Pathak, Advocate.\n      Respondent by Shri Meghnath Banerjee, Advocate.<\/pre>\n<p>      The    present     appeal   is   preferred   by   the<br \/>\nappellants\/claimants under Section 23 of the Railway<br \/>\nClaims Tribunal Act, 1987 challenging the judgment dated<br \/>\n9.5.03 passed by the Railway Claims Tribunal in Claim<br \/>\nCase No. O.A. No. 19\/2000 wherein the claim of the<br \/>\nappellants\/claimants has been rejected.\n<\/p>\n<p>      The facts leading to the present case are that<br \/>\ndeceased Bisahim Bai, wife of Heeralal Sahoo and mother<br \/>\nof Sewak Ram Sahoo died at Raigarh station as a result of<br \/>\nan untoward incident on 17.5.99 when she was trying to<br \/>\nboard 355 Up Jharsuguda-Gondia passenger train at about<br \/>\n9.00 am, she fell down as a result of which she received<br \/>\nsevere injuries and ultimately she expired. The claims<br \/>\nTribunal has rejected the application on the ground that<br \/>\nappellants\/claimants have failed to prove the valid railway<br \/>\nticket with the deceased. She was not treated to be a<br \/>\nbonafide passenger in the absence of any ticket and thus<br \/>\nthe claim is rejected.\n<\/p>\n<p>      On behalf of the appellants\/claimants, reliance is<br \/>\nplaced on &#8216;Naksha Panchayatnama&#8217; (Ex. A\/2) which was<br \/>\nproved before the tribunal which does not show that<br \/>\nsearch was taken of luggage and no ticket was found. So<br \/>\nfar as Naksha Panchayatnama (Inquest) dated 17.5.99 is<br \/>\nconcerned, in the same also, nothing has been stated by<br \/>\nthe police that no ticket was found with the deceased. In<br \/>\nthe present case, a report dated 1.4.2000, a document<br \/>\nfiled and not proved before the tribunal prepared by GRP<br \/>\n Thana, Raigarh only states that on search, no valid ticket<br \/>\nwas found with the deceased and on that basis, the claims<br \/>\ntribunal rejected the claim.\n<\/p>\n<p>      On the basis of the same,it is to be seen that when<br \/>\nimmediately the document i.e. Naksha Panchyatnama<br \/>\n(Inquest) was prepared on 17.5.99 it does not show that<br \/>\nsearch was taken of the luggage and no valid ticket was<br \/>\nfound. Similarly, the document Ex. A\/2 filed by the<br \/>\nRailway also does not show that no ticket was found.\n<\/p>\n<p>      In the present case, no witness has been examined<br \/>\nby the railway to prove that after when the search was<br \/>\ndone, no ticket was found with the deceased and the<br \/>\ndeceased was travelling in the train without there being<br \/>\nany valid ticket.\n<\/p>\n<p>      On the basis of the documents and on the basis of<br \/>\nthe discussion as aforesaid, I am of the view that the<br \/>\nRailway Administration failed to prove that deceased was<br \/>\ntravelling without there being any valid ticket. On the<br \/>\ncontrary,   the     statement   of   Sewak   Ram   who   has<br \/>\nspecifically stated that he purchased the ticket from<br \/>\nRajgarh and the same was handed over to the deceased<br \/>\nand then he left the station before arrival of the train. On<br \/>\nthe basis of the same, there was no material before the<br \/>\nclaims tribunal that the deceased was not having a valid<br \/>\nticket with her and the onus lies on the Railways that no<br \/>\nvalid ticket was purchased. The documents relied upon by<br \/>\nthe railways dated 17.5.99 does not show that after the<br \/>\nsearch of the luggage and also of the deceased, no ticket<br \/>\nwas found. Ultimately, the said fact is mentioned by the<br \/>\npolice in its report dated 1.4.2000 which has been<br \/>\nprepared near about 11 months after the date of accident<br \/>\nand thus no reliance can be placed on such documents.\n<\/p>\n<p>        In view of the aforesaid, I am of the view that the<br \/>\ntribunal was not justified in dismissing the claim and<br \/>\naccordingly, I am inclined to set aside the award passed<br \/>\nby    the   tribunal   and   further   directed    the   railway<br \/>\nadministration to pay compensation to the extent of Rs.4<br \/>\nlacs @ 6% in view of notification published in Gazette of<br \/>\nIndia (Extraordinary) Part II, Section 3(i) dated 7th June,<br \/>\n1990, from the date the application was preferred. The<br \/>\namount of compensation along with interest shall be paid<br \/>\nwithin a period of 60 days from today.\n<\/p>\n<p>       Appeal stands allowed.\n<\/p>\n<p>                                                  (R.K.
