THE BLOCK SUPPLY OFFICER, BANDARA,\n                        MUZAFFARPUR.\n                                         -----------\n<\/pre>\n<p>2   23.06.2011.             Heard learned counsel for the parties.<\/p>\n<p>                            The petitioner prays for quashing of the order<\/p>\n<p>                    dated 25.8.2010, Annexure      5, passed by the      Sub<\/p>\n<p>                    Divisional Officer, East Muzaffarpur canceling        his<\/p>\n<p>                    Licence No. 3 of 1988.\n<\/p>\n<p>                            The petitioner    is a dealer under the Public<\/p>\n<p>                    Distribution System. He was granted retail licence for<\/p>\n<p>                    food grains like Sugar, K.Oil etc vide Licence no. 3 of<\/p>\n<p>                    1988 under the provision of Bihar        Trade Articles<\/p>\n<p>                    Licence Unification) Order, 1984.         In course of<\/p>\n<p>                    inspection on 29.2.2008 the enquiring officer reported<\/p>\n<p>                    certain irregularities. On 6.3.2008 show cause     notice<\/p>\n<p>                    was served on the petitioner. On 13.3.2008 the petitioner<\/p>\n<p>                    filed show cause denying the allegations. On 16.4.2008<\/p>\n<p>                    the licence of the petitioner was suspended and was<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>asked to show cause as to why his licence be not<\/p>\n<p>cancelled. The petitioner filed show cause on 2.5.2008.<\/p>\n<p>by the impugned order dated 25.8.2010 licence of the<\/p>\n<p>petitioner has been cancelled.\n<\/p>\n<p>        Learned counsel submits that once licence has<\/p>\n<p>been   suspended by way of punishment,          no further<\/p>\n<p>punishment in terms of cancellation of licence can be<\/p>\n<p>inflicted in view of the decision of this Court rendered in<\/p>\n<p>case of Md Idris Alam Vs. State of Bihar and others,<\/p>\n<p>reported in 2010(4) PLJR 45. He submits that Public<\/p>\n<p>Distribution System (Control) Order, 2001 substitutes<\/p>\n<p>Bihar Trade Articles (Licenses Unification) Order, 1984.<\/p>\n<p>        Counsel for the State submits that the very<\/p>\n<p>PDS (Control) Order, 2001 on which the petitioner is<\/p>\n<p>relying provides remedy of appeal. He also submits that<\/p>\n<p>suspension order was interim in nature pending<\/p>\n<p>proceeding for cancellation of licence.<\/p>\n<p>        I have heard the petitioner and the State.<\/p>\n<p>        Sub-clause (7) of Clause 11          of the PDS<\/p>\n<p>(Control) Order, 2001 provides for an appeal. As such, I<\/p>\n<p>do not want to go into the merits of the rival claims<\/p>\n<p>made by the parties. The petitioner should approach the<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>         appellate forum for redressal of his grievance.<\/p>\n<p>                  As the petitioner was pursuing       his remedy<\/p>\n<p>         before this court, the learned Appellate authority would<\/p>\n<p>         sympathetically consider his application for condonation<\/p>\n<p>         of delay in filing the appeal.\n<\/p>\n<p>                  The writ petition is disposed of sympathetically.<\/p>\n<pre>Shashi                          ( S.P.
