Earlier, Commission had directed in its order dated 21.11.2008<br \/>\nthat the matter which was not heard by the Appellate Authority should<br \/>\nbe considered by the Appellate Authority and a decision given on the<br \/>\nbasis of the CPIO&#8217;s communication dated 28.05.2008 to the appellant.<br \/>\nAppellant claimed that he had taken this matter in first-appeal before<br \/>\nthe Appellate Authority, Central Excise Hqrs., Indore through a<br \/>\ncommunication dated 03.06.2008, but the Appellate Authority failed to<br \/>\ngive a decision in the appeal.\n<\/p>\n<p>3.    Following Commission&#8217;s above directive, the Appellate Authority,<br \/>\nMd.Irfan Ahmad considered the matter in first-appeal and in his order<br \/>\ndated 06.01.2009 \u23af in which he also explained the reasons why he<br \/>\ncould not consider the first-appeal earlier \u23af he directed the CPIO to<br \/>\nfurnish to the appellant cogent and accurate reply to his RTI-queries.\n<\/p>\n<p>4.    Following Appellate Authority&#8217;s directive, CPIO gave to the<br \/>\nappellant a reply on 16.01.2009.\n<\/p>\n<p>5.    Appellant&#8217;s RTI-application was about information regarding the<br \/>\naction taken on a petition he had earlier filed on 27.03.2008 before the<br \/>\nCustoms authorities about possible service-tax evasion by certain<br \/>\nthird-parties.\n<\/p>\n<p>6.     Now, CPIO in his reply to the appellant has informed him that<br \/>\ncontrary to the appellant&#8217;s belief that action in the above matter was<br \/>\ntaken or would have been taken on the basis of his above-mentioned<br \/>\npetition to the Service Tax Department, investigative action had already<br \/>\ncommenced on the basis of the report received from the Service Tax<\/p>\n<p>AT-29052009-16.doc<br \/>\n<span class=\"hidden_text\">                                                             Page 1 of 2<\/span><br \/>\n Task Force Division, Indore even prior to the receipt of the appellant&#8217;s<br \/>\ncomplaint dated 27.03.2008.\n<\/p>\n<p>7.     During the hearing, CPIO stated that the investigation in this<br \/>\nmatter is still pending and nothing at this stage can be disclosed to the<br \/>\nappellant as it would impede the process of the investigation, which<br \/>\nwas current. He stated that a number of third-parties were under the<br \/>\nscanner in this investigation and witnesses were being examined and<br \/>\nintelligence gathered. If any information is disclosed at this stage, it<br \/>\nwill have a deleterious impact on the ongoing investigation and,<br \/>\ntherefore, demanded that no further information or documents be<br \/>\ndisclosed to the appellant. He cited Section 8(1)(h) and Section 8(1)(g)<br \/>\nin support of his contention.\n<\/p>\n<p>8.    I find from the submissions that the information which appellant<br \/>\nwanted has been accurately disclosed to him through CPIO&#8217;s<br \/>\ncommunication to him dated 16.01.2009. I&#8217;m also in agreement with<br \/>\nthe CPIO that when the investigative process is current, appellant<br \/>\ncannot be allowed access to the action as such intrusion had the<br \/>\npotentiality to impede the investigative process. Matters such as this<br \/>\nattract the bar under Section 8(1)(h) as well as Section 8(1)(g).\n<\/p>\n<p>9.    I, therefore, uphold the action of the CPIO.\n<\/p>\n<p>10.   Appeal fails.
