The Resolution made it clear that<\/p>\n<p>                  the College will be an independent Unit and<\/p>\n<p>                  not a part of Patna Medical College and the<\/p>\n<p>                  senior most Physiotherapist and Occupational<\/p>\n<p>                  Therapist            working           in      the      respective<\/p>\n<p>                  Departments          of    Patna        Medical      College    were<\/p>\n<p>                  made    Drawing        and       Disbursing         Authority    and<\/p>\n<p>                  Controlling Officer. The Principal of Patna<\/p>\n<p>                  Medical        College           was     also       made     overall<\/p>\n<p>                  Controlling Officer of the College. It was<\/p>\n<p>                  also     stipulated          in         the    Resolution       that<\/p>\n<p>                  appointment on teaching posts in the College<\/p>\n<p>                  would     be        made    as    per       the     procedure   for<\/p>\n<p>                  appointment           on    teaching          post    in     Medical<\/p>\n<p>                  Colleges.\n<\/p>\n<p>                          Petitioners were working as teachers in<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>the School before its upgradation and, with<\/p>\n<p>its      upgradation               into        College       and        its<\/p>\n<p>affiliation, petitioners continued to impart<\/p>\n<p>teaching           in        the         College       also.          Now,<\/p>\n<p>petitioners             claim        that       they      should         be<\/p>\n<p>regularized             as    regular          teachers       in        the<\/p>\n<p>College.       They          also     claim        that    since        the<\/p>\n<p>teachers of this College have been equated<\/p>\n<p>with the teachers of Medical Colleges, they<\/p>\n<p>are also entitled for enhancement of                                  their<\/p>\n<p>age of retirement from 60 years to 62 years<\/p>\n<p>which     has       been          done    in       respect     of       the<\/p>\n<p>teachers of Medical Colleges.\n<\/p>\n<p>        In    respect         of     petitioner        no.1,       it    is<\/p>\n<p>submitted          that      he     was       functioning        in     the<\/p>\n<p>College       on        deputation.           Therefore,         service<\/p>\n<p>conditions of his parent department and                                  as<\/p>\n<p>applicable          to       his     substantive          post      shall<\/p>\n<p>govern       his    services.            In    that    view      of     the<\/p>\n<p>matter, petitioner no.1 ought to have been<\/p>\n<p>allowed        to         continue            in      service         upto<\/p>\n<p>completion          of       62     years      of     age.    However,<\/p>\n<p>treating him as a teacher of the College, he<\/p>\n<p>has been made to superannuate on completion<\/p>\n<p>of 60 years of age. Thus, it is submitted<\/p>\n<p>that the respondents are blowing hot and cold<br \/>\n<span class=\"hidden_text\">                            3<\/span><\/p>\n<p>           in respect of the petitioners, inasmuch as on<\/p>\n<p>           the   one     hand,           they    are     treating       the<\/p>\n<p>           petitioners        as     regular       teachers       of   the<\/p>\n<p>           College, whereas on the other, they have not<\/p>\n<p>           regularized the services of the petitioners<\/p>\n<p>           as regular teachers of the College.<\/p>\n<p>                 Counter       affidavit        filed    in     this   case<\/p>\n<p>           sworn by one Deputy Secretary of the Health<\/p>\n<p>           Department is deficient in pleadings in this<\/p>\n<p>           respect.\n<\/p>\n<p>                 Therefore,          this       Court     directs       the<\/p>\n<p>           Principal Secretary of the Health Department<\/p>\n<p>           to file an exhaustive affidavit in this case<\/p>\n<p>           dealing     with        the    issues       raised     by   the<\/p>\n<p>           petitioners in this writ application, noticed<\/p>\n<p>           as above in brief.\n<\/p>\n<p>                 Learned counsel for the State prays for<\/p>\n<p>           four weeks time for the purpose.<\/p>\n<p>                 Put up after four weeks within first ten<\/p>\n<p>           cases.\n<\/p>\n<\/p>\n<pre>Pradeep\/                            ( J.
