>       The Appellant states that inspite of the order of the First Appellate authority on<br \/>\n13\/10\/2009 to provide the information no information has been provided by the PIO. It is<br \/>\napparent from the order of the First Appellate Authority that the information which is being<br \/>\nsought has to be available with the public authority. The FAA has infact recorded, &#8220;The<br \/>\nSPIO\/AR (N\/W) has replied on 10.09.09 that the file is not available. He should make efforts<br \/>\nto locate the file and also endeavor to get the same from the Society \/ Arbitrator if so<br \/>\nrequired.&#8221; Thus it is evident that the information is with RCS and no exemption has been<br \/>\nclaimed to deny the information.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>      The PIO is directed to provide the complete information to the appellant before<br \/>\n20 March 2010.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information<br \/>\nby the PIO Mr. M. L. Gupta within 30 days as required by the law.\n<\/p>\n<p>From the facts before the Commission it is apparent that the PIO is guilty of not furnishing<br \/>\ninformation within the time specified under sub-section (1) of Section 7 by not replying<br \/>\nwithin 30 days, as per the requirement of the RTI Act. He has further refused to obey the<br \/>\norders of his superior officer, which raises a reasonable doubt that the denial of information<br \/>\nmay also be malafide. The First Appellate Authority has clearly ordered the information to be<br \/>\ngiven.\n<\/p>\n<p><span class=\"hidden_text\">                                                                                    Page 2 of 3<\/span><\/p>\n<p> It appears that the PIO&#8217;s actions attract the penal provisions of Section 20 (1). A showcause<br \/>\nnotice is being issued to him, and he is directed give his reasons to the Commission to show<br \/>\ncause why penalty should not be levied on him.\n<\/p>\n<p>Mr. M. L. Gupta will present himself before the Commission at the above address on<br \/>\n08 April 2010 at 11.00am alongwith his written submissions showing cause why penalty<br \/>\nshould not be imposed on him as mandated under Section 20 (1). He will also submit proof<br \/>\nof having given the information to the appellant.\n<\/p>\n<p>If there are other persons responsible for the delay in providing the information to the<br \/>\nAppellant the PIO is directed to inform such persons of the show cause hearing and direct<br \/>\nthem to appear before the Commission with him.\n<\/p>\n<p>This decision is announced in open chamber.\n<\/p>\n<p>Notice of this decision be given free of cost to the parties.<br \/>\nAny information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.\n<\/p>\n<p>                                                                                                 Shailesh Gandhi<br \/>\n                                                                                       Information Commissioner<br \/>\n                                                                                                  04 March 2010<br \/>\n(In any correspondence on this decision, mention the complete decision number.)
