    Petitioner,  the  first   accused  in   S.T.No.<\/p>\n
2314\/1997 on the file of Judicial First Class<\/p>\n
Magistrate’s Court-I, Thrissur, filed this revision<\/p>\n
challenging the concurrent conviction and sentence<\/p>\n
for the offence under Section 58 of Abkari Act.<\/p>\n
Prosecution  case  is  that  at  about  2  a.m.  on<\/p>\n
24.8.1996, PW1, the Preventive Officer and PW4, the<\/p>\n
Excise Inspector of Anti Narcotic Special Squad<\/p>\n
found tempo van KL-8\/8418, parked on the side of<\/p>\n
the patrol bunk at Swaraj Round, Thrissur. Seeing<\/p>\n
the Excise party, petitioner, who was inside the<\/p>\n
vehicle, tried to open the door and escape and<\/p>\n
doubting his conduct, they stopped him and examined<\/p>\n
the van. It was found that underneath the 6700 eggs<\/p>\n
stored in the van, 84 cases of Indian Made Foreign<\/p>\n
Liquor containing 12 bottles of 750 ml. each and 54<\/p>\n
cases containing 24 bottles of 375 ml. each. When<\/p>\n

one bottle each from the cases were opened, they<\/p>\n
got   satisfied   that  it  is  Indian  Made Foreign<\/p>\n
Liquor. Petitioner was arrested. The opened bottles<\/p>\n
were sealed and along with the remaining bottles<\/p>\n
seized, Exhibit P1 seizure mahazar was prepared.<\/p>\n
The sealed bottles, were produced before the court<\/p>\n
with a request to send for chemical analysis.<\/p>\n
Exhibit P5 report was obtained. It shows that the<\/p>\n
sample contained 38.90% by volume of ethyl alcohol.<\/p>\n
After    completing  the  investigation, charge  was<\/p>\n
laid, which was taken cognizance by the learned<\/p>\n
Magistrate for the offence under Section 58 of<\/p>\n
Abkari Act against the petitioner as the cleaner<\/p>\n
and the second accused driver and third accused,<\/p>\n
owner of the tempo van.\n<\/p>\n
     2.     All the  accused   pleaded  not  guilty.<\/p>\n
Prosecution    examined  six  witnesses  and  marked<\/p>\n
Exhibits P1 to P5. Accused did not adduce any<\/p>\n
evidence.\n<\/p>\n
     3. Learned Magistrate, on the evidence, found<\/p>\n
accused 2 and 3 not guilty of the offences, as<\/p>\n

there is no evidence to prove that they were in<\/p>\n
possession of the contraband articles. Accepting<\/p>\n
the evidence of PWs 1 and 4, though PWs 2 and 3,<\/p>\n
the independent witnesses, turned hostile to the<\/p>\n
prosecution,     learned  Magistrate convicted   the<\/p>\n
petitioner for the offence under Section 58 of<\/p>\n
Abkari Act. He was sentenced to simple imprisonment<\/p>\n
for three months and a fine of Rs.15,000\/- and in<\/p>\n
default,    simple  imprisonment  for three  months.<\/p>\n
Petitioner challenged the conviction and sentence<\/p>\n
before     Sessions  Court,  Thrissur in   Crl.A.No.<\/p>\n
69\/2002. Learned Sessions Judge, on re-appreciation<\/p>\n
of evidence, confirmed the conviction and sentence<\/p>\n
and dismissed the appeal. It is challenged in the<\/p>\n
revision.\n<\/p>\n
     4. Learned counsel appearing for the petitioner<\/p>\n
and learned Public Prosecutor were heard.<\/p>\n
     5. Learned counsel argued that evidence of PW1<\/p>\n
establishes that no sample was taken at the time of<\/p>\n
seizure and therefore, based on Exhibit P5 report,<\/p>\n
courts     below  should  not   have convicted   the<\/p>\n

