 The’  .._FOrest Act, 1963, for short the ‘Act’, in<\/p>\n
adfiihitioniv  crirninal complaint registered as CC 698\/ 1994<\/p>\n
 beforexthe OCMFC Court at Koppa for Offence punishable<\/p>\n
  Sec.104{A) of the Act, whence the persons arrested<\/p>\n

2. The petitioner’s Cr1.A.38\/1993 before the District<\/p>\n
and Sessions Judge Court, Chickmagalur, was a1_4].oV\\iv-edi~.by<\/p>\n
order dated 12.1.1994 and the vehicle in  H<\/p>\n
to the petitioner by way of interim_–custody;’=ionAthe <\/p>\n
execution of indemnity bond for <\/p>\n
other conditions, on 22.1.1994.\n<\/p>\n
3. Before the Authoriseditjiftice-ratwoi for the
\nprosecution were exarniipnedp ‘and 2, and the
\npetitioner was examined ‘ii1’he:’:ii’X_uthorised Of\ufb01cer
\nframed behaving regard to the
\nmaterial on rec’o.rd.,_F’Vbeingmsatis\ufb01ed that a forest offence
\nwas cornrnittedi V  the property of the State<\/p>\n
Government, directed con\ufb01scation of the motor vehicle, the<\/p>\n
  size logs and the petitioner to surrender the<\/p>\n
I ‘~v:ehi::il\u00abe days, by order dated 7.4.1999 Annexure<\/p>\n
B.\n<\/p>\n
 The petitioner aggrieved by the said order filed<\/p>\n
 9;f.,cirirni.naiiii appeal No. 61\/ 1999 before the Fast Track Court-<\/p>\n

driver to take vehicle to the house of his friend by name<\/p>\n
Prabhakar.\n<\/p>\n
6. Per contra, learned Adpdl. ,fC3_ri <\/p>\n
the respondent seeks to sustain ‘\u00bbthe;’or.C’.ers..impugned <\/p>\n
being well merited, fully jVusti_iiediii’a_.nid ic:a.l.1ing_ii3 for <\/p>\n
interference. Learned counsel:”h_astensii’tot iifithat the
\nproceedings under   the Act are
\nstatutory and inpdepende..nt._   of criminal
\nproceedings  the Act and
\nthat the  instant case, being
\nsatis\ufb01ed  in question was used for
\ncommittingia\u00bb justified in passing the<\/p>\n
ordergof con\ufb01scatioin. Learned counsel further submits that<\/p>\n
lithe i’petit’io&11eir”having failed to establish that he had taken all<\/p>\n
i’ca1’le_and.fpreCai1ti’on in the matter of entrustment of vehicle,<\/p>\n
was’r_1ot ,cntitl~ed to any benefit of doubt or leniency. Learned<\/p>\n
 further contends that the vehicle in question was<\/p>\n
 ipiixteicased to the petitioner pursuant to the order of the<\/p>\n
  .. _D_iistrict Court as well as in Criminal Petition 623\/2004.<\/p>\n
7. The Karnataka Forest Act is a special statute<\/p>\n
enacted for the purpose of preserving forest arid:i”fo;i’e.st.<\/p>\n

forest, is ir1\u00a5[_f?i;’=.,tec,%ii&Viii:i’1_.’1 .t1fie11-Authorisediibf\ufb01cer. The non<\/p>\n
obstante clause’—in_: the i’e1ievan.t::vprofvisions of the Act gives
\noverriding effect’iove_r”‘oth’eri”st_atutes and laws. Thus, what<\/p>\n
emanates’ from the  of the Act is that the<\/p>\n

 forest” on being satis\ufb01ed that an offence under the<\/p>\n
‘act .1-si\u00e9corrrrnvititec\ufb02and therefore the general power of the<\/p>\n

9. In View of Section 71A of the Act, there  be<\/p>\n
no more doubt, in my mind that the criminal prose’cutio’n<\/p>\n
launched against the persons arrested on sieZ’ure._oofi if<\/p>\n
vehicle alongwith forest produce, ..i\u00bbeadingT_ito,i1an,”ord\u00e9.f.V or-5..<\/p>\n
acquittai has no bearing over the<\/p>\n
the Authorised Officer in trie__”1natter”- of confiscation ‘and ” A<\/p>\n
seizure. Therefore the contentiorii:A’o,f_ the leairriedppcounsei for
\nthe petitioner that the   Seizure mahazar
\ndrawn under Subv.Section{V},i..of  the Act, by the
\nJMFC in the   the bene\ufb01t of the
\npetitioner   ufndieriiiiseiction 71A of the Act,
\ncannot say so, for yet another reason
\nthat proceedings   71(A) can be instituted by<\/p>\n
the authorised “officer either when the authorised officer<\/p>\n
 seizes sub–section (1) of Section 62 any timber, ivory<\/p>\n
beinigvtheipi’-property of the State, or Where any such<\/p>\n
property produced before an Authorised Officer under<\/p>\n
  iSub,–Secti.oh( 1) and he is satis\ufb01ed that a forest offence has<\/p>\n
