The<br \/>\nappellant then appealed to the First Appellate Authority on 7.6.07 whereupon<br \/>\nAppellate Authority held that as the accused is facing trial as stated above, the<br \/>\ninformation sought would impede the process of prosecution. The Appellate<br \/>\nAuthority also supported the order of PIO and upheld applicability of sec. 8(1)(h)<br \/>\nin the present case as below.\n<\/p>\n<blockquote><p>         &#8220;I have carefully examined the plea of the appellant. He is<br \/>\n         admittedly an accused and facing trial in the above stated criminal<br \/>\n         case and as such, the information sought would impede the<br \/>\n         process of his prosecution. The SP \/ CPIO, CBI, ACB, Delhi has,<br \/>\n         therefore, correctly invoked the exemption u\/s 8(1)(h) of the RTI<br \/>\n         Act, 2005. Accordingly, I find no grounds to interfere with the order<br \/>\n         of CPIO \/ SP, CBI, ACD, Delhi passed in the instant matter.&#8221;<\/p><\/blockquote>\n<p>     Being dissatisfied by the order passed by PIO and Appellate Authority, the<br \/>\nappellant has moved his second appeal before us and also referred to the<br \/>\njudgment of Hon&#8217;ble High Court of Madras in AIR 1952 Mad. 276 wherein an<br \/>\norder where a section is repeated as an order shall be justified giving valid<br \/>\nreason. Moreover, he has also referred to appeal No. CIC\/OK\/A\/2006\/00045<br \/>\ndecided on 8.9.06 in which CIC has held that it was not enough to indicate the<\/p>\n<p><span class=\"hidden_text\">                                                1<\/span><br \/>\n clause, but sufficient reasons for refusing the information under these sections<br \/>\nshould also be indicated. Appellant has therefore requested us to\n<\/p>\n<p>       (a)    allow this appeal,\n<\/p>\n<p>       (b)    set aside the impugned order\/letter bearing No. 8497\/RTI-41\/2007-\n<\/p>\n<blockquote><p>              DLI dated 9.6.2007 where the Appellate Authority has upheld what<br \/>\n              he   believes    is   the   otherwise    illegal   order   bearing   No.<br \/>\n              RTI\/CPIO\/41\/2007-DLI-6357 dated 10.5.07 of the CPIO\n<\/p><\/blockquote>\n<blockquote><p>       (c)    consequently direct the respondent \/ CPIO to provide the copies<br \/>\n              FR-1 &amp; FR-II in R.C. No. 42(A)\/98 to appellant.&#8221;\n<\/p><\/blockquote>\n<p>The appeal was heard on 29.12.2008. The following are present:<br \/>\nAppellant<br \/>\n              Sh. Vinod Kumar<br \/>\n              Sh. Bhavook Chauhan, Representative for Appellant.<br \/>\nRespondent<br \/>\n              Sh. Vineet Agarwal, SP, CBI<\/p>\n<p>                                DECISION NOTICE<\/p>\n<p>      In this case the judgment of the Delhi High Court in W.P.(C)<br \/>\nNo.3114\/2007 &#8211; Shri Bhagat Singh Vs. Chief Information Commissioner &amp;<br \/>\nOrs is of direct relevance, since it deals with the application of sec. 8(1)(h):\n<\/p>\n<blockquote><p>       11. &#8220;The Universal Declaration of Human Rights, adopted by the<br \/>\n       United Nations in 1948, assured by Article 19, everyone the right<br \/>\n       &#8220;to seek, receive and impart information and ideas through any<br \/>\n       media, regardless of frontiers&#8221;. <a href=\"\/doc\/539407\/\">In Secretary Ministry of Information<br \/>\n       and Broadcasting, Govt. of India and others vs. Cricket Association<br \/>\n       of Bengal and others<\/a> (1995 (2) SCC 161) the Supreme Court<br \/>\n       remarked about this right in the following terms:\n<\/p><\/blockquote>\n<blockquote><p>             &#8220;The right to freedom of speech and expression includes the<br \/>\n             right to receive and impart information. For ensuring the free<br \/>\n             speech right of the citizens of this country, it is necessary<br \/>\n             that the citizens have the benefit of plurality of views and a<br \/>\n             range of opinions on all public issues. A successful<br \/>\n             democracy posits an &#8220;aware&#8221; citizenry. Diversity of opinions,<br \/>\n             views, ideas and ideologies         is essential to enable the<br \/>\n             citizen to arrive at informed judgment on all issues touching<br \/>\n             them.&#8221;\n<\/p><\/blockquote>\n<\/blockquote>\n<p><span class=\"hidden_text\">                                          2<\/span><\/p>\n<blockquote><p>    This right to information, was explicitly held to be our fundamental<br \/>\n   right under Article 19(1)(a) of the Constitution of India for the first<br \/>\n   time by Justice K.K. Mathew in the <a href=\"\/doc\/438670\/\">State of U.P. vs. Raj Narain,<\/a><br \/>\n   (1975) (4) SCC 428. This view was followed by the Supreme Court<br \/>\n   on a number of decisions and after public demand, the Right to<br \/>\n   Information Act, 2005 was enacted and brought into force.