PUBLIC PROSECUTOR for\nOpponent(s) : 1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 21\/06\/2011\n \n\nORAL\nJUDGMENT<\/pre>\n<p>By<br \/>\n\tway of present appeal, filed under Section 374(2) of the Code of<br \/>\n\tCriminal Procedure, 1973, the appellant has challenged the judgment<br \/>\n\tand order of conviction and sentence dated 08th<br \/>\n\tSeptember, 2010 passed by the learned Sessions Judge, Surendranagar,<br \/>\n\tin Sessions Case No.22 of 2009, whereby the learned Judge has<br \/>\n\tconvicted the appellant-accused under Sections 304 Part II of the<br \/>\n\tIndian Penal Code.\n<\/p>\n<p>It<br \/>\n\tis the case of the prosecution that on 13th December,<br \/>\n\t2008 at about 11.30 hours the appellant-original accused No.1 had<br \/>\n\tentered into the complainant&#8217;s house armed with dharia and knife.<br \/>\n\tWhen the complainant asked the complainant about his identity, the<br \/>\n\tappellant replied that he has some work with her husband. Therefore,<br \/>\n\tthe complainant opened the door. When the complainant seen the<br \/>\n\tappellant armed with dharia and knife, she immediately closed the<br \/>\n\tdoor. Thereafter, the appellant started knocking the door forcibly<br \/>\n\tand also had given a dharia blow on the door. It is the case of the<br \/>\n\tprosecution that therefore, the door stopper had broken out and door<br \/>\n\topened. It is further the case of the prosecution that the appellant<br \/>\n\thas stepped into the complainant&#8217;s house and placed his hands on the<br \/>\n\tchest of the complainant. Therefore, the complainant was shouting<br \/>\n\tloudly and rushed towards his father&#8217;s house, who is residing<br \/>\n\tnearby. On hearing shout of the complainant, father of the<br \/>\n\tcomplainant came outside the house. It is the case of the<br \/>\n\tprosecution that at that point of time, father of the appellant,<br \/>\n\ti.e. original accused No.2, had given a stick blow to the father of<br \/>\n\tthe complainant from reverse side and the present appellant had<br \/>\n\tgiven a dharia blow to the father of the complainant. Subsequently,<br \/>\n\tfather of the complainant taken to the hospital and was given<br \/>\n\tprimary treatment. It is further the case of the prosecution that on<br \/>\n\t08th January, 2009 father of the complainant died.<br \/>\n\tTherefore, a complaint to the said effect came to be registered with<br \/>\n\tJoravarnagar Police Station on 10th January, 2009, which<br \/>\n\tis registered as CR No.I-2 of 2009 for the offence punishable under<br \/>\n\tSections 452, 354, 302 and 114 of the Indian Penal Code.\n<\/p>\n<p>Thereafter,<br \/>\n\tas the case was exclusively triable by the Court of Sessions, the<br \/>\n\tsame was transferred to the Sessions Court, Surendranagar.<br \/>\n\tThereafter, charge was framed by the Sessions Court against the<br \/>\n\taccused persons.\n<\/p>\n<p>\tThereafter<br \/>\n\tthe trial was conducted before the learned Judge. To prove the case<br \/>\n\tof the prosecution, prosecution has examined 13 witnesses and also<br \/>\n\tproduced documentary evidence on record.\n<\/p>\n<p>Thereafter,<br \/>\n\ton completion of evidence by prosecution, statement of accused<br \/>\n\tpersons under Section 313 of the Code of Criminal Procedure, 1973<br \/>\n\tcame to be recorded wherein the accused persons have denied the case<br \/>\n\tfiled against them and submitted that a false case is filed against<br \/>\n\tthem.\n<\/p>\n<p>After<br \/>\n\thearing both the sides, the learned Sessions Judge, Surendranagar by<br \/>\n\this order dated 08th<br \/>\n\tSeptember, 2010 passed in Sessions Case No.22 of 2009, convicted the<br \/>\n\tappellant-original accused No.1 for the offence punishable under<br \/>\n\tSection 304 Part II as stated above and acquitted the original<br \/>\n\taccused No.2 of the charges levelled against him.\n<\/p>\n<p>Being<br \/>\n\taggrieved by and dissatisfied with the said judgment and order of<br \/>\n\tconviction and sentence dated 08th<br \/>\n\tSeptember, 2010 passed by the learned Sessions Judge, Surendranagar,<br \/>\n\tthe appellant hereinabove has preferred the present Criminal Appeal<br \/>\n\tbefore this Court.