The said resolution\nhad  been duly approved by the Registrar of Societies  under\nSection\t 36  of\t the Act. The dispute was  referred  by\t the\nRegistrar under Section 98(1) of the Act to his nominee\t for\na decision, who dismissed the claim.\n    The Tribunal allowed the appeal of first respondent\t and\nremanded  the matter to the Registrar's nominee for a  fresh\ndecision. During the trial, upon an application made by\t the\nappellant  Society under sub-section (2) of Section 96\tthat\nthe  dispute  did not survive as the expulsion\thad  already\nbeen decided in the collateral proceedings and the Registrar\nhad  accorded his approval under Section 36 of the Act,\t the\nDistrict  Registrar held that the first respondent was\tpre-\ncluded\tfrom  contending that the  impugned  Resolution\t was\nillegal\t since he had not preferred any appeal\tagainst\t the\napproval by the Registrar, that the doctrine of res judicata\nwas attracted and, therefore, there was no dispute in exist-\nence between the parties.\n    This  order was taken up in revision under\tSection\t 150\nsub-clause  (9) of the Act before the Tribunal,\t which\theld\nthat  the District Registrar had no jurisdiction to  re-open\nthe  question  as to whether or not the matter\treferred  by\nfirst  respondent was a dispute within the meaning  of\tsub-\nsection\t (1)  of  Section 96 at the  subsequent\t stage,\t and\nhaving already decided that the matter constituted a dispute\nunder  Section 96(1) at an earlier stage, the  powers  under\nsub-section (2) of Section 96 were exhausted and he was\t not\ncompetent to review his earlier decision.\n    In\tappeal,\t the High Court held that the  Tribunal\t was\nright  in holding that the Registrar had no jurisdiction  to\nrevise or review his\n895\nearlier\t decision that the dispute raised by the  first\t re-\nspondent fell within the ambit of the description of dispute\nwithin\tthe  meaning of sub-section (1) of Section  96,\t and\nthat  it had revisional jurisdiction; and also granted\tspe-\ncial leave to appeal.\n    In appeal before this Court, it was contended on  behalf\nof  the\t appellant that when a dispute was referred  to\t the\nRegistrar,  and he ultimately gave a decision on  merits  it\nwas  no doubt appealable but when the Registrar\t entertained\nthe  dispute and sent it to his nominee, that was  an  order\nagainst which a revision lay to the Tribunal.\nDismissing.the appeal, this Court,\n    HELD: 1. Clause (9) of Section 150 confers\tjurisdiction\non  the Tribunal to call for and examine the record  of\t any\nproceeding.  The word 'proceeding' here is qualified by\t the\nphrase, in which appeal lies to it- After final disposal  of\nthese proceedings i.e. decision of the dispute by the Regis-\ntrar  or by his nominee, an appeal will lie to the  Tribunal\nand, therefore, the High Court was right in holding that the\nTribunal had jurisdiction to call for and examine the record\nof such proceedings. [899D-E]\n    The\t phrase 'any proceedings in which an appeal lies  to\nit' in clause (9) of Section 150 makes it clear that if\t the\nproceedings  where  the final order is appealable,  then  it\ncould  not be said that these are the proceedings  where  an\nappeal lies to the Tribunal, and it is in these\t proceedings\nthat the jurisdiction has been conferred on the Tribunal  to\ncall for the record and examine the matter. [899E-G]\n    2.\tWhen  the respondent submitted his  dispute  to\t the\nRegistrar  and\tthe Registrar, after examining\tthe  matter,\ncame to the conclusion that it was a dispute which could  be\nentertained  within the scope of Section 96 and,  therefore,\nreferred  it to his nominee for decision, there is no  doubt\nthat  the Registrar exercised jurisdiction under Section  96\nand,  therefore, the High Court was right in coming  to\t the\nconclusion  that once the Registrar took this  decision,  he\nhad no power to review his order. This appeal is by certificate granted  by\t the<br \/>\nHigh Court of Gujarat under Art. 133 of the Constitution  of<br \/>\nIndia by its order dated 6.4.73. The High Court by its order<br \/>\ndated  6.4.73 dismissed the petition filed by the  appellant<br \/>\nquestioning the correctness of the order of the Gujarat\t Co-<br \/>\noperative Tribunal.