    Since  these  Writ  Petitions  are  similar  in<\/p>\n
nature, the Writ Petitions are disposed of    by a<\/p>\n
common judgment.\n<\/p>\n
    The petitioners in W.P.(C) No.24387 of 2010<\/p>\n
state that they are working as trainees under the<\/p>\n
Entrepreneurship training under a project called<\/p>\n
“Agro Biotechnology Agency for Rural Employment<\/p>\n
Development”  (ABARD).   The  project   was   being<\/p>\n
implemented  with   the   help   of   three   local<\/p>\n
panchayaths in and around the Campus of Kerala<\/p>\n
Agricultural  University   at  Mannuthy,   Thrissur<\/p>\n
District.   It is stated that about 150 trainees<\/p>\n
were selected from the three panchayath areas and<\/p>\n
they were given training for six months.    As per<\/p>\n
Ext.P2  order   dated  28.4.2006   passed  by   the<\/p>\n
Executive   Committee   of   Kerala    Agricultural<\/p>\n
University, a Sub Committee was constituted to<\/p>\n

study   the   feasibility     of   absorption    of  ABARD<\/p>\n
trainees    as   casual     labourers    in   the   Kerala<\/p>\n
Agricultural University.       The decision taken by the<\/p>\n
Sub Committee is produced as Ext.P3. Clause (1) in<\/p>\n
Ext.P3 reads as follows:\n<\/p>\n<\/p>\n
          “After detailed deliberations the following
\n         decisions were taken .\n<\/p><\/blockquote>\n
     1) All the 60 ABARD Trainees may be enrolled as
\n          Casual  labourers   in  a  phased  manner at
\n          Mannuthy Campus and Pooled at University
\n          Livestock Farm & Fodder Research Development
\n          Schme, Mannuthy.”<\/p><\/blockquote>\n
    2. The grievance of the petitioners is that<\/p>\n
they were not absorbed.\n<\/p>\n<\/p>\n
    3. The reliefs prayed for by the petitioners in<\/p>\n
the Writ Petition are the following:<\/p>\n
    “i)   To issue a Writ of Mandamus directing the
\n          respondents  to   implement  Exhibit P3  and
\n          enroll the petitioners as Casual labourers
\n          under the 1st respondent University.<\/p><\/blockquote>\n
    ii)   To issue a Writ of Mandamus directing the
\n          respondents to consider and pass orders on<\/p>\n

          Exhibits P4 and P5 representations within a
\n          reasonable time limit as this Hon’ble Court
\n          may be pleased to fix.\n<\/p>\n
    iii) To issue    such   other writs,  orders   or
\n          directions as this Hon’ble Court may deem
\n          fit and proper in the circumstances of the
\n          case.”\n<\/p>\n<\/p>\n
    4. It is submitted by the learned counsel for<\/p>\n
the  petitioners     that   for  the   time  being,   the<\/p>\n
petitioners confine their relief to relief No.(ii),<\/p>\n
reserving their right to pursue the other reliefs<\/p>\n
at the appropriate stage.\n<\/p>\n<\/p>\n
    5. The petitioners in WP(C) No.23197\/2010 and<\/p>\n
17755 of 2010 are daily rated workers at Cashew<\/p>\n
Research    Station,    Madakkathara    of   the    first<\/p>\n
respondent University.       They state that they have<\/p>\n
been   working as daily rated workers since 1999 and<\/p>\n
they have crossed the age for seeking employment<\/p>\n
elsewhere.    It is also stated that the petitioners<\/p>\n
were performing the duties of regular employees.<\/p>\n
They have got the necessary skill and training for<\/p>\n

undertaking    the   work necessary  for  the  Cashew<\/p>\n
Research    Station     or  other   centres  of   the<\/p>\n
University.    The   grievance  put  forward  by  the<\/p>\n
petitioners in these two Writ Petitions is that<\/p>\n
ignoring    the   fact   that  the  petitioners  were<\/p>\n
employed for long as daily rated workers, the<\/p>\n
University took steps to appoint casual labourers<\/p>\n
from among the persons who were trained by ABARD.<\/p>\n
The petitioners in these two Writ Petitions also<\/p>\n
claimed similar status as ABARD trainees.        They<\/p>\n
submitted    Ext.P3    representation  to  the   Vice<\/p>\n
Chancellor of the University requesting to appoint<\/p>\n
them as casual labourers along with the ABARD<\/p>\n
trainees.     The representations submitted by the<\/p>\n
petitioners    in   these   two  Writ  Petitions  are<\/p>\n
pending.\n<\/p>\n<\/p>\n
    6.   In   Writ   Petition  19402\/2010, the  first<\/p>\n
petitioner is Kerala Agricultural University Labour<\/p>\n
Association,    Pookkode and the second petitioner is<\/p>\n
W.P.(C).Nos.17755,19402,
\n23197 & 24387 of 2010        5<\/p>\n
the   daily wage worker in the Instructional Farm,<\/p>\n
Pookode, run by the Kerala Agricultural University.<\/p>\n
The   grievance     of   the   petitioners  in   WP(c)<\/p>\n
No.19402\/2010 is that though the persons like the<\/p>\n
second petitioner were employed as daily rated<\/p>\n
workers for quite long time, they were not absorbed<\/p>\n
in  service    by   the  University.     Instead, the<\/p>\n
University     decided   to   recruit   fresh   casual<\/p>\n
labourers.    The first petitioner in WP(C) No.19402<\/p>\n
of  2010    submitted   Ext.P3   representation  dated<\/p>\n
14.6.2010 before the Vice Chancellor and Registrar<\/p>\n
of the University.     Ext.P3 is pending disposal.<\/p>\n
    7.   The   petitioners   in   the  aforesaid  Writ<\/p>\n
Petitions submitted that for the time being, it is<\/p>\n
sufficient,     if   the   Vice   Chancellor  of   the<\/p>\n
University and if necessary, the Registrar of the<\/p>\n
University     are     directed   to   consider   the<\/p>\n
aforementioned    representations   submitted  by the<\/p>\n
respective petitioners.<\/p>\n

    In the facts and circumstances of the case, the<\/p>\n
Writ Petitions are disposed of directing the Vice<\/p>\n
Chancellor of the University or if necessary by the<\/p>\n
Registrar of the University to consider and dispose<\/p>\n
of    the    representations    submitted   by   the<\/p>\n
petitioners, after affording the representatives of<\/p>\n
the   petitioners     an  opportunity  for  personal<\/p>\n
hearing.      A   decision shall  be  taken  on  the<\/p>\n
representations as expeditiously as possible and at<\/p>\n
any rate within a period of three months from the<\/p>\n
date of receipt of a copy of the judgment.<\/p>\n
    Writ Petitions are disposed of as above.<\/p>\n
      It is made clear that I have not considered<\/p>\n
the claims put forward by the petitioners on the<\/p>\n
merits.\n<\/p>\n<\/p>\n
