BASANT, J.\n\n           ````````````````````````````````````````````````````\n                   B.A. No. 1823 OF 2008 C\n           ````````````````````````````````````````````````````\n           Dated this the 24th day of March, 2008\n\n                             O R D E R\n<\/pre>\n<p>           Application for anticipatory bail. Petitioner, a young<\/p>\n<p>man aged about 22 years, faces allegations as the first<\/p>\n<p>accused in a crime registered for offences punishable under<\/p>\n<p>the Dowry Prohibition Act. He was allegedly in love with a girl<\/p>\n<p>elder to him. There was allegedly an agreement between the<\/p>\n<p>young lovers to get married. His parents evidently dissuaded<\/p>\n<p>him from entering such a matrimony. At the eleventh hour he<\/p>\n<p>allegedly backed out from the agreement. Allegations have<\/p>\n<p>been made and crime has been registered against the<\/p>\n<p>petitioner\/son and his father.          The allegation is that the<\/p>\n<p>backing out of the petitioner from the agreement to marry is<\/p>\n<p>consequent to disagreement on the amount payable as<\/p>\n<p>dowry.    The father had approached this Court with an<\/p>\n<p>application for anticipatory bail and by order dated 12.3.08 in<\/p>\n<p>BA.1823\/08<br \/>\n<span class=\"hidden_text\">                              : 2 :<\/span><\/p>\n<p>BA.1307\/08 he was granted anticipatory bail subject to<\/p>\n<p>conditions. The petitioner now apprehends imminent arrest.<\/p>\n<p>He prays that directions under section 438 Cr.P.C. may be<\/p>\n<p>issued in his favour also.     The    learned counsel for the<\/p>\n<p>petitioner submits that it was not a case of the marriage not<\/p>\n<p>taking place on account of any dispute regarding dowry.<\/p>\n<p>Better counsel appears to have prevailed and the calf love did<\/p>\n<p>not mature into serious matrimony, it is submitted.<\/p>\n<p>      2.   The learned counsel for the petitioner prays, the<\/p>\n<p>learned Public Prosecutor does not oppose the said prayer<\/p>\n<p>and I am satisfied that the petitioner herein can also be<\/p>\n<p>granted anticipatory bail subject to identical conditions as<\/p>\n<p>were imposed on the father of the petitioner.<\/p>\n<p>      3.   In the result, this petition is allowed. Following<\/p>\n<p>directions are issued under Section 438 Cr.P.C in favour of<\/p>\n<p>the petitioner.\n<\/p>\n<p>      i)   Petitioner shall surrender before the learned<\/p>\n<p>Magistrate having jurisdiction at 11 a.m on 31.3.2008.   He<\/p>\n<p>BA.1823\/08<br \/>\n<span class=\"hidden_text\">                                : 3 :<\/span><\/p>\n<p>shall be released on regular bail on condition that he executes<\/p>\n<p>a bond for Rs.25,000\/-(Rupees twenty five thousand only)<\/p>\n<p>with two solvent sureties each for the like sum to the<\/p>\n<p>satisfaction of the learned Magistrate.<\/p>\n<p>      ii)   The petitioner shall make himself available for<\/p>\n<p>interrogation before the investigating officer between 10 a.m<\/p>\n<p>and 5 p.m on 1.4.08 and 2.4.2008. During this period, the<\/p>\n<p>investigating officer shall be at liberty to interrogate the<\/p>\n<p>petitioner in custody and take all necessary steps for the<\/p>\n<p>proper conduct of the investigation in this crime. Thereafter,<\/p>\n<p>he shall appear before the investigating officer on all Mondays<\/p>\n<p>between 5 p.m. and 6 p.m. for a period of one month and<\/p>\n<p>subsequently as and when directed by the investigating officer<\/p>\n<p>in writing to do so.\n<\/p>\n<p>      (iii) If the petitioner does not appear before the learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above<\/p>\n<p>shall thereafter stand revoked and the police shall be at liberty<\/p>\n<p>to arrest the petitioner and deal with him in accordance with<\/p>\n<p>BA.1823\/08<br \/>\n<span class=\"hidden_text\">                               : 4 :<\/span><\/p>\n<p>law, as if these directions were not issued at all.<\/p>\n<p>     (iv) If he were arrested prior to 31.3.2008, he shall be<\/p>\n<p>released from custody on his executing a bond for<\/p>\n<p>Rs.25,000\/- (Rupees twenty five thousand only) without any<\/p>\n<p>sureties, undertaking to appear before the learned Magistrate<\/p>\n<p>on 31.3.2008.\n<\/p>\n<\/p>\n<p>                                          (R.BASANT, JUDGE)<br \/>\naks<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court C.B.Bineesh vs State Of Kerala To Be Rep.
