Indu Bala Pandey, learned Addl. Public<\/p>\n<p>                    Prosecutor for the State.\n<\/p>\n<p>                             The petitioner, who is in custody in connection with<\/p>\n<p>                    Baheri P.S. Case No.65 of 2010 for the offence under Sections 328<\/p>\n<p>                    and 379, 302\/34 of the Indian Penal Code, has prayed for grant of<\/p>\n<p>                    bail.\n<\/p>\n<p>                             In the case by intoxicating the Bolero driver, a Bolero<\/p>\n<p>                    was stolen by accused persons including the petitioner. The FIR<\/p>\n<p>                    was lodged against unknown. However, during investigation one<\/p>\n<p>                    of the accused was arrested and subsequently one another accused,<\/p>\n<p>                    namely, Rampratap Mahto was arrested, who disclosed the name<\/p>\n<p>                    of petitioner besides other accused persons.<\/p>\n<p>                             Learned counsel for the petitioner submits that the<\/p>\n<p>                    petitioner was running a hotel in the Civil Court campus at Rosera<\/p>\n<p>                    and he was in inimical term with Rampratap Mahto who has<\/p>\n<p>                    falsely implicated the petitioner. In the present case it was<\/p>\n<p>                    submitted that the petitioner has been made accused on the basis<\/p>\n<p>                    of confession of accused made before the police and, as such, the<\/p>\n<p>                    petitioner is entitled for bail.\n<\/p>\n<p><span class=\"hidden_text\">                            2<\/span><\/p>\n<p>              Smt. Indu Bala Pandey, learned Addl. Public Prosecutor<\/p>\n<p>     has opposed the prayer for bail. It was submitted that the vehicle<\/p>\n<p>     in question was recovered on confession made by this petitioner.<\/p>\n<p>              Besides hearing learned counsel for the parties, I have<\/p>\n<p>     also perused the impugned order, which indicates that while<\/p>\n<p>     rejecting the prayer for bail the learned court below has referred<\/p>\n<p>     paragraph 72 of the case diary, which show that vehicle in<\/p>\n<p>     question was recovered as per disclosure made by the petitioner.<\/p>\n<p>              Keeping in view the seriousness of accusation I am not<\/p>\n<p>     inclined to grant privilege of bail to the petitioner.