\n<\/p><\/blockquote>\n<p>12.The Act is an effectuation of the right to freedom of speech and<br \/>\nexpression. In an increasingly knowledge based society, information<br \/>\nand access to information holds the key to resources, benefits, and<br \/>\ndistribution of power. Information, more than any other element, is of<br \/>\ncritical importance participatory democracy. By one fell stroke, under<br \/>\nthe Act, the make of procedures and official barriers that had<br \/>\npreviously impeded information, has been swept aside. The citizen and<br \/>\ninformation seekers have, subject to a few exceptions, an overriding<br \/>\nright to be given information on matters in the possession of the state<br \/>\nand public agencies that are covered by the Act. As is reflected in its<br \/>\npreambular paragraphs, the enactment seeks to promote<br \/>\ntransparency, arrest corruption and to hold the government and its<br \/>\ninstrumentalities accountable to the governed. This spirit of the Act<br \/>\nmust be borne in mind while construing the provisions contained<br \/>\ntherein.\n<\/p>\n<p>13. Access to information under Section 3 of the Act is the rule and<br \/>\nexemptions under Section 8, the exception. Section 8 being a<br \/>\nrestriction on this fundamental right must therefore be strictly<br \/>\nconstrued. It should not be interpreted in manner as to shadow the<br \/>\nvery right self. Under Section 8,exemption from releasing information<br \/>\nis granted if it would impede the process of investigation process<br \/>\ncannot be a ground for refusal of the information, the authority<br \/>\nwithholding information must show satisfactory reasons as to why the<br \/>\nrelease of such information would hamper the investigation process.<br \/>\nSuch reasons should be germane, and the opinion of the process<br \/>\nbeing hampered should be reasonable and based on some material,<br \/>\nsans this consideration, Section 8(1)(h) and other such provisions<br \/>\nwould become the haven for dodging demands for information.\n<\/p>\n<p> 14. A rights based enactment is akin to a welfare measure, like the<br \/>\nAct, should receive a liberal interpretation. The contextual background<br \/>\nand history of the Act is such that the exemptions, outlined in Section<br \/>\n8, relieving the authorities from the obligation to provide information,<br \/>\nconstitute restrictions on the exercise of the rights provided by it.<br \/>\nTherefore, such exemption provisions have to be construed in their<br \/>\nterms, there is some authority supporting this view <a href=\"\/doc\/641119\/\">(See Nathi Devi vs.<br \/>\nRadha Devi Gupta<\/a> 2005(2) SCC201; <a href=\"\/doc\/499867\/\">B. R. Kapoor vs. State of Tamil<br \/>\nNadu<\/a> 2001 (7) SCC 231 and <a href=\"\/doc\/485394\/\">V. Tulasamma vs. Sesha Reddy<\/a> 1977(3)<\/p>\n<p><span class=\"hidden_text\">                                     3<\/span><br \/>\n       SCC 99). Adopting a different approach would result in narrowing the<br \/>\n      rights and approving a judicially mandated class of restrictions on the<br \/>\n      rights under the Act, which is unwarranted.&#8221;\n<\/p>\n<p>            In this case the Court took serious notice of the two-year delay in<br \/>\nreleasing of information and the lack of adequate reasoning of the orders of PIO<br \/>\nand appellate authority. S Ravinder Bhat J specifically notes, &#8220;As held in the<br \/>\npreceding part of the judgment, without a disclosure as to how the investigation<br \/>\nprocess would be hampered by sharing the materials collected till the notices<br \/>\nwere issued to the assessee, the respondents could not have rejected the<br \/>\nrequest for granting information. The CIC, even after overruling the objection,<br \/>\nshould not have imposed the condition that information could be disclosed only<br \/>\nafter recovery was made 1 &#8221;\n<\/p>\n<p>          In light of the above decision, which has a direct bearing on the present<br \/>\ncase dealing as it does with application of Sec 18 (1) sub-section (h), the<br \/>\ndecision of First Appellate Authority Shri R. S. Bhatti, DIG, ACB, CBI is set aside.<br \/>\nThe case is remanded to CPIO Shri Vineet Agarwal, SP, CBI who will re-<br \/>\nexamine it in light of the above decision of the Delhi High Court and give a<br \/>\nruling in the matter within ten working days of the date of issue of this<br \/>\nDecision Notice. . If not satisfied with the information so provided, appellant Shri<br \/>\n                                              nd<br \/>\nVinod Kumar will be free to move a fresh 2 appeal before us as per Sec 19 (3)<\/p>\n<p>         Announced in the hearing.
