Special Civil Application No. 11116 of 2001<br \/>\n<span class=\"hidden_text\">          MR YOGESH S LAKHANI for Petitioner No. 1<\/span><br \/>\n          MR JOSHI A.G.P.for Respondents No. 1-3<br \/>\n<span class=\"hidden_text\">          MS PJ DAVAWALA for Respondent No. 4<\/span>\n<\/p>\n<p>     &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>              CORAM : MR.JUSTICE A.L.DAVE<\/p>\n<p>     Date of decision: 10\/01\/2002<\/p>\n<p>ORAL JUDGEMENT<\/p>\n<p>     The petitioner is detained under   provisions<br \/>\n     contained in Section 3 of the Prevention of Black<br \/>\n     Marketing and Maintenance of  Supply   of   Essential<br \/>\n Commodities Act, 1980 (&#8216;P.B.M.      Act&#8217; for short), by<br \/>\nvirtue of order passed by the District Magistrate,<br \/>\nVadodara, on September 22, 2001, in exercise of powers<br \/>\nvested in him by Section 3 of the said Act and the<br \/>\npetitioner challenges the order of detention in this<br \/>\npetition preferred under Article 226 of the Constitution<br \/>\nof India on various grounds.\n<\/p>\n<p>2.The grounds of detention dated September 22, 2001<br \/>\nserved on the petitioner detenu indicate that five<br \/>\npersons other than the petitioner were found to have been<br \/>\ninvolved in theft of crude oil from underground pipe line<br \/>\nof O.N.G.C.   lying between Gandhar\/Ankleshwar at village<br \/>\nAnti, Taluka Padra. On August 29, 2001 several documents<br \/>\nincluding invoices were found from those persons and it<br \/>\nis found by detaining authority that the petitioner was<br \/>\ninstrumental in providing those forged bogus bills and<br \/>\nthereby to have abetted the activities of the persons<br \/>\nnamed in the ground of detention in para 5 which is found<br \/>\nto be detrimental to the supply of essential commodities.<br \/>\nThe detaining authority observed that it has considered<br \/>\nthe possibility of resorting to alternative less drastic<br \/>\nremedy under the ordinary law but it was considered<br \/>\ninadequate because if such prosecution is launched, the<br \/>\npetitioner may apply for bail, may obtain bail and after<br \/>\nbeing released on bail may pursue the activities. The<br \/>\ndetaining authority observed that the detenu is required<br \/>\nto be immediately prevented from pursuing his activities<br \/>\nand, therefore, the detention is the only effective<br \/>\nremedy   available with the detaining authority and,<br \/>\ntherefore, the order was passed.\n<\/p>\n<p>3.The learned advocate appearing for the petitioner<br \/>\nhas restricted his argument to the following contentions.\n<\/p>\n<p>3.1.The detaining authority was not alive to the fact<br \/>\nthat prosecution was already launched against the present<br \/>\ndetenu along with the other persons named in para 5 of<br \/>\nthe ground of detention which       is   indicated    from<br \/>\ncommunication addressed to the District Supply Officer,<br \/>\nBaroda by Police Inspector, L.C.B. Baroda on September<br \/>\n21, 2001 which forms part of the compilation supplied to<br \/>\nthe detenu. The learned advocate submitted that when<br \/>\nthis document is supplied to the detenu, it necessarily<br \/>\nindicates that this was placed before the detaining<br \/>\nauthority and still the detaining authority has observed<br \/>\nthat taking steps under ordinary law is not possible when<br \/>\nin fact, the prosecution was already launched.        This<br \/>\nindicates that the detaining authority has not properly<br \/>\nstudied the papers before passing the orders.          The<br \/>\n satisfaction   recorded   by   the    detaining authority<br \/>\ntherefore would be vitiated and       the order of    the<br \/>\ndetention therefore may be quashed.