LTD. - Petitioner(s)\n \n\nVersus\n \n\nKANTILAL\nB PATEL C\/O.BARODA LABOUR UNION, 407 - Respondent(s)\n \n\n=========================================\n \nAppearance : \nMR\nHASMUKH THAKKER for\nPetitioner(s) : 1,MR PALAK H THAKKAR for Petitioner(s) : 1, \nRULE\nSERVED for Respondent(s) : 1, \nMR TR MISHRA for Respondent(s) :\n1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 12\/07\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tThe<br \/>\npetitioner has challenged the judgement and award dated 11th<br \/>\nJanuary 2007 passed by the Labour Court No.2, Bharuch in Reference<br \/>\n(LCB) No.42 of 2000 whereby the petitioner was directed to reinstate<br \/>\nthe respondent on his original post with continuity of service and<br \/>\nwith 50% back wages along with costs of Rs.701\/-.\n<\/p>\n<p>2.\tAccording<br \/>\nto the respondent workman, he was working as work-shop incharge with<br \/>\nthe petitioner from 17.9.1998 on a monthly salary of Rs.8500\/- and he<br \/>\nhad to do various jobs also. It was alleged that the petitioner<br \/>\nterminated his services from 1.3.1999 without any notice, notice pay<br \/>\nor payment of retrench compensation. He therefore raised an<br \/>\nindustrial dispute which culminated into Reference (LCB) No.42\/2000<br \/>\nand the Labour Court passed the judgement and award as stated<br \/>\nhereinabove.\n<\/p>\n<p>3.\tLearned<br \/>\nAdvocate for the petitioner has submitted that the  respondent<br \/>\nworkman has already been reinstated in service and he has also<br \/>\nattained the age of superannuation. Therefore the main question is<br \/>\nwith regard to the back wages.\n<\/p>\n<p>4.\tIt<br \/>\nis required to be noted that in the application filed on 25th<br \/>\nFebruary 2004 the petitioner has offered the respondent to reinstate<br \/>\nhim on service. However, this offer was rejected by the workman. This<br \/>\nshows that the respondent workman was not interested in getting the<br \/>\njob, but he was interested only in back wages. In such circumstances,<br \/>\nI am of the view that  grant of back wages was not justified on the<br \/>\npart of the Labour Court.  In any case, it is by now well settled law<br \/>\nthat when a person has not worked on the post, usually back wages<br \/>\nshould not be granted.\n<\/p>\n<p>5.\tIn<br \/>\nthe premises aforesaid, the judgement and order of the Labour Court<br \/>\nqua back wages is quashed and set aside. The rest of the award is<br \/>\nconfirmed. The retirement dues pursuant to this order will be paid to<br \/>\nto the workman within a period of six weeks, if not paid so far.
