THE SUPERINTENDENT OF EXCISE VAISHALI\n                                         -----------\n<\/pre>\n<p>3.   7.9.2010               Heard learned counsel for the petitioner<\/p>\n<p>                 and the State.\n<\/p>\n<p>                            When the juniors of the petitioner were<\/p>\n<p>                 promoted as Sub-Inspector (Excise) on 30.6.1994, he<\/p>\n<p>                 came to this Court in C.W.J.C. No. 9294 of 2003.<\/p>\n<p>                 This Court permitted him to represent.    Officiating<\/p>\n<p>                 promotion was then granted on 29.10.2003 with<\/p>\n<p>                 effect from 30.6.1994, for the reason that he had not<\/p>\n<p>                 cleared the departmental examination. He was not<\/p>\n<p>                 considered for regular promotion when he crossed<\/p>\n<p>                 the age bar of 50 years for promotion prescribed<\/p>\n<p>                 under the Rules.   On 6.7.2009 he represented for<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>           exemption    for       promotion   from   passing   the<\/p>\n<p>           departmental examination on ground of having<\/p>\n<p>           crossed 50 years age which has been rejected on<\/p>\n<p>           2.9.2009.\n<\/p>\n<p>                       By consent of the parties, this application<\/p>\n<p>           is disposed off in similar terms as reported in<\/p>\n<p>           2006(2) PLJR 199, affirmed in L.P.A. and by the<\/p>\n<p>           Supreme Court.\n<\/p>\n<p>                       However, in the peculiar facts of the<\/p>\n<p>           present case, it is clarified that the petitioner shall<\/p>\n<p>           become eligible to be considered for promotion after<\/p>\n<p>           exemption     from       passing    the   departmental<\/p>\n<p>           examination only from the date that he crosses the<\/p>\n<p>           age of 50 years.\n<\/p>\n<p>                       The writ application stands disposed.<\/p>\n<pre>P.
