2.\tRule.\n<\/p>\n
Learned advocate Mr.Joshi waives service of notice of rule for
\nopponent Nos.1 & 2, learned A.G.P. Mr.Pathak waives service of

\nwaives service of notice of rule for opponent No.5 and learned
\nadvocate Mr.Patel waives service of notice of rule for opponent No.6.\n<\/p>\n
3.\tThis
\nis an application seeking an amendment to the main petition.\n<\/p>\n
4.\tHeard
\nthe learned advocates for the parties.\n<\/p>\n
5.\tLearned
\nadvocate Mr.Pujara indicated that this amendment is sought to be
\nbrought on record in light of subsequent development that has taken
\nplace pending the petition. Mr.Pujara submitted that this amendment
\nis brought in to put the petition technically in order and,
\ntherefore, the application may be allowed.\n<\/p>\n
6.\tLearned
\nadvocate Mr.Joshi, learned AGP Mr.Pathak and learned advocate
\nMr.Patel have no objection to the grant of amendment.\n<\/p>\n
7.\tLearned
\nadvocate Mr.Jasani, appearing for opponent No.5, has strongly opposed
\nthis application. According to him, the application cannot be
\nentertained for the following reasons;-\n<\/p>\n
(i)\tthe
\napplication is preferred at a belated stage;\n<\/p>\n
(ii)\tby
\nbringing this amendment, nature of the \tpetition is sought to be
\nchanged;\n<\/p>\n
(iii)this
\nquestion was already considered by this \tCourt while considering the
\nquestion of interim \trelief; and<\/p>\n
(iv)
\nthis amendment is brought in to negate the \torder passed by this High
\nCourt in earlier \tpetitions preferred by opponent Nos.5 & 6.\n<\/p>\n
7.1\t\tMr.Jasani
\nhas drawn attention of this Court to an order passed by this Court on
\n5.9.2006, which is passed after taking into consideration the
\nsubsequent development now sought to be brought on record. Mr.Jasani,
\ntherefore, submitted that the grant of this application would cause
\nprejudice to opponent No.5 and, therefore, may not be allowed.\n<\/p>\n
8.\tHaving
\nregard to the rival submissions, at the outset, it may be noted that
\nthe amendments sought to be brought on record on account of
\nsubsequent development during the pendency of the petition had
\nalready attracted the attention of the applicant, opponents and the
\nCourt soon after the development took place when the Court dealt with
\nthe question of interim relief by order dated 5.9.2006. The Court, in
\nterms, has made reference to the development in that order. Even in
\nthe additional affidavit filed by the petitioner, there is reference
\nto the new development. Therefore, learned advocate Mr.Jasani is to
\nan extent justified in raising a plea that the applicant has
\napproached this Court at a belated stage. Almost four years have
\ngone-by and the petitioner has taken no action in this regard.
\nHowever, learned advocate Mr.Pujara is also right in stating that the
\npetition was not listed till 16.6.2010 after passing of the order on
\n5.9.2006. This is what reflected in the order itself. Mr.Pujara has,
\nin all frankness, taken the responsibility upon himself that upon
\nreading the petition when it was listed on 16.6.2010, he realised a
\nneed for putting the petition in order technically.\n<\/p>\n
9.\tIt
\nis true that delay defeats, but when the delay has not caused any
\nprejudice to the other side and when causing of delay is not likely
\nto accrue any unjust benefit to the person coming late to the Court,
\ndelay need not come in the way. If the order dated 5.9.2006 is seen,
\nappointment of opponent No.5 is already held subject to the final
\noutcome of the petition. Now, if that part is not challenged in the
\npetition, it would render the petition incomplete and technically
\ndefective. If an attempt is made to put the house in order, there is
\nnothing to read any ulterior motive behind coming to the Court late,
\nbecause that fact is already brought to the notice of all the
\nconcerned, including the Court and delay part, therefore, need not
\ncome in the way of the petitioner.\n<\/p>\n
10.\tSo
\nfar as the contention that the petitioner’s attempt is to nullify the
\norder passed by this Court in the earlier petitions, which were
\npreferred by opponent Nos.5 & 6 is concerned, no such relief is
\nsought, which would go adverse to that order. On the contrary, the
\norder dated 5.9.2006 makes it explicit that the appointment of
\nopponent No.5 is subject to the final outcome of this petition and
\nthat order has been accepted by opponent No.5, as it has not been
\nchallenged yet. This contention, therefore, cannot be accepted.\n<\/p>\n
11.\tSo
\nfar as the contention that by the amendment, the nature of the
\npetition is sought to be changed, probably, is not the correct way of
\nlooking at the petition. The petitioner is asserting his right, of
\nwhich he was deprived, firstly by opponent Nos.5 & 6  while
\nbypassing him and getting appointment. The details have come to the
\nnotice of the petitioner only after he sought information under the
\nRight to Information Act.\n<\/p>\n
12.\tLastly,
\nit hardly needs to be stated that by mere grant of amendment of
\npetition, no relief is granted. It only enables the petitioner to
\ncanvass a point before the Court and seek relief, which may or may
\nnot be granted. This amendment, on the contrary, reduces burden on
\nthe shoulder of the judicial system by filing a fresh petition, which
\nthe petitioner could have filed.\n<\/p>\n
13.\tIn
\nview of the above discussion, this application deserves to be allowed
\nand the same is allowed. The amendment to be carried out forthwith.
\nRule is made absolute. No costs.\n<\/p>\n
13.1\t\tThe
\npetitioner shall supply a fresh copy of the amended petition to the
\nCourt and shall serve to respondent Nos.1 & 2 and supply to
\nlearned A.G.P and learned advocates for rest of the respondents. This
\nshall be done by the petitioner within two weeks.\n<\/p>\n