petitioner. Learned counsel also argued that as per<\/p>\n
Exhibit P5 report, the sample examined was only 700<\/p>\n
ml. + 300 ml., which together make only one litre<\/p>\n
and therefore, there is no evidence to prove that<\/p>\n
the quantity of Indian Made Foreign Liquor was in<\/p>\n
excess of the permissible limit and hence, the<\/p>\n
conviction    is not  sustainable. Learned   counsel<\/p>\n
finally argued that the period of detention he had<\/p>\n
already undergone is to be adjusted towards the<\/p>\n
sentence,     in case  the  conviction   is  to   be<\/p>\n
confirmed.\n<\/p>\n
     6.    Though PW1, in  cross-examination, to   a<\/p>\n
question put by the counsel appearing for the<\/p>\n
petitioner, deposed that no sample was taken, as is<\/p>\n
clear from his evidence, he was only answering that<\/p>\n
no sample, out of the bottles was taken. Exhibit P1<\/p>\n
mahazar with the evidence of PW1 corroborated by<\/p>\n
the evidence of PW4, establish that when PWs 1 and<\/p>\n
4 examined the van, they detected 54 cases of<\/p>\n
Indian made Foreign Liquor, each case containing 24<\/p>\n
bottles and each bottle having a capacity of 375<\/p>\n

ml. and 84 cases of Indian Made Foreign Liquor,<\/p>\n
each case containing 12 bottles and each bottle<\/p>\n
having a capacity of 750 ml., concealed beneath the<\/p>\n
eggs being transported in the van. PWs 1 and 4<\/p>\n
opened two bottles, namely, one bottle having a<\/p>\n
capacity of 750 ml. and the other having a capacity<\/p>\n
of 375 ml. and verified what it contained and got<\/p>\n
satisfied that it was Indian Made Foreign Liquor.<\/p>\n
All the bottles were seized. The opened two bottles<\/p>\n
were separately sealed. Evidence of PW1, in cross-<\/p>\n
examination, is only to the effect that apart from<\/p>\n
sealing of the said two bottles, no separate sample<\/p>\n
was taken. Those two bottles were produced in<\/p>\n
court.     The other  bottles  were confiscated  as<\/p>\n
provided under Section 67B of Abkari Act. Evidence<\/p>\n
establish that the two bottles seized and sent for<\/p>\n
all   chemical   analysis  were  the representative<\/p>\n
samples of the bottles. Therefore, based on the<\/p>\n
evidence     of PW1,  relied   on  by the   learned<\/p>\n
Magistrate, it cannot be said that no sample was<\/p>\n
taken. So also, for the reason that the capacity of<\/p>\n

the two bottles, which were sent to the Laboratory,<\/p>\n
is less than the permissible limit of Indian Made<\/p>\n
Foreign Liquor, which could be in the possession of<\/p>\n
a person, it cannot be said that an offence under<\/p>\n
Section 58 of Abkari Act is attracted. Evidence is<\/p>\n
that there were 24 bottles, each containing 375 ml.<\/p>\n
in 54 cases and 12 bottles, each containing 750 ml.<\/p>\n
in 84 cases. The quantity is huge and not within<\/p>\n
the permissible limit. As rightly found by the<\/p>\n
courts below, evidence establish that those bottles<\/p>\n
of Indian Made Foreign Liquor are not lawfully<\/p>\n
manufactured or transported. It is proved that<\/p>\n
petitioner, who was found in the van, when the<\/p>\n
Indian Made Foreign Liquor was being transported,<\/p>\n
has   been   in possession of  the  same  with   the<\/p>\n
knowledge that they are unlawfully manufactured or<\/p>\n
transported.   In such circumstances, conviction of<\/p>\n
the petitioner for the offence under Section 58 of<\/p>\n
Abkari Act is perfectly legal.\n<\/p>\n
     7. Then the question is regarding the sentence.<\/p>\n
Learned Magistrate sentenced the petitioner only to<\/p>\n
CRRP 2652\/03             7<\/span><\/p>\n
simple imprisonment for three months and a fine of<\/p>\n
Rs.15,000\/-.   The fine   awarded  by  the   learned<\/p>\n
Magistrate is the minimum sentence provided as on<\/p>\n
the date of commission of the offence. Even though<\/p>\n
the sentence provided is imprisonment which may<\/p>\n
extend to one year at that time, learned Magistrate<\/p>\n
sentenced    the   petitioner    only   to    simple<\/p>\n
imprisonment for three months. In such circumstances,<\/p>\n
the sentence is also reasonable.\n<\/p>\n
     There is no merit in the revision. Revision is<\/p>\n
dismissed. It is made clear that petitioner is<\/p>\n
entitled to get set off for the period he has been<\/p>\n
in custody before charge was framed and subsequent<\/p>\n
to the conviction, if any. Petitioner is directed<\/p>\n
to appear before Judicial First Class Magistrate-I,<\/p>\n
Thrissur on 03.09.2010. The Magistrate is directed<\/p>\n
to execute the sentence.\n<\/p>\n
