I have considered the rival submissions and<br \/>\nalso perused  the role attributed to the applicant as reflected in<br \/>\nthe FIR, police papers as well as  the provisions of  Sections 306,<br \/>\n323, 498A and 302, 323 324, 447, 504, 506 (2)  and  114 of Indian<br \/>\nPenal Code.    I have taken into consideration the alleged offences<br \/>\nand the manner in which the   it  is committed, the  quantum of<br \/>\npunishment and the  gravity of offence.  However, considering the<br \/>\naforesaid aspects,   I am of the view that   the applicant deserves<br \/>\nto be enlarged on bail.   The application is    allowed<br \/>\naccordingly.   The applicant is ordered     to be enlarged on bail in<br \/>\nconnection with aforesaid offences on executing a bond of Rs.10,000\/-<br \/>\n[Rupees ten thousand only] with one surety of the like amount to the<br \/>\nsatisfaction of the Trial Court and subject to the conditions that he<br \/>\nshall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e]\tmark<br \/>\nhis presence at the concerned Police Station on any day of every<br \/>\nfirst week of English calendar month between 9.00 AM and 2.00 PM.<br \/>\ntill the trial is over;\n<\/p>\n<p>[f]\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[g]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>3.\t\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>4.\t\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>5.\t\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>6.\t\tRule<br \/>\nis made absolute to the aforesaid extent.\tDirect Service is<br \/>\npermitted.\n<\/p>\n<p>\t\t\t\t\t\t\t\t[H.B.ANTANI,<br \/>\nJ.]<\/p>\n<p>msp<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Bhaveshbhai vs State on 16 August, 2010 Author: H.B.Antani,&amp;Nbsp;
