Justice M.SASIDHARAN NAMBIAR\n\n Dated :22\/02\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ------------------------------------------\n            CRL.M.C.NO.483 OF 2010\n           ------------------------------------------\n           Dated 22nd          February 2010\n\n\n                         O R D E R\n<\/pre>\n<p>           Petitioners are the accused in<\/p>\n<p>C.C.943\/2007 on the file of chief Judicial<\/p>\n<p>Magistrate&#8217;s court, Kasaragod. Prosecution<\/p>\n<p>case is that on 13\/7\/2007 at about 5.50 p.m<\/p>\n<p>petitioners   formed             themselves            into   an<\/p>\n<p>unlawful assembly, with the common object<\/p>\n<p>of  causing    hurt         and         damages,         and  in<\/p>\n<p>furtherance of the common object armed with<\/p>\n<p>deadly weapons like iron rod stopped Maruti<\/p>\n<p>Omni Van KA-19\/MF-2097               being driven by the<\/p>\n<p>first respondent by blocking the road with<\/p>\n<p>Maruti   car KL-14B.2247 and                         motor cycle<\/p>\n<p>KL-14D.9262       and       with         iron        road  first<\/p>\n<p>accused hit on the face, chest                         and hands<\/p>\n<p>of the first respondent and caused grievous<\/p>\n<p>Crmc 483\/10<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>hurt       and   second   accused   showing   knife<\/p>\n<p>threatened that he will be murdered        and they<\/p>\n<p>caused      damages  to  the  Maruti  van  of  first<\/p>\n<p>respondent      to  the   tune  of  Rs.8,150\/-   and<\/p>\n<p>thereby committed offences under Sections 143,<\/p>\n<p>147, 148, 341, 323, 326, 506(ii) and 427 read<\/p>\n<p>with Section 149 of Indian Penal Code. Petition<\/p>\n<p>is filed under Section 482 of Code of Criminal<\/p>\n<p>Procedure      to  quash  the  proceedings  pending<\/p>\n<p>before the learned Magistrate contending that<\/p>\n<p>subsequently there was an amicable settlement<\/p>\n<p>of all the disputes with respondents 1 and 2<\/p>\n<p>and        they  have  no  subsisting  grievance  as<\/p>\n<p>against the petitioners and therefore,      as held<\/p>\n<p>by the Apex court in <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State<\/p>\n<p>of Punjab<\/a> (2008 (3) KLT 19 (SC), it is not in<\/p>\n<p>the     interest   of   justice  to   continue  the<\/p>\n<p>prosecution      and  therefore,   case  is  to   be<\/p>\n<p>Crmc 483\/10<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>quashed.\n<\/p>\n<p>           2. Respondents   1   and   2   appeared<\/p>\n<p>through a counsel and filed a joint petition<\/p>\n<p>along with the petitioners stating that there<\/p>\n<p>was amicable settlement of all the disputes and<\/p>\n<p>they are all now     friends and respondents 1 and<\/p>\n<p>2    have    absolutely  no  surviving   grievance<\/p>\n<p>against     the  petitioners  and  they  have   no<\/p>\n<p>objection to quash the proceedings.<\/p>\n<p>           3. Learned counsel appearing for the<\/p>\n<p>petitioners, respondents 1 and 2 and learned<\/p>\n<p>Public Prosecutor were heard.<\/p>\n<p>           4. Learned Public Prosecutor submitted<\/p>\n<p>that statement of respondents 1 and 2 were<\/p>\n<p>subsequently recorded and their statements also<\/p>\n<p>revealed that there was amicable settlement and<\/p>\n<p>respondents     1  and  2     have  no   surviving<\/p>\n<p>grievance against the petitioners.<\/p>\n<p>Crmc 483\/10<br \/>\n<span class=\"hidden_text\">                          4<\/span><\/p>\n<p>           5. As held by the Apex court in Madan<\/p>\n<p>Mohan Abbot&#8217;s case (supra) even though offences<\/p>\n<p>are     not   compoundable, when  there   was  an<\/p>\n<p>amicable settlement of all the disputes between<\/p>\n<p>the injured and the accused and consequent to<\/p>\n<p>the settlement there is no likelihood of a<\/p>\n<p>successful     prosecution, it   is  not  in   the<\/p>\n<p>interest of justice to continue the prosecution<\/p>\n<p>especially when prosecution would result only<\/p>\n<p>in    unnecessary waste of   valuable time of the<\/p>\n<p>court.\n<\/p>\n<p>           Petition is  allowed.
