Sessidas Judge,<br \/>\nAthani partly allowing the Refere_n&#8217;c:a_ &#8216;P_etitlon~.for enhanced<br \/>\ncompensation.   &#8221;   &#8221; &#8221;\n<\/p>\n<p>This petition coming on l\ufb01nal&#8217;V:&#8217;h&#8217;earlln*ajthl&#8217;s day, the Court<br \/>\nmade the following:   -_  &#8216;V &#8221;\n<\/p>\n<p>This petltlodisVIdlvret;t_edt:&#8217;a&#8217;g~aln:st the judgment and order<br \/>\ndated 2&#8243;&#8221; o.gcemai;&#8217;l*,*&#8217;.2.oo2j passed- by the Court of 1: Additional<\/p>\n<p>District Judge; a\u00e9igaum&#8217;lin&#8217;.tAL.A;~:\u00a7.tAppeal No.25 of 1999.<\/p>\n<p>  &#8216;below&#8230;.dismlssed the petitioner&#8217;s IA for the<\/p>\n<p>condon.ation&#8211;.__o~ffdielay of 172 days in filing the appeal;<\/p>\n<p>  t;onseq;uenltl3rvth\u00e9j also stood dismissed.<\/p>\n<p> No&#8221; cogent explanation is forthcoming for the delay in<\/p>\n<p> the affidavit \ufb01led in support of IA.II of 2oo4 here,<\/p>\n<p>. &#8216;V:.&#8217;thae;a&#8217;p_;$ellant submits that the delay is &#8216;not much&#8217;. What matters<\/p>\n<p> isnot the period or the length of delay. But the delay has to be<\/p>\n<p>S satisfactorily explained. In the absence of the satisfactory<\/p>\n<p>explanation, the Court below cannot be held to be fault for<\/p>\n<p>\ufb02\ufb01lri.\n<\/p>\n<p>dismissing the application for the condonatlon of deiay.
