JUSTICE JASBIR SINGH\n\nPresent:     Mr.Peeush Gagneja, Advocate for the petitioner\n                        .....\n<\/pre>\n<p>Jasbir Singh, J.(Oral)<\/p>\n<p>             Notice of motion.\n<\/p>\n<p>             On asking of the Court, Mr.A.K.Sharma, Additional Advocate<\/p>\n<p>General, Punjab Punjab accepts notice.\n<\/p>\n<p>             Heard.\n<\/p>\n<p>             By filing this writ petition, the petitioner has prayed that<\/p>\n<p>directions be issued to the respondents, to release admitted payment, due to<\/p>\n<p>him towards execution of works, detail of which has been given in<\/p>\n<p>paragraph No. 3 of this writ petition.\n<\/p>\n<p>             It is case of the petitioner that he has successfully executed the<\/p>\n<p>work, as mentioned above. Entries were made in the measurement book,<\/p>\n<p>however, the payment has not been released. Thereafter, the petitioner has<\/p>\n<p>served a legal notice dated 28.9.2008 (P5) for releasing the payment, which<\/p>\n<p>is still pending undecided.\n<\/p>\n<p>             This Court feels that if there is no defect in the work executed<\/p>\n<p>by the petitioner, the authorities are not justified to detain amount due to<\/p>\n<p>him.\n<\/p>\n<p><span class=\"hidden_text\"> Civil Writ Petition No.14210 of 2009                                       2<\/span><\/p>\n<p>             In view of facts mentioned above, this writ petition is disposed<\/p>\n<p>of by issuing directions to respondent No.3 to decide legal notice dated<\/p>\n<p>28.9.2008 (P5) served by the petitioner and if there is no legal hitch, release<\/p>\n<p>admitted payment to the petitioner, within three months from the date of<\/p>\n<p>receipt of a copy of this order, failing which, the petitioner shall be entitled<\/p>\n<p>to get interest @ 8% per annum from the date the amount had become due<\/p>\n<p>to him till its realisation.
