\n\tway of this petition the petitioner has prayed for a  direction to
\n\tdeclare that the petitioner is eligible and entitled to get
\n\tappointment on compassionate ground and further  to direct the
\n\trespondent no.1 to consider the case of  the petitioner on merits
\n\twithout raising any technical point and give appointment to the
\n\tpetitioner..\n<\/p>\n
\t\tThe
\n\tbrief facts of the case are as under:-\n<\/p>\n

\n\t\tThe father of the petitioner was working in respondent no.2 school
\n\tas a Principal and died on 18.12.2000 during course of employment.
\n\tThe petitioner had applied for the compassionate appointment on
\n\t13.2.2001, but the said application came to be turned down by the
\n\trespondents on the ground that the petitioner was minor.\n<\/p>\n

\n\t\tAfter attaining the age of majority the petitioner had applied for
\n\tthe appointment as peon on compassionate ground. The petitioner
\n\tthereafter moveed to the grievance reddressal programme of Chief
\n\tMinister vide letter dated 28.8.2007. The respondent no. 3 has
\n\tinformed the petitioner vide letter dated 7.9.2007 that his proposal
\n\tis pending for consideration.\n<\/p>\n

\n\t On 22.7.2008 under the Right to Information Act, the petitioner
\n\tcame to know from the respondent no.4 that his proposal for
\n\tcompassionate appointment was turned down by respondent no.1 on
\n\t8.2.2005.\n<\/p>\n

\n\t\tBeing aggrieved by the said order, the petitioner approached  the
\n\tGujarat Secondary Education Tribunal by way of application bearing
\n\tno. 160 of 2008. Ld. Tribunal after hearing both the parties
\n\tdirected the respondents to reconsider the case of the petitioner
\n\tfor compassionate appointment within period of three months.\n<\/p>\n

\n\t\tSince there was no response from the respondents, the petitioner
\n\tissued notice on 28.4.2009. The said notice was replied by the
\n\trespondent vide letter dated 30.5.2009 stating that the in view of
\n\tG.R. dated 10.3.2000, the case of the petitioner cannot be reviewed
\n\tand therefore the application of the petitioner came to be rejected.\n<\/p>\n

\n\t\tBeing aggrieved by the said reply the petitioner has  preferred
\n\tExecution Application no. 13 of 2009 before the ld. Tribunal and the
\n\tsaid application  came to be disposed of  holding that the
\n\trespondent no.1 is State and Tribunal has no jurisdiction against
\n\tdecision taken by the State. Hence this petition.\n<\/p>\n
\tThe issue involved in this petition is squarely covered by the
\n\tdecision of the Apex Court in the case of State Bank of India and
\n\tAnr. V\/s. Somvir Singh  reported in (2007)4 SCC 788 wherein the
\n\tApex Court has observed as under :-\n<\/p>\n
\t7.
\n\t\tArticle 16(1) of the Constitution of India guarantees to all its
\n\tcitizens equality of opportunity in matters relating to employment
\n\tor appointment to any office under the State. Article 16(2) protects
\n\tcitizens against discrimination in respect of any employment or
\n\toffice under the State  on grounds only of religion, race, caste,
\n\tsex and descent. It is not so well settled and needs no restatement
\n\tat our end that appointment on compassionate grounds is an exception
\n\tcarved out to the general rule that recruitment to public services
\n\tis to be made in a transparent and accountable manner providing
\n\topportunity to all eligible persons to compete and participate in
\n\tthe selection process. Such appointment are required to be made on
\n\tthe basis of open invitation of application and merit. Departments
\n\tof employees died in harness do not have any special or additional
\n\tclaim to public services other than the one conferred, if any, by
\n\tthe employer.\n<\/p>\n

\n\t\tIn Union Bank of India V\/s. M.T. Latheesh this Court while dealing
\n\twith the similar question observed that indiscriminate grant of
\n\temployment on compassionate grounds would shut the door for
\n\temployment to the ever-growing population of unemployed youth.\n<\/p>\n
\t13.
\n\t\tIn our considered opinion, the High Court itself could not have
\n\tundertaken any exercise to decide as to what would be the reasonable
\n\tincome which would be sufficient for the family for its survival and
\n\twhether it had been left in penury or without any means of
\n\tlivelihood. The only question the High Court  could have adverted
\n\titself to is whether the decision-making process rejecting the claim
\n\tof the respondent for compassionate appointment is vitiated ?
\n\tWhether the order is not in conformity with the scheme framed by the
\n\tappellant Bank ? It is not even urged that the order passed by the
\n\tcompetent authority  is not in accordance with the scheme. It is
\n\twell settled that the hardship of the dependents does not entitle
\n\tone to compassionate appointment dehors the scheme or the statutory
\n\tprovisions as the case may e. the income of the family from all
\n\tsources is required to be taken into consideration according to the
\n\tscheme which the High Court altogether ignored while remitting the
\n\tmatter for fresh consideration by the appellant Bank.  It is not  a
\n\tcase where the dependents of the deceased employee are left  without
\n\tany means of  livelihood  and unable to make both ends meet. The
\n\tHigh Court ought not to have disturbed the finding and the
\n\tconclusion arrived at the appellant Bank that the respondent was not
\n\tliving hand-to-mouth. As observed by this Court in G.M. (D&PB)
\n\tv. Kunti Tiwary the High Court cannot dilute the criteria of penury
\n\tto one of  not very well-to-do  . The  view taken by the
\n\tDivision Bench of the High Court may amount to varying the existing
\n\tscheme framed by the appellant Bank. Such a course is impermissible
\n\tin law.\n<\/p>\n
\t\tFurther
\n\tin  the case of Santosh Kumar Dubey V\/s. State
\n\tof U.P. And Others reported in (2009)6 Supreme Court Cases 481,the
\n\tApex Court has observed has observed as under :-\n<\/p>\n
\t11.
\n\t\tThe very concept of giving a compassionate appointment is to tide
\n\tover the financial difficulties that are faced by the family of the
\n\tdeceased due to the death  of the earning member of the family.
\n\tThere is immediate loss of earning for which the family suffers
\n\tfinancial hardship. The benefit is given so that the family can tide
\n\tover such financial constrains.\n<\/p>\n
\t12.
\n\t\t The request for appointment  on compassionate grounds should be
\n\treasonable and proximate to the time of the death of the bread
\n\tearner of the family, inasmuch as the very purpose of giving such
\n\tbenefit is to make financial help available to the family to
\n\tovercome sudden economic crisis occurring in the family of the
\n\tdeceased who has died in harness. But  this, however, cannot be
\n\tanother source of recruitment. This also cannot be treated as a
\n\tbonanza and also as a right to get an appointment in government
\n\tservice.\n<\/p>\n
\t\t On
\n\tthe facts of the case I am of the view that when the family is
\n\tsurvived for a decade without compassionate appointment there is no
\n\tneed of any compassionate appointment. Further in view of the above
\n\tdecisions I do not find any merits in this petition. The petition is
\n\ttherefore dismissed.\n<\/p>\n