\n<\/p>\n<p>3.2.Learned advocate Mr.Lakhani, also submitted that<br \/>\nthe detaining authority was not aware about the fact that<br \/>\nthe other accused persons had applied for bail and their<br \/>\nbail applications were rejected and, therefore, the<br \/>\npossibility of the petitioner applying for and getting<br \/>\nthe bail considered by the authority was not proper. In<br \/>\nfact, the orders of rejection were not placed before the<br \/>\ndetaining authority by the sponsoring authority and<br \/>\ntherefore there was absence of complete material before<br \/>\nthe detaining authority and therefore, the order is<br \/>\npassed in absence of such relevant        material   and,<br \/>\ntherefore, the order would stand vitiated. Mr.Lakhani<br \/>\nurged that the petition may therefore be allowed.\n<\/p>\n<p>4.Learned A.G.P. Mr. Joshi, opposes the petition<br \/>\non behalf of respondents Nos.1, 2 and 3. Respondent No.4<br \/>\nis represented by learned counsel Ms.Davawala.\n<\/p>\n<p>5.Affidavit-in-replies    are   filed   by   Deputy<br \/>\nSecretary to the Government of Gujarat as well as Under<br \/>\nSecretary in the Department of Consumer Affairs, Ministry<br \/>\nof Consumer Affairs, Food and Public Distribution, New<br \/>\nDelhi, which are taken on record.\n<\/p>\n<p>5.1.Learned advocate Mr.Lakhani has placed on record<br \/>\nthe   copy of communication addressed to the D.S.O.<br \/>\nVadodara by Police Inspector L.C.B. Vadodara (Rural) on<br \/>\n21.9.2001 which form part of the compilation supplied to<br \/>\nthe detenu.\n<\/p>\n<p>6.At   the outset it may be recorded that it<br \/>\ntranspired during the course of argument that the persons<br \/>\nnamed in para 5 of the ground of detention that is the<br \/>\npersons who are principally involved in the activities<br \/>\nwere detained and have been released from detention as<br \/>\ntheir petition have been accepted by this Court. The<br \/>\npresent petitioner is only alleged to have aided and<br \/>\nabetted the activity of the principal miscreants.\n<\/p>\n<p>7.Apart from the above aspect the case before this<br \/>\nCourt indicates that the detaining authority        while<br \/>\npassing the order does not seem to have studied the<br \/>\npapers placed before it.   The detaining authority has<br \/>\nobserved that if steps are taken under ordinary law, the<br \/>\ndetenu may apply for bail, may obtain bail and thereafter<br \/>\nmay continue his illegal activities and, therefore, in<br \/>\nthe opinion of the detaining authority steps under the<br \/>\n ordinary law cannot be the taken and the petitioner is<br \/>\nrequired to be detained under P.B.M. Act whoever in fact<br \/>\nas it is clear from the communication between the Police<br \/>\nInspector L.C.B. and D.S.O. Vadodara, which forms part<br \/>\nof the compilation provided to the detenu (necessarily<br \/>\nmeaning that it was placed before the detaining authority<br \/>\nfor consideration) that prosecution was already launched<br \/>\nagainst the present detenu and that he was to be<br \/>\narrested. Thus action under ordinary law was already<br \/>\ntaken.    It is clear from that communication that bail<br \/>\napplication of the other miscreants was rejected by the<br \/>\nCourt and    they   were   in   judicial   custody.    The<br \/>\nsatisfaction of the detaining authority that the detenu<br \/>\nis likely to get bail and pursue the activities and<br \/>\ntherefore detention is the only remedy was without any<br \/>\nbasis.    In this regard the decision of the Apex Court in<br \/>\n<a href=\"\/doc\/1724660\/\">Amritlal v. Union Government A.I.R.<\/a> 2000 S.C. 3675 can<br \/>\nbe profitably be used.\n<\/p>\n<p>8.In view of the above discussion the satisfaction<br \/>\nof detaining authority is found to be vitiated because of<br \/>\nnon-application of mind and non-consideration of relevant<br \/>\nmaterial. It vitiates the order in question. The order<br \/>\ntherefore   deserves to be quashed by allowing this<br \/>\npetition.\n<\/p>\n<p>9.The petition is allowed.      Order   passed   by<br \/>\nDistrict Magistrate, Vadodara dated 22.9.2001 is hereby<br \/>\nquashed and set-aside. Detenu Harshad Dahyabhai Patel be<br \/>\nreleased from detention forthwith if not required in any<br \/>\nother case. Rule is made absolute. No costs.\n<\/p>\n<p>(A.L.
