No. 5721\/2010\n\n12.5.2010<\/pre>\n<p>.\n<\/p>\n<p>      Shri Wakeel Khan, learned counsel for petitioner.<\/p>\n<p>      Shri Deepak Awasthy, learned GA for State.<\/p>\n<p>      Heard.\n<\/p>\n<p>      This petition has been filed by the petitioner alleging<\/p>\n<p>that he has performed the marriage with Ku.Vandana,<\/p>\n<p>daughter of Dewaki Nandan Dewaliya. However, there is no<\/p>\n<p>proof of marriage submitted along with petition. The<\/p>\n<p>affidavits which have been filed only indicates that there<\/p>\n<p>was intention to perform the marriage . The photograph<\/p>\n<p>which has been filed is not of marriage ceremony, it cannot<\/p>\n<p>be taken to be a proof of performance of marriage of<\/p>\n<p>petitioner with Ku.Vandana.        Petitioner&#8217;s counsel has<\/p>\n<p>submitted that Vandana is going to be married again on<\/p>\n<p>16.5.10. In view of the fact that petitioner has not been able<\/p>\n<p>to prove it prima facie that he has performed marriage with<\/p>\n<p>Ku.Vandana, we are not inclined to entertain this petition<\/p>\n<p>filed to hold that she is in illegal custody of Dewaki Nandan<\/p>\n<p>Dewaliya who is the father of Ku. Vandana.<\/p>\n<p>      In view of aforesaid, we leave it open to the petitioner<\/p>\n<p>to avail the appropriate remedy before Civil Court to prove<br \/>\n the factum of marriage in appropriate proceedings, only<\/p>\n<p>thereafter he can claim the custody of Ku.Vandana.<\/p>\n<p>        The writ petition being devoid of merits is hereby<\/p>\n<p>dismissed.\n<\/p>\n<\/p>\n<pre>      (Arun Mishra)              (S.C.Sinho)\n         Judge.
