No. 6192.11\n\n\n              Writ Petition No. 6192 of 2011\n18-04-2011\n      Shri Pradeep Batra, learned counsel for the\npetitioner.\n      Petitioner by way of this petition under Article\n226 of the Constitution of India seeks direction to the\nrespondents\/Collector, Harda and Chief Municipal<\/pre>\n<p>officer,   Nagar     Palika   Parishad,       Harda,     not       to<br \/>\ndispossess\/interfere     with     the   possession       of      the<br \/>\npetitioner over the land in question. The petitioner<br \/>\nalso claims compensation of Rs. 5,00,000\/- in lieu of<br \/>\nalleged    illegal   demolition    of   the    house      of     the<br \/>\npetitioner.\n<\/p>\n<p>      Petitioner claims her to be the legal heir of one<br \/>\nlate Thakur Guljar Singh, who was freedom fighter<br \/>\nand was in possession of land admeasuring 200 ft. x<br \/>\n200 ft. = 40,000 sq. ft. situated near Harda city<br \/>\nveterinary hospital in Ward No. 17, Harda, whereon<br \/>\ncertain construction was raised by him and was<br \/>\nnamed as Guljar Bhawan.\n<\/p>\n<p>      It is the contention of the petitioner that she is<br \/>\nresiding along with her family in the constructed<br \/>\nbuilding since last 50 years and after the death of late<br \/>\nThakur Guljar Singh her husband prior to his death,<br \/>\nhad applied for mutation over the said property,<br \/>\n                                                       W.P. No. 6192.11<\/p>\n<p>which otherwise stood in the name of Thakur Guljar<br \/>\nSingh.\n<\/p>\n<p>     It is contended that the respondent\/Nagar Palika<br \/>\nParishad, Harda in arbitrary exercise of power<br \/>\ndemolished the entire Guljar Bhawan under the<br \/>\npretext that the same was unauthorizedly constructed<br \/>\nover Municipal land. It is in the background of these<br \/>\nfacts,   the   petitioner   seeks        direction    for     non-<br \/>\ninterference     on   the    land   in     question     and        a<br \/>\ncompensation in lieu of alleged demolition.\n<\/p>\n<p>     Though the petitioner claims herself to be the<br \/>\nlegal heir of late Thakur Guljar Singh as also owner of<br \/>\nthe land in question; however, no cogent material is<br \/>\nbrought on record to establish the said facts. On the<br \/>\ncontrary, representation preferred by late husband of<br \/>\nthe petitioner brought on record as Annexure-P\/4<br \/>\nindicates that late Guljar Singh was not married and<br \/>\nthe petitioner happens to be the wife of nephew of<br \/>\nlate Guljar Singh. No document is also brought on<br \/>\nrecord indicating therein the right, title or interest of<br \/>\nsaid Guljar Singh over the land in question.\n<\/p>\n<p>     In    a   petition     under   Article    226      of      the<br \/>\nConstitution of India it is incumbent upon the<br \/>\npetitioner to establish his\/her legal right, in absence<br \/>\nwhereof no mandamus can be issued. Therefore,<br \/>\n                                                W.P. No. 6192.11<\/p>\n<p>present   petition   cannot    be   entertained.