\n<\/p>\n<p>    The facts necessary for disposal of this appeal are that<br \/>\nappellant is a co-operative housing society registered\twith<br \/>\nthe  Registrar\tof Cooperative Societies Gujarat  under\t the<br \/>\nprovisions  of the Act. It is alleged that this Society\t was<br \/>\nformed on 2nd May 1961 with the object of providing  housing<br \/>\nfacilities to its members. Respondent No.1 Panchal Keshavlal<br \/>\nNarbheram was a founder member of this Society alongwith  11<br \/>\nothers.\t It is alleged that the conduct of  respondent\tNo.1<br \/>\nwas  found to be detrimental to the interest of the  Society<br \/>\nand its working and the Society therefore invoked the provi-<br \/>\nsions  of Section 36 of the Act, passed a  resolution  dated<br \/>\n19.6.65 to expel respondent No.1 from the membership of\t the<br \/>\nSociety.  A further opportunity to show cause was  given  to<br \/>\nthe respondent and on November 28, 1965 the appellant socie-<br \/>\nty  passed a resolution expelling respondent No.1  from\t the<br \/>\nmembership of the Society.\n<\/p>\n<p>    This resolution of the Society was duly approved by\t the<br \/>\nRegistrar of Societies as required under Sec. 36 of the said<br \/>\nAct on 13.4.66.\n<\/p>\n<p>    On\t17.2.66 respondent No.1 instituted another  proceed-<br \/>\nings  under  Sec. 96(1) with the Registrar  of\tCo-operative<br \/>\nSocieties seeking relief of setting aside of the  resolution<br \/>\npassed\tby the Society against respondent No. 1. The  Regis-<br \/>\ntrar  entertaining  the dispute and exercising\tpowers\tcon-<br \/>\nferred under Sec. 98(1) referred the dispute for decision to<br \/>\nhis  nominee  and out of these\tproceedings  ultimately\t the<br \/>\npresent appeal arises.\n<\/p>\n<p>On July 16, 1966 the Registrar&#8217;s nominee dismissed  respond-<br \/>\nent<br \/>\n<span class=\"hidden_text\">897<\/span><br \/>\nNo.  1&#8217;s  claim by his order dated 16.7.66.  Thereafter\t re-<br \/>\nspondent  No.1 carried the matter to the Tribunal by way  of<br \/>\nan appeal i.e. Appeal No. 119 of 1966.\n<\/p>\n<p>    That on August 25, 1967 the Tribunal allowed the  appeal<br \/>\nof the respondent and remanded the matter to the Registrar&#8217;s<br \/>\nnominee for a fresh decision in accordance with law.<br \/>\n    After  remand the parties proceeded with the  trial\t and<br \/>\nadduced\t oral  evidence before the Registrar&#8217;s\tnominee\t but<br \/>\nduring\tthe trial on 16.2.70 the appellant-society  made  an<br \/>\napplication  under sub-sec. (2) of sec. 96 to  the  District<br \/>\nRegistrar  that\t the question relating to the  expulsion  of<br \/>\nrespondent No. 1 had already been decided in the sense\tthat<br \/>\nin the collateral proceedings the Registrar had recorded his<br \/>\napproval under Sec. 36 of the Act to the action taken by the<br \/>\nSociety\t and therefore the dispute did not survive. On\tthis<br \/>\napplication  the  District Registrar heard the\tparties\t and<br \/>\ncame  to the conclusion that respondent No. 1 was  precluded<br \/>\nfrom  contending that the impugned resolution expelling\t him<br \/>\nfrom  the membership of the society was illegal inasmuch  as<br \/>\nhe had not preferred any appeal against the decision of\t the<br \/>\nRegistrar according his approval to the action taken by\t the<br \/>\nSociety under sec. 36.\n<\/p>\n<p>    The District Registrar was of the opinion that  doctrine<br \/>\nof  resjudicata\t was attracted and therefore  there  was  no<br \/>\ndispute in existence between the parties. This order  passed<br \/>\nby  the District Registrar on 19.6.70 was taken up in  revi-<br \/>\nsion under Sec. 150 sub-clause 9 of the Act to the Tribunal.