SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/10\/2011 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tThe<br \/>\npresent Special Civil Application under Article 227 of the<br \/>\nConstitution of India has been preferred by the petitioner-original<br \/>\nappellant to quash and set aside the impugned order passed by the<br \/>\nGujarat State Cooperative Tribunal dated 07\/10\/2003 in Miscellaneous<br \/>\nApplication No. 73\/2003 by which the learned tribunal has dismissed<br \/>\nthe said application submitted by the petitioner to condone the delay<br \/>\nin preferring the Appeal challenging the judgment and award passed by<br \/>\nthe learned Board of Nominees dated 23\/01\/2003 in Summary Lavad Suit<br \/>\nNo. 1213\/2003.\n<\/p>\n<p>2.\tIt<br \/>\nappears that being aggrieved and dissatisfied with the judgment and<br \/>\naward passed by the learned Board of Nominees dated 23\/01\/2003 in<br \/>\nSummary Lavad Suit No. 1213\/2003, the petitioner preferred Appeal<br \/>\nbefore the Gujarat State Cooperative Tribunal  and  there was a delay<br \/>\nof approximately 193 days in preferring the Appeal and, therefore,<br \/>\nthe petitioner submitted Miscellaneous Application No. 73\/2003<br \/>\nrequesting to condone the delay.  Instead of considering whether<br \/>\nthere was sufficient cause made out to  condone the delay or not the<br \/>\nlearned tribunal considered the Appeal on merits without giving an<br \/>\nopportunity to the petitioner and by the impugned order has refused<br \/>\nto condone the delay mainly on the ground that there is no merit in<br \/>\nthe Appeal.  In catena of decisions, the Hon&#8217;ble Supreme Court has<br \/>\nobserved that while considering the delay condonation application,<br \/>\nnormally the merits of the Appeal\/case is not required to be<br \/>\nconsidered and if it is considered, in that case, some opportunity is<br \/>\nrequired to be given to the party to submit the case on merits even<br \/>\nprima facie.\n<\/p>\n<p>3.\tUnder<br \/>\nthe circumstances, the impugned order passed by the learned tribunal<br \/>\nrejecting the application submitted by the petitioner to condone the<br \/>\ndelay cannot be sustained and the same deserves to quash and set<br \/>\naside and the matter is to be remanded to the learned tribunal for<br \/>\nconsidering the Appeal in accordance with law and on its own merits.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above and for the reasons stated hereinabove, the present<br \/>\npetition succeeds.   The impugned order passed by the learned<br \/>\ntribunal dated 07\/10\/2003 in Miscellaneous Application No. 73\/2003 is<br \/>\nhereby quashed and set aside and the delay caused in preferring the<br \/>\nAppeal challenging the judgment and award passed by the learned Board<br \/>\nof Nominees in Summary Lavad Suit No. 1213\/2003 is hereby condoned.<br \/>\nThe learned tribunal is now to directed to decide and dispose of the<br \/>\nAppeal and consider the said Appeal against the judgment and award<br \/>\npassed by the learned Board of Nominees in Summary Lavad Suit<br \/>\n1213\/2002 on merits.  Considering the facts and circumstances of the<br \/>\ncase, as the judgment and award passed by the learned Board of<br \/>\nNominees is of the year 2003, the learned tribunal is directed to<br \/>\ndecide and dispose of the said Appeal on merits at the earliest but<br \/>\nnot later than nine months from the date of receipt of the present<br \/>\norder.  It will be open for the petitioner to submit an appropriate<br \/>\napplication for interim relief, which be considered by the learned<br \/>\ntribunal in accordance with law and on its own merits.
