Justice M.SASIDHARAN NAMBIAR\n\n Dated :12\/03\/2010\n\n O R D E R\n               M.Sasidharan Nambiar, J.\n              --------------------------\n                Crl.M.C.No.642 of 2010\n              --------------------------\n\n                         ORDER\n<\/pre>\n<p>    Petitioners are the accused and respondents 2 and<\/p>\n<p>3, the defacto complainants and the injured in C.C.<\/p>\n<p>No.913\/2003  on  the  file  of  Judicial  First   Class<\/p>\n<p>Magistrate&#8217;s Court, Thiruvalla, taken cognizance for<\/p>\n<p>the offences under Sections 143, 147, 148, 452, 324 and<\/p>\n<p>427  read  with  Section  149  of  Indian  Penal  Code.<\/p>\n<p>Prosecution case is that on 6.6.2003 at about 7.45<\/p>\n<p>p.m.,   the ten accused formed themselves into an<\/p>\n<p>unlawful assembly with the common object of trespassing<\/p>\n<p>into the house of respondents 2 and 3 and to cause hurt<\/p>\n<p>to the second respondent due to the enmity that son of<\/p>\n<p>the second respondent had shifted the allegiance from<\/p>\n<p>DYFI  and  in   furtherance  of   the  common   object,<\/p>\n<p>trespassed into the house and abused first respondent<\/p>\n<p>and inflicted injury on her and when third respondent,<\/p>\n<p>the daughter, intervened, she was pushed, causing her<\/p>\n<p>to fall down and petitioners also caused damages to the<\/p>\n<p>tune of Rs.25,000\/- by breaking the electric bulbs and<\/p>\n<p>glasses of the windows and doors and thereby, all the<\/p>\n<p><span class=\"hidden_text\">CRMC 642\/10                 2<\/span><\/p>\n<p>accused committed the offences. This petition is filed<\/p>\n<p>under Section 482 of Code of Criminal Procedure to<\/p>\n<p>quash  the   cognizance taken   contending  that  entire<\/p>\n<p>disputes   with   the  petitioners   were   settled   by<\/p>\n<p>respondents  2  and   3 and  they   have  no  subsisting<\/p>\n<p>grievance against the petitioners and in view of the<\/p>\n<p>settlement, it is not in the interest of justice to<\/p>\n<p>continue the prosecution.\n<\/p>\n<p>    2. Respondents 2 and 3 appeared through a counsel<\/p>\n<p>and filed separate affidavits stating that they have<\/p>\n<p>settled all the disputes with the petitioners and they<\/p>\n<p>are not interested in prosecuting the case further, as<\/p>\n<p>they   have   no   subsisting  grievance   against   the<\/p>\n<p>petitioners and they have no objection for quashing the<\/p>\n<p>proceedings.\n<\/p>\n<p>    3.    Learned  Public   Prosecutor  submitted   that<\/p>\n<p>statement   of   the   second   respondent   was   taken<\/p>\n<p>subsequently and the statement also discloses that<\/p>\n<p>there was settlement.\n<\/p>\n<p>    4. Learned counsel appearing for the petitioners,<\/p>\n<p>respondents 2 and 3 and learned Public prosecutor were<\/p>\n<p>heard.\n<\/p>\n<p><span class=\"hidden_text\">CRMC 642\/10                3<\/span><\/p>\n<p>     5.   Affidavits filed  by  respondents  2  and   3<\/p>\n<p>establish that there was complete settlement of the<\/p>\n<p>disputes with the petitioners. As held by the Apex<\/p>\n<p>Court in <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of Punjab<\/a> (2008 (3)<\/p>\n<p>KLT 19), when the offences alleged are purely personal<\/p>\n<p>in   nature  and  it is  established  that  there   was<\/p>\n<p>settlement of all the disputes and consequent to the<\/p>\n<p>settlement, there is no likelihood of a successful<\/p>\n<p>prosecution, it is not in the interest of justice to<\/p>\n<p>continue the prosecution. As it is established that<\/p>\n<p>there has been a complete settlement of the disputes,<\/p>\n<p>it is not in the interest of justice to continue the<\/p>\n<p>prosecution.\n<\/p>\n<p>     Petition is allowed.
