The<\/p>\n<p> plaintiff in a suit for specific performance of a<\/p>\n<p> contract for sale sought for a prohibitory as<\/p>\n<p> well as mandatory injunction against the owner of<\/p>\n<p> the property. The court below found that though<\/p>\n<p> the defendant admits receipt of advance under the<\/p>\n<p> control for sale, there were no grounds to grant<\/p>\n<p> any   order   of    injunction   against    further<\/p>\n<p> transactions.\n<\/p>\n<\/p>\n<p>2.At the stage of admission, we had granted an<\/p>\n<p> interim order on I.A.No.3340\/2010 to the effect<\/p>\n<p> that  there   would  be   a  temporary   injunction<\/p>\n<p><span class=\"hidden_text\">FAO274\/10              -: 2 :-<\/span><\/p>\n<p> restraining the respondent from alienating the<\/p>\n<p> suit property and from encumbering the same for a<\/p>\n<p> period of four months on condition that the<\/p>\n<p> appellant produces before the court below a fixed<\/p>\n<p> deposit receipt drawn on a nationalized bank in<\/p>\n<p> his name for the balance sale consideration in<\/p>\n<p> terms of the plaint. This was in a way testing<\/p>\n<p> the bonafides of the appellant. Since the matter<\/p>\n<p> is yet to go for trial, we do not want to say<\/p>\n<p> anything finally on it. But, the fact of the<\/p>\n<p> matter remains that even as on today, no fixed<\/p>\n<p> deposit receipt is provided before the court<\/p>\n<p> below,    though  the appellant   had enjoyed the<\/p>\n<p> benefits of the interim order for four months.<\/p>\n<p>3.For    the  reasons  recorded    by  the  learned<\/p>\n<p> Subordinate    Judge and     on the basis  of the<\/p>\n<p> materials on record, we do not find any reason to<\/p>\n<p> hold that there is a prima facie case warranting<\/p>\n<p> the issuance of a temporary injunction as prayed<\/p>\n<p> for     before   the    court   below.   This  is<\/p>\n<p> notwithstanding the fact that the court below has<\/p>\n<p><span class=\"hidden_text\">FAO274\/10             -: 3 :-<\/span><\/p>\n<p> recorded that the defendant admits receipt of<\/p>\n<p> part of the sale consideration.<\/p>\n<p> For the aforesaid reasons, we find no merit in<\/p>\n<p> this appeal.
