Heard both sides.\n<\/p>\n<p>\t3. A re&#8217;sume&#8217; of facts absolutely necessary and germane for the disposal<br \/>\nof this Civil Miscellaneous Appeal would run thus:<br \/>\n\tThe Tribunal vide Judgement dated 25.01.2006 has awarded compensation to a<br \/>\ntune of Rs.1,62,349\/- (Rupees one lakh sixty two thousand three hundred and<br \/>\nforty nine only) on the following sub-heads:\n<\/p>\n<p>For loss of income\t&#8211;\tRs.1,39,200\/-\n<\/p>\n<p>For medical expenses\t&#8211;\tRs.  16,449\/-\n<\/p>\n<p>For extra nourishment\t&#8211;\tRs.   3,000\/-\n<\/p>\n<p>For pain and sufferings\t&#8211; \tRs.   3,000\/-\n<\/p>\n<pre>For transportation\t-\tRs.     500\/-\nFor damages to dress\t-\tRs.     200\/-\t\n\t\t\t\t-------------\n\t\t\tTotal\t-\tRs.1,62,349\/-\n\t\t\t\t-------------\t\t\t\n\n<\/pre>\n<p>\t4. Being aggrieved by and dissatisfied with the Judgment and Decree of the<br \/>\nTribunal, the appellant Insurance Company filed this Civil Miscellaneous Appeal<br \/>\non the following grounds:\n<\/p>\n<p>\tThe multiplier system has been applied by the Tribunal without any<br \/>\njustification in the injury case and that the compensation arrived at by the<br \/>\nTribunal is on the higher side.\n<\/p>\n<p>\t5. The point for considerations are (i) whether the multiplier system<br \/>\nadopted by the Tribunal in assessing the compensation in injury case is<br \/>\njustified? and (ii) whether there is any infirmity in the Judgment of the<br \/>\nTribunal?\n<\/p>\n<p>6. On points:\n<\/p>\n<p>\tThe learned counsel for the appellant Insurance Company would draw the<br \/>\nattention of this Court to the fact that the Tribunal fixed the permanent<br \/>\ndisability at 30%, even though the doctor gave opinion that injured sustained<br \/>\n45% permanent disability.  The injured sustained fracture on his left leg.  No<br \/>\ndoubt, because of that, there was some shortening of the left leg and that he<br \/>\ncould not walk speedily and he suffered partial permanent disability.  It is a<br \/>\ntrite proposition of law that the multiplier system can be applied only in<br \/>\nmatters, where there is total permanent disability.  If the injured&#8217;s life has<br \/>\nbecome a mere vegetative one and that his existence is worse than death, then in<br \/>\nthat case certainly the compensation can even exceed the compensation, which<br \/>\ncould be awarded in the event of death.\n<\/p>\n<p>\t7. No doubt at the relevant time of the accident, the claimant was an<br \/>\nyoungster and student and because of that accident his future prospects might<br \/>\nhave got affected.  While awarding compensation for the partial permanent<br \/>\ndisability, the Court takes into account his loss of future income also and as<br \/>\nsuch separately for future loss of income, no calculation need be made by<br \/>\nadopting multiplier method for 30% permanent disability.  Even at the rate of<br \/>\nRs.2000\/- (Rupees two thousand only) for each percentage of disability, the<br \/>\ncompensation could be awarded, taking into account the fact that the claimant<br \/>\nwas a youngster and student at the relevant time of the accident and accordingly<br \/>\nif worked out, it comes to Rs.60,000\/- (Rupees sixty thousand only) for the<br \/>\npartial permanent disability.  As such sum of Rs.1,39,200\/- (Rupees one lakh<br \/>\nthirty nine thousand and two hundred only) calculated towards the permanent<br \/>\ndisability is modified as Rs.60,000\/- (Rupees sixty thousand only) and the rest<br \/>\nof the compensation awarded under various other sub heads are left undisturbed<br \/>\nas nothing has been shown that the said awarding of amount are unjustifiable.<br \/>\nAccordingly, the compensation is modified as under:<br \/>\nFor loss of income\t&#8211;\tRs.60,000\/-\n<\/p>\n<p>For medical expenses\t&#8211;\tRs.16,449\/-\n<\/p>\n<p>For extra nourishment\t&#8211;\tRs. 3,000\/-\n<\/p>\n<p>For pain and sufferings &#8211; \tRs. 3,000\/-\n<\/p>\n<p>For transportation\t&#8211;\tRs.   500\/-\n<\/p>\n<p>For damages to dress\t&#8211;\tRs.   200\/-\n<\/p>\n<blockquote><p>\t\t\t \t&#8212;&#8212;&#8212;&#8211;\n<\/p><\/blockquote>\n<blockquote><p>\t\tTotal\t&#8211;\tRs.83,149\/-\n<\/p><\/blockquote>\n<p>\t\t\t\t&#8212;&#8212;&#8212;&#8211;\t<\/p>\n<p>\t 8. In the result, this Civil Miscellaneous Appeal is partly allowed and<br \/>\nthe award of the Tribunal is reduced from Rs.1,62,349\/- (Rupees one lakh sixty<br \/>\ntwo thousand three hundred and forty nine only) to Rs.83,149\/- (Rupees eighty<br \/>\nthree thousand one hundred and forty nine only), which shall carry interest at<br \/>\nthe rate of 7.5% per annum as directed by the Tribunal.
