DAVE\n\t\t\n\t\n\n \n\nDate\n: 13\/07\/2011 ORAL ORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tLearned APP, waives service of notice of Rule for respondent &#8211;<br \/>\n\tState.\n<\/p>\n<p>This<br \/>\n\tapplication is filed under Section 438 of the Code of Criminal<br \/>\n\tProcedure in connection with<br \/>\n\t first information report registered at C.R.No.I-108 of 2011 with<br \/>\n\tTharad police station, Dist: Banaskantha for the offences punishable<br \/>\n\tunder Sections 376, 363, 366, 406, 504,506(2), 114 of  the Indian<br \/>\n\tPenal Code, Sections 3(i)(x), 3(i)(ii) and 3(i)(xi) of the Scheduled<br \/>\n\tCastes and Scheduled Tribes [Prevention of Atrocity] Act.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the applicants submits that the applicants are relative<br \/>\n\tof the co-accused Devabhai Malabhai Harijan who is enlarged on bail<br \/>\n\ttoday. They belong to Harijan community and, therefore, the<br \/>\n\tprovisions of  the Scheduled Castes and Scheduled Tribes [Prevention<br \/>\n\tof Atrocity] Act will not apply.\n<\/p>\n<p>\tBesides, the applicants are available during the course of<br \/>\n\tinvestigation. It is further submitted that in view of the above,<br \/>\n\tthe applicants may be granted anticipatory bail.\n<\/p>\n<p>Heard<br \/>\n\tLearned APP for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the accused and punishment<br \/>\n\tprescribed for the alleged offences, without discussing the evidence<br \/>\n\tin detail, at this stage, I am inclined to grant anticipatory bail<br \/>\n\tto the applicants.  This Court has also taken into consideration the<br \/>\n\tlaw laid down by the Apex Court in the case of <a href=\"\/doc\/1108032\/\">Siddharam<br \/>\n\tSatlingappa Mhetre v. State of Maharashtra &amp; Ors. Reported<\/a> in<br \/>\n\t[2011]1 SCC 694, wherein the Apex Court reiterated the law<br \/>\n\tlaid down by the Constitutional Bench in the case of Shri<br \/>\n\tGurubaksh Singh Sibbia &amp; Ors. Reported in [1980]2 SCC 565.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe result, this application is allowed by directing that in the<br \/>\n\tevent of the applicants herein being arrested pursuant to first<br \/>\n\tinformation report registered at C.R.No.I-108 of 2011 with Tharad<br \/>\n\tpolice station, Dist: Banaskantha,  the applicants<br \/>\n\tshall be released on bail on furnishing a bond of Rs.10,000\/-<br \/>\n\t(Rupees Ten Thousand only) each with one surety of like amount on<br \/>\n\tfollowing conditions :-\n<\/p>\n<p>[a]\tshall<br \/>\ncooperate with the investigation and make available for interrogation<br \/>\nwhenever required.\n<\/p>\n<p>[b]\tshall<br \/>\nremain present at concerned Police Station on  25.7.2011 between<br \/>\n11:00 am to 2:00 pm:\n<\/p>\n<p>[c]\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them from disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p>[d]\tshall<br \/>\nat the time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e]<br \/>\n\twill not leave India without the permission of the Court and, if<br \/>\nholding a Passport, shall surrender the same before the trial Court<br \/>\nimmediately<\/p>\n<p>[f]\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if he considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>[g]\tdespite<br \/>\nthis order, it would be open for the Investigating Agency to apply to<br \/>\nthe competent Magistrate, for police remand of the applicants. The<br \/>\napplicants shall remain present before the learned Magistrate on the<br \/>\nfirst date of hearing of such application and on all subsequent<br \/>\noccasions, as may be directed by the learned Magistrate. This would<br \/>\nbe sufficient to treat the accused in the judicial custody for the<br \/>\npurpose of entertaining application of the prosecution for police<br \/>\nremand. This is, however, without prejudice to the right of the<br \/>\naccused to seek stay against an order of remand, if ultimately<br \/>\ngranted, and the power of the learned Magistrate to consider such a<br \/>\nrequest in accordance with law. It is clarified that the applicants,<br \/>\neven if, remanded to the police custody, upon completion of such<br \/>\nperiod of police remand, shall be set free immediately, subject to<br \/>\nother conditions of this anticipatory bail order.