\n<\/p>\n<p>Heard<br \/>\n\tMr.Ashish Dagli, learned counsel for the appellant and Mr.H.L. Jani,<br \/>\n\tlearned Additional Public Prosecutor for the respondent-State.\n<\/p>\n<p>Mr.Dagli<br \/>\n\thas read the charge at Exhibit 5 and contended that the present<br \/>\n\tappellant is convicted for the offence punishable under Section 304<br \/>\n\tPart II of the Indian Penal Code and is acquitted from the offence<br \/>\n\tpunishable under Sections 452, 376 and 302 of the Indian Penal Code.<br \/>\n\tHe has also contended that the prosecution has failed to prove the<br \/>\n\tcase beyond reasonable doubt against the appellant. Mr.Dagli has<br \/>\n\tread the Jail Report produced on record by Mr.H.L. Jani, learned<br \/>\n\tAdditional Public Prosecutor and contended that the appellant has<br \/>\n\tcompleted more than half sentence. He has further contended that<br \/>\n\tlooking to the facts of the case as well as evidence produced on<br \/>\n\trecord, conviction imposed upon the appellant is very harsh. He has<br \/>\n\talso contended that the appellant is behind the bars for sufficient<br \/>\n\tperiod. He has also contended that he is not arguing the matter on<br \/>\n\tmerits, but arguing the matter only for the purpose of quantum. He<br \/>\n\thas also contended that the appellant is a young man and is the only<br \/>\n\tbread winner for his family and therefore, lenient view is required<br \/>\n\tto be taken in the matter. He, therefore, contended that therefore,<br \/>\n\tthe appellant is required to be set at liberty by reducing the<br \/>\n\tsentence imposed upon him.\n<\/p>\n<p>Heard<br \/>\n\tMr.H.L. Jani, learned Additional Public Prosecutor for<br \/>\n\tthe respondent-State. He has supported the judgment and order of<br \/>\n\tconviction passed by the learned Judge. He has contended that<br \/>\n\tlooking to the charge framed against the appellant, order passed by<br \/>\n\tthe learned Judge is absolutely just and proper. He has also read<br \/>\n\tthe documentary evidence produced on record and contended that<br \/>\n\tlearned<br \/>\n\tJudge has not committed any error in convicting the<br \/>\n\tappellant-accused. He, therefore, contended that the present appeal<br \/>\n\tis required to be dismissed.\n<\/p>\n<p>I<br \/>\n\thave<br \/>\n\tgone through papers produced before me and the judgment and order<br \/>\n\tpassed by the learned Judge. I have also perused the oral as well as<br \/>\n\tdocumentary evidence led before the learned Judge and also<br \/>\n\tconsidered the submissions made by learned counsel for the parties.\n<\/p>\n<p>It<br \/>\n\tappears from the papers that the appellant was acquitted from the<br \/>\n\toffence punishable under Section 302 of the Indian Penal Code.<br \/>\n\tLooking to the facts and circumstances of the case I am of the<br \/>\n\topinion that conviction imposed upon the appellant is very harsh. I<br \/>\n\tam of the opinion that when the appellant has already undergone half<br \/>\n\tof the sentence, if the sentence already undergone by the<br \/>\n\tappellant-convict may be treated as sentence, same would meet with<br \/>\n\tthe ends of justice. Even looking to the submissions advanced by the<br \/>\n\tlearned counsel for the appellant and circumstances of the case,<br \/>\n\tsentence imposed upon the appellant is required to be reduced and<br \/>\n\tmodified on the ground of sympathy also.\n<\/p>\n<p>Hence,<br \/>\n\tin view of the foregoing reasons, present appeal is partly allowed.<br \/>\n\tThe<br \/>\n\tJudgment and order of conviction dated 08th<br \/>\n\tSeptember, 2010 passed by the learned Sessions Judge, Surendranagar,<br \/>\n\tin Sessions Case No.22 of 2009, is hereby confirmed. However, the<br \/>\n\tjudgment and order of sentence dated 08th<br \/>\n\tSeptember, 2010 passed by the learned Sessions Judge, Surendranagar,<br \/>\n\tin Sessions Case No.22 of 2009 is hereby reduced and modified to the<br \/>\n\textent of sentence which the appellant-accused has already<br \/>\n\tundergone. The appellant-accused is in jail. He is directed to set<br \/>\n\tat liberty forthwith, if not required in any other case. Rest of the<br \/>\n\tjudgment and order dated 08th<br \/>\n\tSeptember, 2010 shall<br \/>\n\tremain unaltered.
