Petitioners who are partners of a firm which<\/p>\n<p>availed various loans from the 3rd              respondent Bank for<\/p>\n<p>business purpose, is challenging the proceedings initiated<\/p>\n<p>under the Securitization and Reconstruction of Financial<\/p>\n<p>Assets and Enforcement of Security Interest Act, 2002<\/p>\n<p>(SARFAESI Act). The loans in question were secured by<\/p>\n<p>mortgage of six items of immovable properties. According<\/p>\n<p>to the petitioners the respondents have already taken<\/p>\n<p>possession of the properties after issuing notice as<\/p>\n<p>contemplated under Section 13 (4) of the SARFAESI Act. It<\/p>\n<p>is now apprehended that the properties taken over<\/p>\n<p>possession will be sold in pursuance of the proceedings<\/p>\n<p>initiated. According to the petitioners they are ready and<\/p>\n<p>willing to pay off the liability by arranging private sale of<\/p>\n<p>W.P.(C)No. 29493 of 2009<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>some of the items of properties mentioned in Ext.P2 notice<\/p>\n<p>issued under Section 13 (2) of the SARFAESI Act.<\/p>\n<p>      2.    It is mentioned that the 1st petitioner had filed an<\/p>\n<p>earlier writ petition as W.P.(C) No.26028\/2009. In the said<\/p>\n<p>writ petition it was specifically contended that item No.6<\/p>\n<p>mentioned in the schedule of Ext.P2 notice is the residential<\/p>\n<p>house of the 1st petitioner and inpsite of 1st petitioner<\/p>\n<p>approaching the Bank with an offer to pay reasonable<\/p>\n<p>market price for the said item of property, the Bank was not<\/p>\n<p>prepared to accept such an offer .\n<\/p>\n<p>      3.    Standing counsel appearing for the respondents<\/p>\n<p>had produced a copy of the judgment in W.P.(C)<\/p>\n<p>No.26028\/2009 for my perusal.           It is noticed that on<\/p>\n<p>22nd September, 2009 the above said writ petition was<\/p>\n<p>disposed of directing the respondent Bank to consider offer<\/p>\n<p>of the 1st petitioner herein and to take a decision regarding<\/p>\n<p>feasibility of entering into a private sale of the said item of<\/p>\n<p>the property, with the 1st petitioner or with any of his<\/p>\n<p>nominees.       This court had shown indulgence in further<\/p>\n<p>W.P.(C)No. 29493 of 2009<br \/>\n<span class=\"hidden_text\">                                 -3-<\/span><\/p>\n<p>directing the Bank to abstain from sale of that particular<\/p>\n<p>item of property, till such decision is taken. It is submitted<\/p>\n<p>by the standing counsel that pursuant to such direction the<\/p>\n<p>1st petitioner has not so far made any concrete offer with<\/p>\n<p>respect to purchase of that particular item of property.<\/p>\n<p>      4.    It is noticed that the 1st petitioner herein had filed<\/p>\n<p>the earlier writ petition almost with identical prayers. In<\/p>\n<p>that writ petition he had restrained his claims, with respect<\/p>\n<p>to the property described as item No.6.                Now the<\/p>\n<p>1st petitioner along with another partner had filed this writ<\/p>\n<p>petition seeking the very same relief with respect to other<\/p>\n<p>items of property also.         It is noticed that inspite of<\/p>\n<p>indulgence shown in the earlier writ petition the petitioners<\/p>\n<p>have not made any concrete offer for purchase of property<\/p>\n<p>described as item No.6 in the schedule.            Therefore the<\/p>\n<p>repeated writ petition can only be considered as an attempt<\/p>\n<p>to protract the proceedings in one way or other. It is a<\/p>\n<p>shear abuse of the process of this court and the petitioners<\/p>\n<p>does not deserve any indulgence in this matter.<\/p>\n<p>W.P.(C)No. 29493 of 2009<br \/>\n<span class=\"hidden_text\">                               -4-<\/span><\/p>\n<p>      5.    Accordingly I find no ground to interfere and the<\/p>\n<p>writ petition is dismissed.\n<\/p>\n<\/p>\n<p>                                        C.K.
