Both parties were present.\n<\/p>\n<p>2.    The RTI-application corresponding to this second-appeal was filed<br \/>\nby the appellant on 14.06.2007 comprising the following nine queries:-\n<\/p>\n<blockquote><p>      &#8220;1.   The subject case against New Tobacco was initiated in<br \/>\n            1996, but the Departmental Proceedings against Sri Guha<br \/>\n            was initiated in April 2001. Why such delay occurred?\n<\/p><\/blockquote>\n<blockquote><p>       2.   The Inquiry Officer submitted his report in April 2003 that<br \/>\n            found &#8216;Articles of Charge &#8211; Not proved&#8217; against Sri Guha<br \/>\n            and it was communicated in June 2003 by the Disciplinary<br \/>\n            Authority i.e. Commissioner, Central Excise, Kolkata II,<br \/>\n            without any comment.\n<\/p><\/blockquote>\n<blockquote><p>            Please inform whether the IO Report was accepted or<br \/>\n            rejected in April-June 2003 by the Disciplinary<br \/>\n            Authority. If it was disagreed at that time, please<br \/>\n            provide a copy of the relevant portion of the Note Sheet<br \/>\n            in this regard.\n<\/p><\/blockquote>\n<blockquote><p>       3.   In September 2004, a communication was sent to Sri Guha<br \/>\n            by the Disciplinary Authority intimating &#8216;Imposition of<br \/>\n            Major Penalty&#8217; as per CVC&#8217;s 2nd Stage Advice on the basis of<br \/>\n            IO Report that held charges not proved. In June 2006<br \/>\n            Disciplinary Authority proposed to disagree with the<br \/>\n            findings of the IO Report (April 2003).<br \/>\n            Is there any relation between the September 2004 letter<br \/>\n            and June 2006 letter? If yes, how these two were<br \/>\n            related?\n<\/p><\/blockquote>\n<blockquote><p>       4.   Under what law major penalty can be imposed without<br \/>\n            proof of any charge?\n<\/p><\/blockquote>\n<blockquote><p>       5.   Sri Guha submitted a reply to the June 2006 letter on 26<br \/>\n            June 2006. What are the stage-wise time frames provided for<br \/>\n            disposal of disciplinary proceedings? Whether these<br \/>\n            time frames were maintained in case of Sri Guha?\n<\/p>\n<p>       7.   What is the current status of the New Tobacco Company<br \/>\n            Ltd., Agarpara for which departmental proceedings was<br \/>\n            lodged?\n<\/p>\n<p>       8.   Sri Guha&#8217;s first ACP was due in October 2000 and the<br \/>\n            Chargesheet was issued in April 2001. Even then why ACP<br \/>\n            benefits were not given to him?\n<\/p>\n<p>       9.   Whether the disciplinary authority is aware that Sri<br \/>\n            Guha is a Pensioner and have not been getting my full<br \/>\n            pension benefits?\n<\/p>\n<p>            If yes, how does he propose to provide solace to Sri<br \/>\n            Guha and his family?&#8221;\n<\/p>\n<p>3.    Response was furnished to the appellant by CPIO on 09.07.2007<br \/>\nand by the Appellate Authority on 17.08.2007. This second-appeal filed<br \/>\nby appellant was received in the Commission on 13.04.2009.\n<\/p>\n<p>4.   There appears to be considerable delay in the appellant filing the<br \/>\nsecond-appeal. But having taken it on file, it is decided to continue the<br \/>\nproceeding for a decision.\n<\/p>\n<p>5.    Appellant stated during the hearing that presently his request for<br \/>\ninformation was only one, which was, the reason for delay of six years<br \/>\nin taking a decision in an enquiry which was initiated against the<br \/>\nappellant through a departmental proceeding in April, 2001. Appellant<br \/>\nmeanwhile retired on 28.02.2003, but the proceeding against him<br \/>\nremained inconclusive.\n<\/p>\n<p>6.    It was submitted on behalf of the respondents that the case of<br \/>\nthis appellant was pending before the Central Board of Excise and<br \/>\nCustoms (CBEC) since 31.07.2006. On a query from the Board, further<br \/>\ninformation was furnished by Central Excise Commissionerate, Kolkata-II<br \/>\non 12.04.2007. The orders of the CBEC were awaited.\n<\/p>\n<p>Decision:\n<\/p>\n<p>7.    CPIO, CBEC, Md.Akhtarul Hanif, Under Secretary is hereby<br \/>\ndirected to furnish a reply to the appellant after obtaining it from the<br \/>\nofficer who held the requisite information, within three weeks of the<br \/>\nreceipt of this order, under intimation to the Commission which must<\/p>\n<p>AT-30062009-13.doc<br \/>\n<span class=\"hidden_text\">                                                              Page 2 of 3<\/span><br \/>\n reach the Commission within one week of the reply furnished to the<br \/>\nappellant on behalf of CBEC.\n<\/p>\n<p>8.
