M. SAHAI)<\/p>\n<p>We<\/a><br \/>\n\thave heard learned counsel Mr. Anshin H. Desai for the petitioner<br \/>\n\tand Ms. Jirga Jhaveri, learned Assistant Government Pleader for the<br \/>\n\trespondents.\n<\/p>\n<p>This<br \/>\n\tpetition has been filed praying that election scheduled to be held<br \/>\n\ttomorrow i.e. 08.07.2011 may not be held or in the alternative 557<br \/>\n\tpersons who have been illegally granted Traders License be<br \/>\n\trestrained from casting their votes from the traders constituency in<br \/>\n\tthe election of Junagadh Agricultural Produce Market Committee.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the petitioner has vehemently urged that these 557<br \/>\n\tpersons have been illegally granted Traders Licenses just to<br \/>\n\tmaterially affect the election. This list of 557 Traders who have<br \/>\n\tbeen granted Traders Licenses according to the petitioner was known<br \/>\n\tto the other persons on 16.06.2011, but the petitioner came to know<br \/>\n\tabout this fact only on 05.07.2011.\n<\/p>\n<p>A<br \/>\n\tFull Bench of this Court in <a href=\"\/doc\/587628\/\">Dehgam Group Seva Sahakari Mandli<br \/>\n\tLimited v. R. D. Rohit, Authorized Officer and Co-operative Officer<br \/>\n\t(Marketing),<\/a> 2006 (1) GCD 211 (Guj.) (FB) has held that a person<br \/>\n\twho has not been permitted to cast vote or if illegal voters have<br \/>\n\tbeen permitted to cast vote, in both the situations, remedy lies in<br \/>\n\tfiling election petition under Rule 28 of the Gujarat Agricultural<br \/>\n\tProduce Marketing Rules, 1965.\n<\/p>\n<p>Since<br \/>\n\tthe petitioner has an adequate alternative remedy of filing an<br \/>\n\telection petition, we are not inclined to interfere with the process<br \/>\n\tof election.
