{"id":129100,"date":"2010-09-08T00:00:00","date_gmt":"2010-09-07T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/rewashankar-pathak-vs-beni-prasad-shrivastava-on-8-september-2010"},"modified":"2014-05-27T14:19:33","modified_gmt":"2014-05-27T08:49:33","slug":"rewashankar-pathak-vs-beni-prasad-shrivastava-on-8-september-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/rewashankar-pathak-vs-beni-prasad-shrivastava-on-8-september-2010","title":{"rendered":"Rewashankar Pathak vs Beni Prasad Shrivastava on 8 September, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Madhya Pradesh High Court<\/div>\n<div class=\"doc_title\">Rewashankar Pathak vs Beni Prasad Shrivastava on 8 September, 2010<\/div>\n<pre>                W.P..No.11961 of 2010\n\n\n\n\n8.9.2010\n\n\n       Shri Pranay Verma, Advocate for the petitioner.\n       This petition is directed against an order dated 13.8.2010\npassed by Second Civil Judge, Class-II, Gadarwara District\nNarsinghpur in Civil Suit No.4-A\/2008 by which petitioner's\napplication under Order 9 Rule 4 and 7 read with Section 151 of\nC.P.C. was rejected.\n       Learned counsel      for the petitioner submitted that the\npetitioner was proceeded ex parte on 8.7.2010 on which date the\npetitioner was suffering from high fever and could not attend the\ncase. After recovery, the petitioner moved an application before\nthe Trial Court on 23.7.2010 for setting aside ex parte order but it\nhas been rejected by the Trial Court.\n       On the perusal of the file, we find that the petitioner filed a\nsuit for eviction against the respondent in which the respondent<\/pre>\n<p>filed counter claim. On 8.7.2010        when the case was fixed for<br \/>\nrecording of evidence, the petitioner remained absent and the case<br \/>\nwas proceeded ex parte against the petitioner. On the adjourned<br \/>\ndate of hearing, 16.7.2010, the case was again adjourned and on<br \/>\nthat date, the other party submitted before the Trial Court that the<br \/>\ndefendant is not willing to produce any evidence and the case was<br \/>\nfixed for final argument.. On the adjourned date i.e. 23.7.2010, the<br \/>\npetitioner moved an application under Order 9 Rule 4 and 7 read<br \/>\nwith Section 151 of CPC for setting aside ex parte order which has<br \/>\nbeen rejected by the Trial Court on the ground that no<br \/>\ndocumentary evidence was produced by the petitioner in support<br \/>\nof his contention in respect of showing sufficient cause on that<br \/>\nday.\n<\/p>\n<p>       On perusal of the Order 9 Rule 7 of CPC, it is apparent that<br \/>\ngood cause has to be assigned for setting aside ex parte order.\n<\/p>\n<p>                   W.P..No.11961 of 2010<\/p>\n<p>Apart from this, the petitioner was plaintiff and in absence of the<br \/>\nplaintiff only an ex parte order has been passed in respect of the<br \/>\ncounter claim but the petitioner&#8217;s suit has not been dismissed by<br \/>\nthe Trial Court. In the application   of the petitioner under Order 9<br \/>\nRule 7     of CPC when good cause was shown by the petitioner,<br \/>\nprima facie the affidavit filed by the petitioner in support of the<br \/>\napplication ought to have been relied upon        by the Trial Court<br \/>\nunless and until some counter is filed by the other side denying the<br \/>\naverments of the petitioner. In these circumstances, we find that<br \/>\nthe Trial Court erred in rejecting the application filed by the<br \/>\npetitioner. Hence this petition is allowed and following directions<br \/>\nare issued :-\n<\/p>\n<p>(1)      The ex parte order passed against the petitioner dated<br \/>\n8.7.2010 is hereby set aside subject to payment of cost which we<br \/>\nquantify to be Rs.1000\/- (Rupees one thousand) payable by the<br \/>\npetitioner to the other side. On payment of cost, in the Trial Court,<br \/>\nto the other side, the Trial Court shall set aside the ex parte order<br \/>\ndated 8.7.2010 and shall proceed in the matter from the stage of<br \/>\nthe case as it was fixed on 8.7.2010.\n<\/p>\n<p>(2)      In case the cost is not deposited in the Trial Court before<br \/>\nthe next date of hearing, the Trial Court is free to proceed in the<br \/>\nmatter in accordance with law.\n<\/p>\n<p>(3)      As this case has been decided in the peculiar facts and<br \/>\ncircumstances of the case without notice to the other side, liberty<br \/>\nis granted to the other side to seek review of this order and in that<br \/>\ncircumstances, Shri Pranay Verma, learned counsel appearing for<br \/>\nthe petitioner shall accept notice on behalf of the petitioner and in<br \/>\nthat regard his Vakalatnama shall survive.\n<\/p>\n<p>                  W.P..No.11961 of 2010<\/p>\n<p>     This petition is finally disposed of.\n<\/p>\n<p>     C.c. as per rules.\n<\/p>\n<pre> (Krishn Kumar Lahoti)                       (J.K.Maheshwari)\n      JUDGE                                      JUDGE\n\n\nDV\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Rewashankar Pathak vs Beni Prasad Shrivastava on 8 September, 2010 W.P..No.11961 of 2010 8.9.2010 Shri Pranay Verma, Advocate for the petitioner.
