It is undisputed position that as per the<br \/>\napplicant-petitioner, the opponent has left the limits of Indian<br \/>\nterritory. No evidence is produced on record to show that minor<br \/>\nPratik and Jaydeep were within the territory of India on the date<br \/>\nwhen this Court passed the order. No material is produced on record<br \/>\nto show that on which date the respondent &#8211; opponent has left<br \/>\nthe country and, that too, in contravention of the order passed by<br \/>\nthis Court. Under the circumstances, it is not possible for this<br \/>\nCourt to take cognizance of the alleged contempt.\n<\/p>\n<p>4.\tApart<br \/>\nfrom the above,, it deserves to be recorded that when the opponent is<br \/>\nnot within the territory of the country, admittedly, as stated by the<br \/>\napplicant, the jurisdiction cannot be invoked on the ground as sought<br \/>\nto be canvassed.\n<\/p>\n<p>5.\tHence,<br \/>\nthe present application is not entertained and dismissed.\n<\/p>\n<p>6.\tThe<br \/>\naforesaid shall be without prejudice to the rights and contentions of<br \/>\nthe parties of main First Appeal.\n<\/p>\n<p>(JAYANT<br \/>\nPATEL, J.)<\/p>\n<p>(Ms.\n<\/p>\n<p>B.M.
