Patarki Nutt, S\/o Mahjid Nut.\n                               Versus\n                       THE STATE OF BIHAR\n                              -----------\n<\/pre>\n<p>04.   23.06.2010          Heard learned counsel for the petitioners and<\/p>\n<p>                   the State.\n<\/p>\n<p>                          The petitioners seek bail in a case instituted<\/p>\n<p>                   for the offences under Sections 395 and 397 of the<\/p>\n<p>                   Indian Penal Code.\n<\/p>\n<p>                          It has been submitted that the petitioners are<\/p>\n<p>                   not named in the First Information Report but during<\/p>\n<p>                   investigation some witnesses disclosed the complicity<\/p>\n<p>                   of the petitioners as having been seen running away<\/p>\n<p>                   from the place of occurrence on the night of the<\/p>\n<p>                   occurrence. It has been submitted that had the<\/p>\n<p>                   petitioners been in fact seen after the occurrence<\/p>\n<p>                   their names would have been disclosed by the<\/p>\n<p>                   informant in the First Information Report and it<\/p>\n<p>                   being absent the whole story of identification appears<\/p>\n<p>                   to be concocted.\n<\/p>\n<p>                           Considering the same and also that there has<\/p>\n<p>                   been no recovery from their possession, let the<\/p>\n<p>                   petitioners, above named be released on bail on<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>furnishing bail bonds of Rs. 5,000\/- (Five Thousand)<\/p>\n<p>each with two sureties of the like amount each to the<\/p>\n<p>satisfaction of Chief Judicial Magistrate, Siwan in<\/p>\n<p>connection with Mairwa P.S. Case No. 146 of 2009<\/p>\n<p>subject to the following conditions:- (i) That one of the<\/p>\n<p>bailors will be a close relative of the petitioners who<\/p>\n<p>will give an affidavit giving genealogy as to how he is<\/p>\n<p>related with the petitioners and the other bailor shall<\/p>\n<p>be the wife of the petitioners. The bailor will also<\/p>\n<p>undertake to inform the Court if there is any change<\/p>\n<p>in the address of the petitioners. (ii) That the bailor<\/p>\n<p>shall also state on affidavit that he will inform the<\/p>\n<p>court concerned if the petitioners are implicated in<\/p>\n<p>any other case of similar nature after their release in<\/p>\n<p>the present case and thereafter the court below will<\/p>\n<p>be at liberty to initiate the proceeding for cancellation<\/p>\n<p>of bail on the ground of misuse. (iii) That the<\/p>\n<p>petitioners will give an undertaking that they will<\/p>\n<p>receive the police papers on the given date and be<\/p>\n<p>present on date fixed for charge and if they fail to do<\/p>\n<p>so on two given dates and delays the trial in any<\/p>\n<p>manner, their bail will be liable to be cancelled for<\/p>\n<p>reasons of misuse. (iv) That the petitioners will be well<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>           represented on each date and if they fail to do so on<\/p>\n<p>           two consecutive dates, their bail will be liable to be<\/p>\n<p>           cancelled.\n<\/p>\n<p>                    In view of the antecedents of the petitioners,<\/p>\n<p>           the petitioners are directed to appear before the<\/p>\n<p>           Supdt. of Police, Siwan within fifteen days of their<\/p>\n<p>           release with a copy of this order and thereafter every<\/p>\n<p>           two weeks for the next one year. The conduct of the<\/p>\n<p>           petitioners will be kept under watch in this period by<\/p>\n<p>           the S.P. concerned and if it is found wanting in any<\/p>\n<p>           respect, a report shall be made to the court concerned<\/p>\n<p>           by him to initiate a proceeding for cancellation of bail<\/p>\n<p>           for reasons of misuse of bail.
