Petitioner is aggrieved by the order<\/p>\n<p>                  bearing Memo No. 1086 dated 18.5.2006, Annexure-3,<\/p>\n<p>                  passed by the Director (Administration)-cum- Joint<\/p>\n<p>                  Secretary, Human Resources Development Department<\/p>\n<p>                  whereunder petitioner has been held entitled for grant<\/p>\n<p>                  of scale of Rs. 4000- 6000\/- with effect from 1.1.1996<\/p>\n<p>                  in partial modification of the departmental letter No. 92<\/p>\n<p>                  dated 24.4.1999 whereunder petitioner was allowed the<\/p>\n<p>                  higher scale of Rs. 5000- 8000\/-.\n<\/p>\n<p>                               3. It is submitted on behalf of the petitioner<\/p>\n<p>                  that order bearing Memo No. 1086 dated 18.5.2006,<\/p>\n<p>                  Annexure-3, has been passed reducing the scale of the<\/p>\n<p>                  petitioner without giving him any opportunity of being<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>heard as also without noticing the fact that petitioner<\/p>\n<p>served on the post of Head Typist, the order, however,<\/p>\n<p>proceeds on the basis that petitioner is serving as<\/p>\n<p>Typist, which is incorrect. It is also pointed out that the<\/p>\n<p>higher scale of Rs. 5000 &#8211; 8000\/- is admissible to Head<\/p>\n<p>Typist.\n<\/p>\n<p>          4. Aforesaid submission was noticed by this<\/p>\n<p>Court under interim order dated 12.3.2007 passed in<\/p>\n<p>the instant writ case with direction to the State-<\/p>\n<p>respondents to file counter affidavit and not to take any<\/p>\n<p>coercive steps against the petitioner. Till date no<\/p>\n<p>counter affidavit has been filed. Counsel for the State,<\/p>\n<p>A.C. to S.C.-27, however, states that further time may<\/p>\n<p>be allowed and matter be taken up for admission on<\/p>\n<p>Monday (01.08.2011) by which date counter affidavit<\/p>\n<p>shall be filed. Aforesaid request of the counsel for the<\/p>\n<p>State to grant further time to file counter affidavit is<\/p>\n<p>rejected in view of the order which is being proposed to<\/p>\n<p>be passed in the instant case.\n<\/p>\n<p>          5.    Impugned      order   dated    18.5.2006,<\/p>\n<p>Annexure-3 reducing the pay scale of the petitioner<\/p>\n<p>having been issued without granting the petitioner<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>         opportunity of being heard, in the circumstances suffers<\/p>\n<p>         from the vice of arbitrariness, the writ petition is<\/p>\n<p>         disposed of directing the petitioner to appear before the<\/p>\n<p>         Director (Administration)-cum- Joint Secretary, Human<\/p>\n<p>         Resources Development Department, who shall grant<\/p>\n<p>         the petitioner opportunity of being heard in the light of<\/p>\n<p>         the submissions noted in this order and pass<\/p>\n<p>         appropriate reasoned order in the matter. In the event,<\/p>\n<p>         contention of the petitioner is accepted by the Director<\/p>\n<p>         (Administration)-cum-      Joint    Secretary,     Human<\/p>\n<p>         Resources Development Department            then it goes<\/p>\n<p>         without saying that not only the order dated 18.5.2006,<\/p>\n<p>         Annexure-3 shall be modified granting the petitioner<\/p>\n<p>         scale of Rs. 5000- 8000\/- with effect from 1.1.1996, but<\/p>\n<p>         arrears thereof shall also be paid as early as possible, in<\/p>\n<p>         any case within three months from the date of receipt\/<\/p>\n<p>         production of a copy of this order before the Director<\/p>\n<p>         (Administration)-cum-      Joint    Secretary,     Human<\/p>\n<p>         Resources Development Department.\n<\/p>\n<\/p>\n<pre>Arjun\/                                        ( V.
