SIRI JAGAN, J.\n                  -------------------------------------------------\n                       W.P.(C)No. 11988 OF 2008\n                  -------------------------------------------------\n                  Dated this the 16th day of June, 2009\n\n\n                                  JUDGMENT\n<\/pre>\n<p>      The petitioner is an offspring of an inter caste married couple,<\/p>\n<p>of which the father is a backward Christian and the mother a<\/p>\n<p>Hindu-Pulaya Community.            According to the petitioner while the<\/p>\n<p>petitioner was an infant, his father deserted him and his mother.<\/p>\n<p>Thereafter the petitioner&#8217;s mother brought him up in her father&#8217;s<\/p>\n<p>house.     Her parents also belong to Hindu-Pulaya Community.<\/p>\n<p>Therefore according to the petitioner, he was brought up with all the<\/p>\n<p>social disabilities attached to a scheduled caste. Petitioner contends<\/p>\n<p>that in such circumstances, the petitioner is entitled to all reservation<\/p>\n<p>benefits applicable to a member of Hindu-Pulaya Community, which<\/p>\n<p>is recognised as a Scheduled Caste Community in Kerala. Petitioner<\/p>\n<p>applied for a community certificate to the 1st respondent. But the<\/p>\n<p>same has not been issued to the petitioner. Apparently the reason<\/p>\n<p>for the same is that the 1st respondent directed the petitioner to<\/p>\n<p>obtain a report from the Village Officer, Vanchiyoor within the<\/p>\n<p>jurisdiction of which the petitioner&#8217;s father resides. It is under the<\/p>\n<p>WPC : 11988\/08<br \/>\n<span class=\"hidden_text\">                                   -:2:-<\/span><\/p>\n<p>above circumstances the petitioner has filed the above writ petition<\/p>\n<p>seeking the following relief:\n<\/p>\n<p>       i. to issue a writ of mandamus or other appropriate writ, order<\/p>\n<p>or direction, directing the 1st respondent to issue a community<\/p>\n<p>certificate to the petitioner as prayed for by him under Exhibit P8<\/p>\n<p>application.\n<\/p>\n<p>       The contention of the petitioner is that, since the petitioner has<\/p>\n<p>been brought up in the Hindu-Pulaya Community with all the social<\/p>\n<p>disabilities attached to the Community, the petitioner is entitled to a<\/p>\n<p>Community certificate as a Hindu-Pulaya, based on the Full Bench<\/p>\n<p>decision of this Court in <a href=\"\/doc\/1464149\/\">Indira v. State of Kerala<\/a> [2005(4) KLT 119].<\/p>\n<p>       The learned Government Pleader submits that now that the<\/p>\n<p>Government has issued a new Government Order, GO(MS)<\/p>\n<p>No.109\/2008 dated 20.11.2008, whereby persons can claim<\/p>\n<p>Community status of the mother also, for the purpose of reservation<\/p>\n<p>benefits.    The petitioner can apply afresh on the basis of that<\/p>\n<p>Government Order. In the above circumstances the writ petition is<\/p>\n<p>disposed of with the following directions:\n<\/p>\n<p>       If the petitioner files a fresh application before the 1st<\/p>\n<p>WPC : 11988\/08<br \/>\n<span class=\"hidden_text\">                                  -:3:-<\/span><\/p>\n<p>respondent for a Community Certificate, the 1st respondent shall<\/p>\n<p>consider the application in the light of the above said Government<\/p>\n<p>Order and issue a Community Certificate to the petitioner as<\/p>\n<p>expeditiously as possible, at any rate, within one month from the date<\/p>\n<p>of receipt of the application along with a copy of this judgment.<\/p>\n<p>                                               S.
