DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/10\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tHeard<br \/>\nlearned advocates for the parties.\n<\/p>\n<p>\tRule.\n<\/p>\n<p>Learned APP Mr.Kartik Pandya and Ms.Jirga Jhaveri, learned advocate<br \/>\nwaive service of notice of rule for respective respondents.\n<\/p>\n<p>\tAt<br \/>\nthe request of the learned advocates for the parties, this<br \/>\napplication is taken up for final hearing today itself.\n<\/p>\n<p>\tThe<br \/>\ncomplainant herself is present and she has reiterated what is stated<br \/>\nin her affidavit dated 30.09.2010. She further submitted that the<br \/>\nabove affidavit is filed without any undue pressure, coercion or<br \/>\nthreats.  Besides, it is submitted that a petition for divorce under<br \/>\nSection 13B of the Hindu Marriage Act, will be filed before the<br \/>\nFamily Court at Ahmedabad and she has no objection if the impugned<br \/>\nproceedings and FIR are quashed and set aside.\n<\/p>\n<p>\tHaving<br \/>\nheard learned advocates for the parties  and on perusal of the record<br \/>\nof the case and considering the married life and age of the parties<br \/>\nand the settlement arrived at between the parties, prima facie, this<br \/>\nCourt is of the opinion that ends of justice would be met if the<br \/>\nimpugned complaint being CR No.I-192 of 2010 registered with Sole<br \/>\nPolice Station, Ahmedabad is quashed and set aside.\n<\/p>\n<p>\tThis<br \/>\napplication is allowed and the impugned complaint is hereby quashed<br \/>\nand set aside.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent only.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>[Anant<br \/>\nS.
