SIRI JAGAN, J.\n                 ------------------------------------\n                    W.P.(C)No.13915 OF 2008\n               ----------------------------------------\n                 Dated this the 22nd day of May, 2008\n\n                              JUDGMENT\n<\/pre>\n<p>     Petitioners 1 and 2 are the parents of persons, who died in<\/p>\n<p>an accident on account of collapse of a wall of the school<\/p>\n<p>belonging to the 6th respondent. Petitioners 3 to 5 are persons,<\/p>\n<p>who were injured in the same accident. They are seeking the<\/p>\n<p>following reliefs:\n<\/p>\n<blockquote><p>              &#8220;The Honourable High Court may be pleased to issue<br \/>\n        writ of Mandamus or such other or further appropriate<br \/>\n        Writ, Order directing<br \/>\n              (1)   the Respondents jointly and severally to pay<br \/>\n        compensation to the petitioners for the loss and injury<br \/>\n        suffered by their families by death and injury as the case is<br \/>\n        resultant of the Kuttamberur school wall collapse occurred<br \/>\n        on 27\/03\/2008 and<br \/>\n              (2)   to direct the respondents 2 &amp; 3 to take all<br \/>\n        necessary steps to assure safety and security of buildings<br \/>\n        and structures in all schools in Kerala State to prevent<br \/>\n        repetition of similar mishaps in future.&#8221;\n<\/p><\/blockquote>\n<p>Although the petitioners deserve sympathy, I am afraid that the<\/p>\n<p>question of liability for payment of damages cannot be decided in<\/p>\n<p>proceedings under Article 226 of the Constitution of India. The<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.13915\/08               2<\/span><\/p>\n<p>liability for payment of damages depends on negligence of the<\/p>\n<p>person concerned. For proving negligence, evidence has to be<\/p>\n<p>taken.     All these cannot be decided in proceedings under<\/p>\n<p>Article 226 of the Constitution of India. The remedy of the<\/p>\n<p>petitioners lies in filing a civil suit for damages.    Without<\/p>\n<p>prejudice to the right of the petitioners to file a suit for the<\/p>\n<p>same cause of action, this writ petition is dismissed.<\/p>\n<p>                                         S.
