Since<br \/>\neven after waiting for almost 30 months from the date of award the<br \/>\nrespondent Nagarpalika did not comply with Award, the petitioner<br \/>\nfiled this petition with a prayer that the respondent Nagarpalika may<br \/>\nbe directed to implement the award. Until then the respondent<br \/>\nNagarpalika had not taken any action in connection with the Award<br \/>\ndated 21.11.2006.\n<\/p>\n<p>2.\tIt<br \/>\nis necessary to note that even after the presentation of the petition<br \/>\nin December, 2007 and even after the Court issued notice on<br \/>\n28.12.2007, the respondent Nagarpalika did not take any action for<br \/>\nalmost 8 months i.e. in all for almost 21 months since the date of<br \/>\nAward.\n<\/p>\n<p>3.\tToday,<br \/>\nwhen the Court was about to pass direction in view of the aforesaid<br \/>\nfacts and in light of the relief prayed for in the petition, Mr.<br \/>\nRathod, learned advocate for the respondent Nagarpalika submitted<br \/>\nthat on 29.7.2008 i.e. after almost 7 months since this Court issued<br \/>\nnotice in the petition and after almost 20 months since the date of<br \/>\nAward, the respondent ?  Nagarplaik has filed Misc. Application<br \/>\nunder Rule 26A of the Industrial Disputes Act for restoration of the<br \/>\nproceedings, since the Award, implementation of which is prayed for<br \/>\nin the present petition has been passed ex parte.\n<\/p>\n<p>4.\tIn<br \/>\nresponse to the said submission of learned advocate Mr. Rathod, Mr.<br \/>\nMishra, learned advocate for the petitioner submitted that the<br \/>\napplication which is claimed to have been filed by the petitioner now<br \/>\nafter 20 months is obviously time barred and it appears to have been<br \/>\nfiled almost after 7 months since the Court issued notice in the<br \/>\npetition only with a view to frustrating  present petition. He<br \/>\nsubmitted that in view of such facts, the respondent Nagarpalika may<br \/>\nbe directed to at least reinstate the petitioner during the<br \/>\nconsideration of the Misc. Application by the Labour Court.\n<\/p>\n<p>5.\tIn<br \/>\nthe facts and circumstances of the case, particularly, in light of<br \/>\nthe submission made by Mr. Rathod, learned advocate that now after 20<br \/>\nmonths, the respondent Nagarpalika has filed Misc. Application No.7<br \/>\nof 2008 on 29.7.2008 with a request for setting aside the ex parte<br \/>\nAward, the respondent Nagarpalika is directed, by way of ad hoc and<br \/>\ninterim arrangement during the consideration of the Misc.<br \/>\nApplication, to reinstate the petitioner without prejudice its rights<br \/>\nand contentions in the Misc. Application and to start paying him<br \/>\nregular wages. The respondent Nagarpalika shall issue necessary<br \/>\norders of reinstating the petitioner w.e.f. 1.9.2008 without<br \/>\nprejudice to the prayer in the Misc. Application.\n<\/p>\n<p>6.\tIt<br \/>\nis clarified that the Labour Court will decide Misc. Application in<br \/>\naccordance with law after considering all submissions and objection<br \/>\nof the petitioner &#8211; workman herein and also without being influenced<br \/>\nby the fact that by virtue of this Court&#8217;s order, the respondent<br \/>\nNagarpalika is directed to reinstate the petitioner. The said aspect<br \/>\nshould not influence the Labour Court in taking any decision in<br \/>\nconnection with the relief prayed for by the respondent Nagarpalika.<br \/>\nIt is also clarified that this ad-hoc arrangement shall not create<br \/>\nany equity or right in favour of the petitioner.\n<\/p>\n<p>7.\tIt<br \/>\nis pertinent to note that on 4.1.2008, the Executive Committee of the<br \/>\nrespondent Nagarpalika is said to have passed Resolution being<br \/>\nResolution No.37 taking decision to reinstate the respondent on his<br \/>\noriginal post and yet the said Resolution is not implemented during<br \/>\nthis entire period of 7 months and instead now on 29.7.2008, as<br \/>\nclaimed by Mr. Rathod, learned advocate  Misc. Application is filed<br \/>\nin the Labour Court. Be that as it may, The conduct of the Executive<br \/>\nCommittee and of the respondent Nagarpalika that even after the<br \/>\nResolution dated 4.1.2008, the respondent Nagarpalika did not inform<br \/>\nthis Court about the said Resolution and kept on dragging this<br \/>\npetition, is unjustified and for such action, it is considered<br \/>\nappropriate to grant costs in favour of the petitioner, which is<br \/>\nquantified at Rs.2000\/-. The aforesaid Resolution No.37 dated<br \/>\n4.8.2008 is kept on record.\n<\/p>\n<p>8.\tIn<br \/>\nview of the aforesaid direction, Mr. Mishra, learned advocate  for<br \/>\nthe petitioner does not press this petition at this stage.<br \/>\nAccordingly, the petition is disposed of at this stage, as not<br \/>\npressed.
