DHARMADHIKARI\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>ARIJIT PASAYAT,J.\n<\/p>\n<p>Rajasthan State Road Transport Corporation (hereinafter referred<br \/>\nto as &#8216;Corporation&#8217;) calls in question legality of the judgment<br \/>\nrendered by learned Single Judge of the Rajasthan High Court dismissing<br \/>\nthe second appeal filed by the Corporation.\n<\/p>\n<p>Background facts necessary for disposal of the appeal in a<br \/>\nnutshell are as follows:\n<\/p>\n<p>The respondent (hereinafter referred to as the &#8217;employee&#8217;) filed<br \/>\na civil suit in the Court of the learned Additional Civil Judge, Senior<br \/>\nDivision and Judicial Magistrate III, Jaipur City, Jaipur.  Suit was<br \/>\nfor declaration that the order of termination dated 18.3.1986 passed by<br \/>\nthe Corporation is illegal.  According to him he was appointed as a<br \/>\nConductor on permanent basis and on erroneous impression that he was<br \/>\ncarrying passengers without tickets, his services were terminated. He<br \/>\nwas not departmentally proceeded against and no inquiry was conducted,<br \/>\nand, therefore, the order of termination was illegal and arbitrary.  It<br \/>\nwas further pleaded that the principle of &#8220;last come first go&#8221; was not<br \/>\nfollowed in his case.  The Corporation took the stand that the employee<br \/>\nwas appointed on daily wage basis.  He was not appointed on permanent<br \/>\nbasis.  There was no necessity for departmental proceedings or enquiry<br \/>\nsince he was engaged on a daily wage basis, and the engagement was<br \/>\ndiscontinued. In any event there was no stigma attached.  The Trial<br \/>\nCourt after consideration of the materials brought on record came to<br \/>\nhold that the employee was appointed on daily wage basis.  There was no<br \/>\nquestion of departmental inquiry in case of daily wager.  The employee<br \/>\nhad not produced any appointment order to substantiate his plea that he<br \/>\nwas engaged on permanent basis.  There was no inquiry held and,<br \/>\ntherefore, the question whether the inquiry was proper or not did not<br \/>\narise for consideration.  The Trial Court did not think it necessary to<br \/>\ndecide the question of jurisdiction to entertain the suit.  The suit<br \/>\nwas dismissed.  The employee preferred an appeal before the First<br \/>\nAdditional District Judge No.V, Jaipur City who by the judgment dated<br \/>\n23.3.1999 reversed the conclusions of the Trial Court and held that the<br \/>\norder of termination was illegal and violative of principles of natural<br \/>\njustice  and employee was entitled to be in the service of the<br \/>\nCorporation and he was entitled to the monetary and financial<br \/>\nconsequential benefits.\n<\/p>\n<p>The Corporation preferred an appeal before the Rajasthan High<br \/>\nCourt and the learned Single Judge as noted above dismissed the second<br \/>\nappeal.\n<\/p>\n<p>In support of the appeal Mr. Sushil Kumar Jain, learned counsel<br \/>\nsubmitted that the approach of the High Court is clearly erroneous.  It<br \/>\nrecorded findings which are contrary to the materials on record.  The<br \/>\nHigh Court proceeded on the basis as if the Trial Court held that the<br \/>\ninquiry against the plaintiff was not in accordance with the principles<br \/>\nof natural justice and that the procedure of holding enquiry was<br \/>\ngrossly violative. The High Court and the Appellate Court had held that<br \/>\nthe inquiry was not in accordance with the principles of natural<br \/>\njustice.  After referring to the conclusions of the First Appellate<br \/>\nCourt, the High Court felt that decision given on merits is based on<br \/>\nfacts.\n<\/p>\n<p>None appeared on behalf of respondents in spite of service of<br \/>\nnotice.\n<\/p>\n<p>We find that while the Trial Court had analysed the factual<br \/>\nposition in law in great detail and had arrived at the right<br \/>\nconclusions, the First Appellate Court did not consider the matter in<br \/>\nthe proper perspective.  Some of its conclusions are clearly untenable.<br \/>\nFor example on the basic question as to the validity of the action<br \/>\ntaken by the Corporation, the First Appellate Court observed as<br \/>\nfollows:\n<\/p>\n<p>&#8220;10. The contention of the learned advocate for<br \/>\nrespondent is that the plaintiff was a daily wage<br \/>\nworker and was on a temporary post and that there is<br \/>\nno need for holding the departmental enquiry before<br \/>\nterminating him.  That in support of the contention<br \/>\nthe learned advocate has produced the following<br \/>\nillustrations before me :-\n<\/p>\n<p>1.\t1991 S.C.C. 591 State of Uttar Pradesh<br \/>\nversus Kaushal Kishore Shukla.\n<\/p>\n<p>2.\tA.I.R. 1994 Supreme Court 2411 State  of<br \/>\nUttar Pradesh versus Prem Lata.\n<\/p>\n<p>3.\t1996 (5) S.C.C. 889 K.V. Krishnamani<br \/>\nversus Lalit Kala Academy.\n<\/p>\n<p>4.\t1996 (1) S.C.C. 560 Satya Narayan versus<br \/>\nHigh Court of Madhya Pradesh and Ors.\n<\/p>\n<p>5.\tR.L.R. 1990 (2) page 268 Shakti Kant<br \/>\nPathak versus Paschmi Dugadh Utpadak<br \/>\nSahkari Sangh Ltd.\n<\/p>\n<p>6.\t1994 (2) W.L.C. (Raj.) 25 Kanwar Singh<br \/>\nversus Union of India.&#8221;\n<\/p>\n<p>It is to be noted that before the First Appellate Court the<br \/>\nCorporation was the respondent.  After referring to some judgments<br \/>\nreferred to by the Corporation, it inappropriately came to the<br \/>\nconclusions that the judgment and decree was liable to be appealed and<br \/>\nthe appeal of the plaintiff was liable to be accepted on the basis of<br \/>\nthe above mentioned illustrations (reference was made to the judgments<br \/>\nnoted above).\n<\/p>\n<p>Unfortunately, it has not been indicated as to how decisions<br \/>\nrelied upon by the Corporation supported the case of the plaintiff-<br \/>\nemployee.  What was the ratio in those cases and how they were<br \/>\napplicable and helpful to the employee&#8217;s case has also not been<br \/>\nindicated.  Such unreasoned and palpably wrong conclusions cannot be<br \/>\nsupported in law.  Unfortunately, the High Court did not consider these<br \/>\naspects.  It confused between the  conclusions of the Trial Court and<br \/>\nthe First Appellate Court.  Conclusions of the First Appellate Court<br \/>\nwere treated to be that of the Trial Court.  This was certainly a very<br \/>\nhighly improver way of dealing with the matter.\n<\/p>\n<p>In view of the above, we remit the matter to the High Court to<br \/>\ndecide the appeal in accordance with law after giving due opportunities<br \/>\nto the parties.\n<\/p>\n<p>Appeal is allowed in the aforesaid terms with no order as to<br \/>\ncosts.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Rajasthan State Road Transport &#8230; vs Tilla Ram on 25 August, 2004 Author: A Pasayat Bench: Arijit Pasayat, D.M.
