No.42432 of 2010\n                                      UMESH RAM\n                                          Versus\n                                THE STATE OF BIHAR\n                                        -----------\n<\/pre>\n<p>3.   17.3.2011                 Heard both the sides.\n<\/p>\n<p>                               The case is under Section 302 of the I.P.C. and the<\/p>\n<p>                 allegation is that the present petitioner along with other co-<\/p>\n<p>                 accused persons committed the murder of Jagdish Ram who was<\/p>\n<p>                 the Bahnoi of the petitioner. Jagdish Ram used to earn after<\/p>\n<p>                 labouring in Punjab, send the major part of his earnings to his<\/p>\n<p>                 wife through Surendra Ram who was the maternal uncle of his<\/p>\n<p>                 wife. The wife used to keep some part of the money and hand<\/p>\n<p>                 over the remaining part of the money to this petitioner who on<\/p>\n<p>                 being requested to pay the money back by the deceased was not<\/p>\n<p>                 paying up and on the pretext of Puja to be solemnised in the<\/p>\n<p>                 household, took away the deceased. This petitioner along with<\/p>\n<p>                 other accused strangulated him to death thereafter.<\/p>\n<p>                               The defence of the petitioner, as may appear from<\/p>\n<p>                 the reading of paragraph 1 of the case diary is that the deceased<\/p>\n<p>                 was sleeping on a chauki and had fallen from it and died on that<\/p>\n<p>                 account. But, that part of the story is completely exploded by the<\/p>\n<p>                 Doctor who found a ligature mark continuously on the neck of<\/p>\n<p>                 the informant suggesting that the deceased was asphyxiated to<\/p>\n<p>                 death.\n<\/p>\n<p>                               Considering the fact that the deceased had been<\/p>\n<p>                 taken away by this petitioner and he died in the house of the<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>        petitioner having ligature mark on his neck the defence of the<\/p>\n<p>        petitioner is tale tale and considering that the Court is not<\/p>\n<p>        inclined to direct the release of the petitioner on bail.<\/p>\n<p>                       The petition is dismissed.\n<\/p>\n<\/p>\n<pre>Kanth                                          ( Dharnidhar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Umesh Ram vs The State Of Bihar on 17 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
