PUBLIC PROSECUTOR for\nRespondent(s) : 1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 10\/12\/2010\n \n\nORAL\nORDER<\/pre>\n<p>\tPresent<br \/>\n\tapplication is filed by the applicant under Section 439 of the<br \/>\n\tCriminal Procedure Code, 1973 for releasing him on regular bail in<br \/>\n\tconnection with CR No.I-39 of 2010 registered with Kishanwadi Police<br \/>\n\tStation, Vadodara for the offences punishable under Sections 364(A),<br \/>\n\t365, 368, 452, 323, 506(2), 467, 468, 471, 419, 212, 120(B) and 34<br \/>\n\tof the Indian Penal Code and under Section 135 of the Bombay Police<br \/>\n\tAct.\n<\/p>\n<p>\tHeard<br \/>\n\tMr.Rajesh Kanani, learned counsel for the applicant and Mr.H.L.<br \/>\n\tJani, learned Additional Public Prosecutor for the respondent-State.\n<\/p>\n<p>\tMr.Kanani<br \/>\n\thas submitted that false complaint is filed with a view to implicate<br \/>\n\tthe present applicant in the offence. He has also contended that<br \/>\n\tprima-facie no case is made out against the present applicant. There<br \/>\n\tare no evidence to connect the present applicant with the alleged<br \/>\n\toffence. He has also contended that co-accused has been granted bail<br \/>\n\tby the Hon&#8217;ble Supreme Court of India vide order dated 25th<br \/>\n\tOctober 2010 passed in Criminal Miscellaneous Application No.18602<br \/>\n\tof 2010. Mr.Kanani has also contended that the present applicant is<br \/>\n\ta young boy and he is very poor person. He has also contended that<br \/>\n\tin view of the order passed by the Hon&#8217;ble Supreme Court of India,<br \/>\n\tthis Court vide order dated 29th November 2010 granted<br \/>\n\tbail to co-accused. He, therefore, prayed to release the applicant<br \/>\n\ton regular bail.\n<\/p>\n<p>\tAs<br \/>\n\tagainst this, Mr.Jani, learned Additional Public Prosecutor, has<br \/>\n\tstrongly opposed the present application and contended that the<br \/>\n\tpresent application deserves dismissal. He has also contended that<br \/>\n\tthis is a successive bail application.\n<\/p>\n<p>\tI<br \/>\n\thave gone through the order passed by the trial Court as well as<br \/>\n\tpapers produced on record of the case. From the perusal of the<br \/>\n\tpapers it appears that the applicant-accused was identified by the<br \/>\n\tvictim. It also appears from the perusal of the papers that<br \/>\n\tingredient of Section 120(B) of the Code of Criminal Procedure, 1973<br \/>\n\tis established. The applicant had meeting of mind with other<br \/>\n\tconspirators. I have also perused Section 10 of the Evidence Act.<br \/>\n\tIngredient of Section 10 of the Evidence Act is also established on<br \/>\n\trecord. I have also gone through the order passed by the Hon&#8217;ble<br \/>\n\tSupreme Court of India. There seems to be nothing on record against<br \/>\n\tthe applicant before the Hon&#8217;ble Supreme Court of India. I have not<br \/>\n\tfound any substance in the present application. Hence, present<br \/>\n\tapplication deserves to be dismissed and is hereby dismissed. Rule<br \/>\n\tis discharged .\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