<br \/>\nThe Tribunal came to the conclusion that the District Regis-<br \/>\ntrar  had  no  jurisdiction to re-open the  question  as  to<br \/>\nwhether or not the matter referred by respondent No. 1 was a<br \/>\ndispute\t within\t the meaning of sub-sec. (1) of Sec.  96  at<br \/>\nthis  subsequent stage. The view taken was that\t having\t al-<br \/>\nready  decided that the matter constituted a  dispute  under<br \/>\nSec.  96(1) at an early stage before he made a reference  to<br \/>\nthe Registrar&#8217;s nominee in exercise of powers under Sec. 97.<br \/>\nThe powers under sub-sec. (2) of Sec. 96 were exhausted\t and<br \/>\nit was not competent for him to review his earlier decision.<br \/>\nAccordingly  the Tribunal by its order dated 6.2.71  allowed<br \/>\nthe  revision  petition, set aside the order passed  by\t the<br \/>\nDistrict Registrar on June 25, 1970 and directed the  Regis-<br \/>\ntrar&#8217;s\tnominee to proceed with the decision of\t the  matter<br \/>\nexpeditiously having regard to the fact that the dispute  is<br \/>\nan  old one having its origin in a resolution passed by\t the<br \/>\nappellant-society on November 28, 1965.\n<\/p>\n<p><span class=\"hidden_text\">898<\/span><\/p>\n<p>    The appellant-society feeling aggrieved by the aforesaid<br \/>\ndecision  invoked the jurisdiction of the High\tCourt  under<br \/>\nArticles  226 and 227 of the Constitution of India. In\tthis<br \/>\npetition  the appellant raised mainly two  contentions:\t (i)<br \/>\nthat the Tribunal was in error in holding that Registrar was<br \/>\nnot competent to review his earlier decision that the matter<br \/>\nreferred  to by the respondent No.1 was a  &#8216;dispute&#8217;  within<br \/>\nthe  meaning of sub-section (1) of Sec. 96 of the Act;\t(ii)<br \/>\nthat the Tribunal had no revisional jurisdiction against  an<br \/>\norder passed under Sec. 96(2) of the Act.\n<\/p>\n<p>    On the first question the High Court came to the conclu-<br \/>\nsion  that the Tribunal was right in holding that  Registrar<br \/>\nhad no jurisdiction to revise or review his earlier decision<br \/>\nwherein\t the Registrar came to the conclusion that the\tdis-<br \/>\npute raised by respondent No. 1 fell within the ambit of the<br \/>\ndescription  of dispute (within the meaning of sub-sec.\t (1)<br \/>\nof Sec. 96). On the second question the High Court took\t the<br \/>\nview that the Tribunal had revisional jurisdiction.<br \/>\n    The\t High  Court  considered the question  of  leave  to<br \/>\nappeal to this Court and granted leave and framed  following<br \/>\nquestion for decision:\n<\/p>\n<blockquote><p>\t      &#8220;In an order passed by the Registrar in  exer-<br \/>\n\t      cise  of the powers under sub-section  (2)  of<br \/>\n\t      Sec. 96 of Gujarat Cooperative Societies\tAct,<br \/>\n\t      1961  subject to revision by the\tTribunal  in<br \/>\n\t      exercise of the powers under Section 150(9) of<br \/>\n\t      the Act?&#8221;\n<\/p><\/blockquote>\n<p>In  pursuance to the certificate granted by the\t High  Court<br \/>\nthe present appeal has been filed by the appellant.<br \/>\n    Learned  counsel appearing for the\tappellant  contended<br \/>\nthat  although when a dispute is referred to  the  Registrar<br \/>\nand he ultimately gives decision on merits that is no  doubt<br \/>\nappealable but when the Registrar entertains the dispute and<br \/>\nsends it to his nominee that is not an order against which a<br \/>\nrevision  can  lie to the tribunal. Learned  counsel  placed<br \/>\nreliance  on the decision in Krishnarao Bakaramji  Hadge  v.<br \/>\nThe  State of Maharashtra, [1969] B.L.R. 150  and  contended<br \/>\nthat the Tribunal had no revisional jurisdiction.