Justice V.GIRI\n\n Dated :23\/06\/2009\n\n O R D E R\n                        V.GIRI, J\n                      -------------------\n                   W.P.(C).17348\/2009\n                      --------------------\n         Dated this the 23rd day of June, 2009\n\n                      JUDGMENT\n<\/pre>\n<p>     The vehicle bearing registration No.KL-7Q-3978,<\/p>\n<p>belonging to petitioner was              allegedly seized for<\/p>\n<p>infraction of the provisions of the Kerala Protection of<\/p>\n<p>River Banks (Protection and Regulation of removal of<\/p>\n<p>sand) Act, 2002.      He has approached the District<\/p>\n<p>Collector, the 1st respondent for release of the vehicle<\/p>\n<p>and is aggrieved by the          non-consideration     of the<\/p>\n<p>request.\n<\/p>\n<\/p>\n<p>2.    The nature of the power exercised by the District<\/p>\n<p>Collector and the para meters within which such power<\/p>\n<p>is to be exercised have been dealt with by a Bench of<\/p>\n<p>this Court in Sanjayan Vs.Tahasildar              [2007 (4)<\/p>\n<p>KLT 597].        Principles have been reiterated in<\/p>\n<p>Subramanian Vs. State of Kerala [2009 (1) KLT<\/p>\n<p>77).\n<\/p>\n<\/p>\n<p>3.     In Subramanian&#8217;s case, this Court observed<\/p>\n<p>W.P.(C).17348\/09<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>that the power exercised by the District Collector is<\/p>\n<p>under Section 23 of the Kerala Protection of River<\/p>\n<p>Banks (Protection and Regulation of removal of sand)<\/p>\n<p>Act, 2002.      It is also, therefore, quasi judicial in<\/p>\n<p>character.     Reasons will have to be given by the<\/p>\n<p>District Collector while passing orders under Section<\/p>\n<p>23 of the Kerala Protection of River Banks (Protection<\/p>\n<p>and Regulation of removal of sand) Act, 2002 r\/w Rules<\/p>\n<p>27 and 28 of Kerala Protection of River Banks and<\/p>\n<p>Regulation of Removal of Sand Rules 2002. If there is<\/p>\n<p>a contention that      the transportation of sand was<\/p>\n<p>supported by a pass issued by the competent local<\/p>\n<p>authority, that has to be referred. The materials which<\/p>\n<p>are placed before       the District Collector  by the<\/p>\n<p>subordinate officials shall also be looked into.   This<\/p>\n<p>has been indicated in Subramanian&#8217;s case. If motion<\/p>\n<p>is made by the owners of the vehicle for release of the<\/p>\n<p>vehicle on interim custody, it will be subject to the<\/p>\n<p>conditions mentioned in paragraph 58 of the said<\/p>\n<p>judgment. The District Collector may pass orders on<\/p>\n<p>W.P.(C).17348\/09<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>such applications for interim custody. (The scope of<\/p>\n<p>the directions contained in Subramanian&#8217;s case have<\/p>\n<p>later been dealt with in <a href=\"\/doc\/925008\/\">Sareesh v.             District<\/p>\n<p>Collector<\/a>      (2009 (2)      KLT  906).    Appropriate<\/p>\n<p>clarifications have been issued in the latter judgment).<\/p>\n<p>Further conditions can be imposed in the course of<\/p>\n<p>release of the vehicle as indicated by this Court in<\/p>\n<p>Shoukathali Vs. Tahasildar [2009 (1) KLT 640].<\/p>\n<p>4.    Keeping in mind the observations made in the<\/p>\n<p>judgments in Shoukathali&#8217;s case and Subramanian&#8217;s<\/p>\n<p>case and other judgment which have been referred to,<\/p>\n<p>the 1st respondent shall pass final orders in the matter<\/p>\n<p>of confiscation\/release of the vehicle in question after<\/p>\n<p>conducting an appropriate enquiry as early as<\/p>\n<p>possible, at any rate within three months from the date<\/p>\n<p>of receipt of a copy of this judgment.<\/p>\n<p>5.    In the meanwhile, if motion      is made by the<\/p>\n<p>petitioner for interim custody of the vehicle, then<\/p>\n<p>W.P.(C).17348\/09<br \/>\n<span class=\"hidden_text\">                           4<\/span><\/p>\n<p>orders shall be passed by the District Collector on the<\/p>\n<p>application for interim custody of the vehicle, within<\/p>\n<p>three weeks from the date of receipt of a copy of this<\/p>\n<p>judgment in the light of the observations contained in<\/p>\n<p>Shoukathali Vs. Tahasildar [2009 (1) KLT 640,<\/p>\n<p>Subramanian Vs. State of Kerala [2009 (1) KLT<\/p>\n<p>77) and <a href=\"\/doc\/925008\/\">Sareesh v. District Collector<\/a> (2009 (2)<\/p>\n<p>KLT 906).\n<\/p>\n<\/p>\n<p>6.    I make it clear that I have not considered the<\/p>\n<p>petitioner&#8217;s contentions on merits.     It is upto the<\/p>\n<p>District Collector to consider whether the vehicle is to<\/p>\n<p>be released on interim custody or not. It is also upto<\/p>\n<p>the District Collector to consider, in accordance with<\/p>\n<p>law, the question as to whether the vehicle belonging<\/p>\n<p>to the petitioner has been used in a manner as to<\/p>\n<p>contravene the provisions of the Act and the Rules<\/p>\n<p>framed thereunder and as to whether the vehicle is<\/p>\n<p>liable for confiscation and pass final orders on that<\/p>\n<p>basis.\n<\/p>\n<p>W.P.(C).17348\/09<br \/>\n<span class=\"hidden_text\">                          5<\/span><\/p>\n<p>      The writ petition is disposed of as above.