<br \/>\n    The High Court in the impugned judgment after  consider-<br \/>\ning  this decision and the provisions contained in  Sec.  97<br \/>\ncame  to the conclusion that when a dispute is\treferred  to<br \/>\nthe Registrar under sec. 96 and<br \/>\n<span class=\"hidden_text\"> 899<\/span><br \/>\nthe  Registrar\tentertains  the dispute under  Sec.  96\t and<br \/>\nultimately  finally disposes it of against the\tdecision  on<br \/>\nthe  merits there is an appeal to the Tribunal according  to<br \/>\nSec. 97 which is similar to Sec. 101 of the present  Gujarat<br \/>\nCo-operative  Societies\t Act, 1961 and in view of  this\t the<br \/>\nlearned Judges of the High Court came to the conclusion that<br \/>\nunder  clause  9  of Sec. 150 the  Tribunal  has  revisional<br \/>\njurisdiction in a matter an appeal lies to it. Clause (9) of<br \/>\nSec. 150 reads:\n<\/p>\n<blockquote><p>\t      &#8220;(9) The Tribunal may call for and examine the<br \/>\n\t      record  of any proceeding in which  an  appeal<br \/>\n\t      lies  to\tit, for the  purpose  of  satisfying<br \/>\n\t      itself as to the legality or propriety of\t any<br \/>\n\t      decision\tor order passed. If in any case,  it<br \/>\n\t      appears to the Tribunal that any such decision<br \/>\n\t      or  order\t should\t be  modified,\tannulled  or<br \/>\n\t      reversed,the  Tribunal  may pass,\t such  order<br \/>\n\t      thereon as it may deem just.&#8221;\n<\/p><\/blockquote>\n<p>This  confers jurisdiction on the Tribunal to call  for\t and<br \/>\nexamine the record of any proceeding. The word\t&#8216;proceeding&#8217;<br \/>\nhere  is qualified by the phrase in which an appeal lies  to<br \/>\nit.  It is not disputed that after final disposal  of  these<br \/>\nproceedings i.e. decision of the dispute by the Registrar or<br \/>\nby his nominee an appeal will lie to the Tribunal and there-<br \/>\nfore  in  the impugned judgment the Division  Bench  of\t the<br \/>\nGujarat\t High  Court  took the view that  the  Tribunal\t has<br \/>\njurisdiction  to  call for and examine the  record  of\tsuch<br \/>\nproceedings. The judgment of the Bombay High Court on  which<br \/>\nreliance  is placed refers to Sec. 149 sub-clause 9  of\t the<br \/>\nMaharashtra Co-operative Societies Act, 1960. It is no doubt<br \/>\ntrue  that  the phrase &#8216;any proceedings in which  an  appeal<br \/>\nlies  to it&#8217; is identical in the two statutes i.e. Sec.\t 150<br \/>\nclause 9 of the Gujarat Co-operative Societies Act and\tsub-<br \/>\nclause 9 of Sec. 149 of the Maharashtra Co-operative  Socie-<br \/>\nties,  Act, 1960. This language makes it clear that  if\t the<br \/>\nproceedings  where  the final order is\tappealable  then  it<br \/>\ncould  not be said that these are the proceedings  where  an<br \/>\nappeal\tlies to the Tribunal and it is in these\t proceedings<br \/>\nthat the jurisdiction has been conferred on the Tribunal  to<br \/>\ncall for the record and examine the matter. In this view  of<br \/>\nthe  matter, in our opinion, the view taken by the  Division<br \/>\nBench of the Gujarat High Court in the present case  appears<br \/>\nto be correct and the High Court was fight in coming to\t the<br \/>\nconclusion  that the Tribunal had jurisdiction to  call\t for<br \/>\nand  examine the record i.e. exercise  revisional  jurisdic-<br \/>\ntion.  Although this was the only question which was  stated<br \/>\nin the certificate issued by the High Court, learned counsel<br \/>\nalso  attempted to contend that the view taken by  the\tHigh<br \/>\nCourt  on the first question as to whether the Registrar  is<br \/>\nnot  competent\tto review his earlier decision\tbut  in\t our<br \/>\nopinion even on<br \/>\n<span class=\"hidden_text\">900<\/span><br \/>\nthat  ground the view taken by the High Court appears to  be<br \/>\ncorrect.\n<\/p>\n<p>    When the respondent submitted his dispute to the  Regis-<br \/>\ntrar  and the Registrar after examining the matter  came  to<br \/>\nthe  conclusion that it was a dispute which could be  enter-<br \/>\ntained within the scope of Sec. 96 and therefore referred it<br \/>\nto  his nominee for decision. It could not be  doubted\tthat<br \/>\nthe Registrar exercised jurisdiction under Sec. 96 and\tcame<br \/>\nto the conclusion and therefore the High Court was right  in<br \/>\ncoming to the conclusion that once the Registrar takes\tthis<br \/>\ndecision  he has no power to review his order. In this\tview<br \/>\nof the matter we see no reason to entertain this appeal. The<br \/>\nappeal\tis therefore dismissed.
